PRESENT: Commissioners Acker, Balser, Daly, Robertson and Vaohon " ABSENT I Commissioners Pratt and Sorenson OTHERS PRESEN~1 Camphouse, Mansur, Nioklin, Rogers, MoGlasson and Talley The minutes of the meeting o~ December 28, 1954, were approved as written and maIled. Pursuant to notioe given, a public hearing was held on the proposal to change the zone on Duarte Road between First Avenue and Third Avenue from Zones R-l, R-2 and R-3 to Zones R-2, 0-0 and 001 as contemplsted by Resolution No. 177. Preceding the opening of the meeting to the public hearing. the Chairman and the Planning Consultant explained the usee allowed in the newly oreated C-O and 0-1 Zones and also the uses eliminated from Zone R-3. A communication from Mr. Bishop Moore, representing Roger Moore, owner of property at 150 East Dusrte Road, was read wheroin he objeoted to the commercial zone on Duarte Road and also to the opening of an alley south or Duarte Road. The report of the Plan- ning Consultant was read. Mr. Joe Barll, ~l East Duarte Road, spoke on behalf arhimsel~as owner ot property at the northeast cor- ner of Second Avenue and Duarte Road, and Mr. James Slemons. owner ot property at the northwBst corner ot Second Avenue and Duarte Road. He stated that Zone C-l would be favored by each of them ~ith the possible exceptton of the Slemens property, on which a 5000 square foot limitatIon of building might present a problem in the fUture. He also stated that Mr. Slemons would grant land for the widening of Duarte Road. Second Avenue and the opening of an alley at the rear of the property. With the exce~tion of the limitation on building size, he favored the change to Zone C-l. A copy ot his remarks was filed with the Secretary. Mr. Robbins presented h1a 01ln map showing rezoning recollllllended by him, including additional territory in Zone R-2 not under oon- sideration by the Planning Comm1ss1on, and recommending that Duarte Road be changed to Zone C-2 instead of c-o or C-l aa contemplated in the Resolution. He went into lengthy detail. describing the separate paroels of property aD shown on his map. He recommended that an alley be opened north of Duarte Road and that the City take steps to acquire the outlet to First Avenue. He pointed out that an alley south of Duarte Road would be difficult on account of no access from First Avenue or Second Avenue. He recommended the tmmediate widening of Duarte Road between First Avenue and Second Avenue but stated that dedication ot.land for the widening ot Duarte Road and the opening of an alley north of Duarte Road would cause hardship to some of the property owners by reason ot the reduced lot depth remaining. He, also called attention to proceedings now under way in the City of Monrovia to zone portions of Duarte Road as far west as Mayflower Avenue for commerctal use. He also recommended that the entire southerly port10n of the property be placed 1n Zone R-2 instead of R-2 and R.l ae proposed by the COllllll1asion on the ground that the R-l property at the extreme rear of the lot ~ould not be useable. Mre. H. L. Landon, 125 EQst Duarte Road, stated that she felt the trees oere a hazard to traffic and should be removed; also that the resident1al character of t he neighborhood was gone and favored rezoning for commercial purposes. No other person desired to be heard. The Chairman deolared the hearing closed and requested that ' each Commissioner view the property and that the Planning Consultant submit a written report at the next meeting. Also, that copies of Mr. Earll's and Mr. Robbins' remarks be submitted to each Commis- sioner. The Commission considered the deoision on the application of H. A. Valentine for a change of zane from Zone R-3 to Zone C-2 on the northeast 'corner of Live Oak Avenue and Second Avenue. A com- munication from Edward J. Till of Stephen W. CUnningbam and Associ- ates stated that they had checked ,the uses permitted within the now Zone C-l and found that those uses would meet all the require~ ments or their client for the subject property and requested that the application for zone change be modified to request a change of zone from Zone R-3 to Zone 0-1 instead of Zone C-2 ae filed. A renort. of the Planning Consultant was read, stating that Live Oak Avenue between Santa Anita Avenue and Sixth Avenue would be the ne~t area to be reported on for possible rezoning to Zonee C~O and C~l. He recommended that the present application not be approved at the present time and that the subject property be con- sidered along with the study of the entire street. It was the consensus of opinion of the Commission that no rezoning should be granted at the pressnt time and thst the entire area be considered in one prooeedings. The City Attorney pointed out that under the requirements of Ordinanoe Bo. 760, the Planning Commission must reach a decision 35 days after the holding of a publiC hearing. He stated that on account 01' this time restriotion, he had pre- pared a rough draft of a resolution to be considered in this case. Upon instruction of the Chairman, Resolution No. 180, recommending the denial of the requested reclassification from Zone R-3 to Zone C-2 was presented and read. Motion by Mr. Robertson, seconded by Mr. Daly and carried that Resolution No. 180 be adopted. The Commission considered a decision on t he application of :Reuben V. Senior and others for a change of zone trom Zone C-2 to Zone M-l on portions of Las Tunas Drive and Live Oak Avenue between Santa Anita Avenue and 81 Mon~ Avenue. A report t'rom the City Engineer stated that he felt tb1s was purely a zoning matter with no e~1neering requirements involved. A report trom the Planning Consultant stated that in his opinion M-l use ot property on Las 'l'unas Drive would be undes1rable to both the residential and COlll- mercial property on the north side 01' the street and recOllllllended the denial of the applbation. However, he aug~eated that consid- eration might be given to some reolassification for this property ~f sll ingress and egress was by way of Live Oak Avenue and the Las Tunas Drive frontage was protected by. masonry wall and landscaping. - 2 - 1-11-55 41 . Mr. Vachon called attention to the inoonsistency of this ap- plication stating that Las Tunas Drive prop~rty ~as not suited to comme~cial uses ~,d the application of H. A. Valentine stating that additional commeroial property wa~ needed on Las Tunas Drive. Mr. Robertson stated that in hiB opinion thB present development of commercial uses on Las T4nas Drive was a detriment to good com- mercial uses. Motion by Mr. Robertson, seoonded by Mr. Vachon and carried that the City Attorney be instructed to prepare a resolu- tion recommending the denial ot the application. The req~est of the Teu.ple Clty '-hamber of Commerce that the name of Sunset Boulevard within the City ot Aroadia be changed to Temple City Boulevard was oonsldered. Protests were received from E. M. Halph, 710' Sunset boulevard; Mr. and Mrs. J.U. Cle.rlinghouse, 710-D Sunset Boulevard; Doris BoCOCk, '110-C Sunset Boulevard; and Mrs. Witt, 718 Sunset Boulevard. A communication from James I. Bailiff, acting post master, stuted that a change in the name of the street without changing house numbers to correspond to the county system might cause more confusion than now exists but that the post office was willing to abide by any deoision of the City. A report from the City Manager stated that the various departments had no recommendations to make. Motion by ~. Vachon, seconded by Mr. Acker and carried that the request ~or the change of name be reoommended for denial. The o~fer of the Arcadia Unified School District to dedicate land for street purposes at the Camino Grove School 'and requesting that the street be named Camino Grove Avenue was reported on by the Subdivision Committee, who felt that the two-foot strip at the west end'of the proposed dedication shoul~ be controlled by the City of Arcadia instead of the Sohool Board. Mr. Robertson felt that a meeting between the Subd!viaion Committee and the Sohool Board might be well. ~e II18tter was held and the Chairman Buthor- ~zed the Subdivision Committee to meet with the School Board in'an attempt to reach same mutually satisfactory agreement. fhe request of Don A. Young, 4l0East Longden Avenue, to divide property was reported on by Mr. Daly. rhis request was to divide an existing lot 120 teet by 145.4 feet into two lots, each to be 72.7 teet wide and 120 teet deep and stated that the exist- ing dwelling on the property would be removed and two new homes built. A reoort from tbe City Engineer was read. Mr. Daly stated thet in his opinion it would be a definite improvement to the neighborhood. A prior phone call from Mr. Sorenson to the Secre- tary concurred with the reomme~atlon ot Mr. Daly. Motion by Mr. Daly, seconded by Mr. Acker and carried that permission to divide Lot l,.Tract No. 14359 into two lots eaoh 72.7 feet in width ~~d facing Fifth Avenue be recommended tor approval subject to the following conditions I 1. That a flnal map prepared by an engineer or surveyor be submitted; 2. Tbat a sewer lateral be constructed tor the additional lot; 3. '!hat the $25.00 recreation tee be paid on the additional lot. ' The request of E. C. Roy, 1114 Fairview Avenue, to divide the rear of his property and sell it to Daniel L. Cooper, 1015 Sunset Boulevard was oonsidered. The request proposed a division of prop- erty 65 feet by 84 feet at the rear of the Fairview address to be added to the rear of the Sunset Boulevard address. Mr. Daly stated that the location of buildings on the Fairview property prohibited the division of any wider width and that he saw no' - 3 - 1-11055 . . disadvantage to the proposed dlvlsion. A prlor phone call from Mr. Sorenson stated substantially the same facta. Motion by Mr. Daly, seconded by Mr. Vachon and oarried that permission to divide the Southerly 65 feet of the easterly 84 feet ot Lot 52, Tract No. 2731. to be added to the Southerly 120 feet ot Lot 53 of sald tract be recommended for approval, Gubject to t he filing of a final map prepared by an engineer or surveyor. A COMmUnIcation from the Los Angeles County Flood Control dis- trict set out theIr 'reasons for asking that Doshier Avenue be opened for street purposes between Highland Oaks ~ive and the Flood Control spreading basin and debris disposal area. The Plan- ning Consultant reread a statemant trom bis report of November 23, 1954, recommending the denial of the request. The report of the City ~nglneer, dated November 23, 1954, was reread. . Mr. Robertson stated that as a resident of the area, he felt the matter should have full consideration before any action was taken. Motion by Mr. Daly. seoonded by Mr. Balser and carried that the Flood Control District be re~uested to send a representative to meet with the Planning Commission, the City Angineer and the Planning Consultant to present further information as to the Gource of the debris to be',hnuled, truck routes to be used, and the saving 01' time and ex- pense by the opening 01' this additional aocess to the disposal area. Second revised tentative map of Tract Ho. 21122. located east of Sixth Avenue and south of Longden Avenue, was presented and con- sidered. This revised map proposed the elimination of two lots shoIDn on previous maps, resulting in 14 lots in the traot, each having a width of more than 75 teet and a depth of approximately 110 feet. The matter of maklog the p~posed street parallel with the Santa Anita Wash was disoussed. Motion by Mr. Robertson. seconded by Mr. Daly and oarried thatseoond revised tentative map of Tract No. 21122 be recommended tor approval subject to the fol- lowing conditions: 1. That funds bs deposited for streetlights in aocordance with a plsn to be obtained trom the ~dison Company; 2. That a deposit be made for street trees and reoreation fees as required by Ordinance No. 860; 3. That all improvements conform to existing city standards; 4. That all property within the subdivision, including a small triangle lylog west of Lot 7 be annexed to the City ot Aroadia; 5. 'nw.t the subdIvision be developed with or after Tract No. 18820; 6. 'l'hat the tangent portion 01' the street be made parallel to the Santa Anita Wash right of wa7. A communication trom the 01ty Engineer and City Manaser trans- mitted from the City Council the request ot Mr. Paul Burkholder that the City oonsider the annexation of additional territory located west ot Baldwin Avenue and consider what, if any, of the area should be favorably considered tor annexation if such a request is sub- mitted. 1'he Cheirman requested that the Planning Consultant submit . a report on the matter, that copies of a map be furnished to each Commissioner and thet each Commissioner view and study the area. fhe request of Dorothee de Pont, 1430 South Tenth Avenue, to divide property was referred to Mr. Sorenson and Mr. Acker to in- vestigate and report. - 4 - 1-11-55 o . The Chairman stated that he had had telephone calls complain- ing that lots 10 'fract No. 18616, located on Firth Avenue south of Duarte Road, had been approved at approximately 67i-foot mldths ~hile aareements ~ith the Subdivider required that the lots be 6~ feet in width. The Chairman asked if coples of the map were available. the Secretary produced oopies of the approved tentative and final maps. Mr. Robbins,' Subdivider, stated that the matter had resulted from a misunderstanding and that the engineer had changed the map and that it now provided for the lots at 6~l-foot wldth. The Secretary oalled attention to the faot that the approved maps as signed by the City Clerk. City Treasurer, Oity ~glneer and other offlo~ale provided tor lots having e width of 67.55 feet and questioned the authority for the ohange of the map t'11thout re= turning it for further approval by the Plann~ng Commission and the City Council. The matter was briefly disoussed and no action ~as taken. The Chairman appointed Mr. Vachon as a member of the Subdivi- sion Committee. t1l1ing the Vacancy caused by the expiration of the term of Mr. Knopp. Mr. Robertson requested that Dames and ad- dresses of all Planning CommissioDers be furniehed to each Commis- sioner. Attention was called to the meeting of the Southern California Planning Congress to be held at the Shrine Club in Arcadia on January 13. 1965. The City Attorney. pres~ Resolution No. 179. instituting pro- ceedings for the oonsideration ot a change ot zone from Zona R-3 to Zonas C-O and C-l on certain property on Huntington Drive be- tween Michi11inda Avenue and Holly Avenue. Motion by Mr. Robertson. seconded by Mr. Vachon and carried that the reading of the body of the Resolution be waived.
