PRESENT: Commiseioners Anderson, Balser, Daly, Pratt and Sorenson ABSENT: Commissioners Knopp and Robertson OTHERS PRESENT: lItansU1', Nicklin, Rogezos, Hulse, lItoGlassonand Talley M:o. James E. Daly assumed his seat as a member of this Commis- sion, having been appointed by the City Council to fill the office formerly held by Mr. Berky.' In the absence of ChaiI'lll8.ll Knopp, Mr. Balser presided as Chair- man pro tem. The minutes of the mee'ting 01' May 11, 1954,' were a;>proved as written and mailed. PU1'suant to noticeg1 ven, a public hearing was held on the appli- cation of E. W. Bates for a ohange of zCI1e fi'om..Zone R-2 to Zona 0-2 or Zone PR-2 on a small portion of the abandoned Southern Pacific rigl:lt of way, looated at the rear of the Bates property at 850 South Baldwin Avenue.' No commnrrtcatlons d1rectly affecting the proposed change 01' zone were reoeived. The Seoretary announced that he was in receipt of a petition signed by fifteen residents of Fairview Avenue, protesting the use or R-2 property, looated at 653 Fe.i1'view Avenue, by Bates Chevrolet for the parking and storage of automob.11es in con- nection wi th their business and that he had oontaoted Mr. Bates as of this date and had been assU1'ed that the violation would cease. He further stated that 'an inspeotion of the proPllIl"ty this evening showed that the automobiles had been removed. Mr. HfUto1d Woodruff, Sales Manager .for Bates Chevrolet, stated that the property in question con- tained about 2300 square feet and had no Iloceae from any street except through their property now zoned C-2 and requested that the small parcel carry the s8ll1e zoning as the balllnoe of the11" property. Mr. Floyd Hill, 616 Fairview Avenue, opposed the granting of the change of zone on the ground that it might lead to expansion in the future and that there should be some buffer zone between the present commercial and residential zones. Commissioner Anderson aalted M:o. Woodruff if a park1ng overlay would be satisfactory. A later d1scussion between the City Attorney and the Planning Consultant brought out the fact that a parking overlay would not give the l'ight to use the property as de- sired by the applicant. No other person desired to be heard. The Chairman. declared the heazoin8 olosed and requested that each Commis- sioner view the property and that a report be submitted by the Plan- ning Consultant fozo consideration at t be ne,o; meeting. As noted in the minutes of M~ 11, the Collll11ssiOI?- considered the recommendation of t he City Engineer regarQine; requi~ments for maps of lot splits, suggesting that such map s be required to be prepared by registered engineers or licensed sU1'vsyors and that the $2$.00 par lot recreation fee be required to be paid for all new lots created by a lot split. The C1ty Engineer pointed ou, the fact that maps presently being submitted in ~ cases were not drawn to scale or - 1 - $-2$- 5!~ r . . were not of uniform size and were difficult of interpretation. The Commission a~eed that the recreation fee should be charged but hesi- tated to increase costs to an applicant for a lot split. After a lengthy disoussion entered into by all the Commissioners. the Plan- ning Consultant and MarShall Pond. representing Morris Finley. Surve veyor. motion \vas made by Mr. Pratt. seconded by Mr. Sorenson and unanimously carried by roll call vote that the City Attorney be instructed to prepare regulations for the submission of maps for lot splits as reoommended by the City Engineer'sletter of May 11. with the exoeption that a tentative map be submitted for oonsideration by the Commission and 1f granted. a final map to be prepared and filed for permanent recoI'd. and in the oase of imprcved lots. a field sur- vey shall be IIl8.de showing the exact looation of suoh improvements in relation to existing and proposed lot linea. Tentative map of Tract No. 20555. located at the west end of Lemon Avenue and Ala tel' Avenue was reported on by the Subdivision Com- mittee. Mr. Pratt st~ted that the street layout was in compliance with approved plans of the City but that Lots 4. 7 and 8 seemed of un- reasonably shallow depth. Motion by Mr. Pratt. seconded by Mr. Balser and unanimously carried by roll call vote that the tentative map of Tract No. 20555 be held in abeyance and that the subdivider be re- quested to submit more info:nnation as to the depth of the lots. Revised tentative map of prOposed Tract.No. 20290, located at the north end of Bella. Vista Drive was submitted for oonsideration. This traot was approved by the Commission on Apl'1l 13 and denied by the City Council on April 20 beoause of a proposed 50-foot street. The revised map showed the proposed street to be 60 feet wide. A report from the City Engineer stated that all lots oonformed to the zoning ordinance in area except Lot 6 ,and that Lots 6 and 7 were less than 7$ feet in width. It was the opinion 'of the Commission that oertain ohanges should be made in lot frontages even though such ohanges would reduce the lot areas below 7$00 square feet. Motion by Mr. Pzoatt. seconded by Mr. Balser and unanimoUSly oarried by roll call vote that the revised map of Tract No. 20290 be recommended for approval subjeot to the following conditions: 1. Dedicate to the City a two-foot wide lot at each end of "AR Street. 2. Rearrange the frontages of lots as follows: Lot 4, 86 feet; Lot 5. 86 feet; Lot b. 70 feet; Lot 7. 70 feet; Lot 8, 86 feet. 3. That the "frame row houses". shown on Lot 6, be removed or be made to oonform to the zoning and building ordinances. 4. That the frame house shown adjacent to the rear Une of Lot 7 be removed or be made to oonf'orm to the zoning and building ordinances. A communioation from Alfred Allen suggested a procedure tor hand- ling expenses incurred by a subdivider in subdividing property and in- stalling improvements adjacent to and which might be used by property not included in the subdivision. This is follOWing up the idea invas- tigated by tha Subdivision Committee in a meeting with the subdividers held on Ma;r 10. 'J.'he suggestion was' that a buffer strip between the subdivision and property adjacent to the subdivision be deeded to a title company to be held under an irrevooable trust for a period of ten years or until such time as the adjacent property pays a pre- determined smount to represent !il pro rata share of the cost of the improvements installed by the subdivider, such payment to be refunded to the subdivider. and that if such payment is not made at the end. of ten yenrs. then the property shall be deeded in fee to the City of Arcadia by the trtlstee. The amount of PfqlI1e1lt required shall be de- termined by negotiations between the subdivider and the City Engineer and be approved by the Planntng Comm1ss::on. The city Attorney dictated Resolution No. 155, declaring the policy of the Planning Commission'1n reference to the orderly subdivision 01' property. Motion by M1>. Pratt. seoonded by Mr. Sorenson and olU'rled that Resolution No. 155 be adopted. The City Attorney presented Resolution No. 153, recomnending the gro.nting or a' zone varianoe to permit the constzouction and mainte- nance or an addition to the United Parcel Service Bullding, located at Santa Anita Avenue and Lucile Street. The findings in the resolu- tion were read o.nd discussed. Motion by Mr. Sorenson, seconded by Mr. Anderson and carr1ed that the reading of the body of the resolu- tion be waived. Motion by Mr>. Pratt. seconded by Mr. Balser and oarried that Resolution No. 153 be adopted. The City Attorney presented Resolution No. 154. reoommending ths granting or the petition or Charles C. Ano,arson o.nd others for a change of zone !':rom Zone R-1 to Zone R-2 on Lote 1. 6 and 9. Tract No. 10532, looated on South First Avenue. The f'1nci1ngs of the reso- lution were read and discussed. Motion by Mr. Pratt, seoonded bI Mr. Sorenson and olU'ried that. the reading of the body of the resolut on be waived. Motion by Mr. Balser, seoonded by Mr. Sorenaon and car- ried toot Resolution. No. 1$4 be adopted. Adlsoussion was held regarding approval or the location or houses in Zone R-l coaatructed at looations other than the !':ront building line. It was the oonsenuus of opinion that suoh III proval should be oonsidsred by the Modi1'ication Committee. Mr. Balser reported upon a mee1;ing held with. the Health and Sani- tation Commission on May 19 to consider petitions signed by various residents protesting present regulations. regarding the keeping or poultry and suggestIng certain changes. Motion by Mr. Pratt. seoonded by Mr>. Anderson and carried that the Planning Commission 1s cognizant of the problem of the prevention and oontrol of fl1es and odors; tb.at the Health and Sanitation Commission 1s 'now giving consideration to such problem; that the remediee suggested 1n the petitions submitted ar.e unwarranted at this tillB; and that thIs Commission reOOJllllleM to the City Council tb.at no aotion be taken on the pet1tions at this time. The Chairmen instzouoted the Secretary to write to Mr. Berky oom- mending him and thanking him for his work on the Commission during the term which has l'eoently ex,pired.
