PRESJi;NT: Commissioners Acker, Balser, Daly, Pratt, Sorenson and Vachon ABSENT: Commissioner Robertson OTHERS PRESENT: Nicklin, Rogers, McGlasson and. Talley The minutes of the meeting of January 25, 1955, approval of which had been delayed pending a communication from the Los Angeles County Flood Control District, were discussed. A communication from H. E. Hedger, Chief Engineer of the District, and signed by Paul Baumann, requested that the above mentioned minutes reflect that Mr. Laverty quoted in part from a letter written to the City of Arcadia, dated April 21, 1952, which called attention to the fact that the extension of Doshier Avenue might be needed in the tuture. iath this addition, the minutes of the meeting of January 25, 1955, were approved and the minutes of the meeting of February 8, 1955, were approved as written and mailed. ~ -:,1 Request of l\Jrs. Margaret C. Horn and !.;rs. Neva J. Herndon for division of property at 9935 Camino Real was revorted on by Mr. Sorenson and W~. Balser. This property is located on the north side of Camino Real, west of Baldwin Avenue, in territory recently an- nexed to the City of Arcadia and is zoned R-3. The request was to divide a lot III feet wide into two lots of 55.5-foot frontage each, ~pon which the applicants proposed to build two apartment houses. Mr. Sorenson called attention to the fact that the lots would be only 4! feet narrower than required by the Subdivision Ordinance in Zone R-3 but would contain ccnsiderably more area than required and that such division would be in line with other divisions previously granted in Zone R-3. Motion by Mr.. Sorenson, seconded by hlr. Balser and carried, that permissim to divide ~he West III feet of the east 322 feet of the south 176.1 feet of Lot 8, Block A, Santa Anita Land COllrpany's tract into two parcels each having a frontage of 55.5 feet be recolllDl8nded for approval subject to the following condi tions: 1. That a final map prepared by an engineer or surveyor be filed with the City Engineer; 2. That a sewer lateral be provided for each parcel; 3. The. t a recreation fee of ;;25.00 be paid for the newly created parcel. Request of Zucalia A. Peck, 483 West Duarte Road, to divide property cre.atIng a neW lot facing La Cadena Avenue, was reported on by Mr. Sorenson and Mr. Balser. The division requested met all re- quirements of the Subdivision Ordinance. Motion by Mr. Sorenson, seconded by Mr. Balser and carried, that permission to divide the South 75 feet of the north 225 feet of Lot 49, Tract No. 3430, be recommended for approval subject to the following conditions: 1. That a final map prepared by an engineer or surveyor be filed with. the City Engineer; 38 2. That a recrea.t1on fee of $25.00 be paid f or the neW paroel. Request of Charlotte L. Sutton for division of property at 303 East Longden Avenue. on which action was deferred at the last meeting, was considered. The Secretary reported that measurements had been taken on the lot and that to provide sufficient clearance from the existing house, the application should be amended to request a divi- sion of 83 feet instead of 85 feet. Mrs. Sutton was in the audience and consented to the. above amendment. A communication from Mrs. Sutton stated that the south entrance of the existing house would be used as a side entr~ce only and that the existing north entrance would become the main entrance to the building. Motion by Mr. Sor- enson, seconded by Mr. Vachon and carried, that permission to divide the South 83 feet of the east 100.92 feet of the west 601.84 feet of Lot 106, Arcadia Acreage Tract. be recommended far aoproval subject to the following conditions: 1. That a final map prepared by an engineer or surveyor be filed with the City Engineer; 2. That a sewer lateral be provided for the new loti 3. That a recreation fee of ~~25.00 be paid for the new lot. Request of D. C. Wheeler. 228 East Sycamar e Avenue, for divi- sion of property wa.s reported on by Mr. Pratt. Mr. Robertson had also viewed the property and had concurred with the ideas expressed by Mr. Pratt. This request was to divide 88 feet by 180 feet from the front portion of Lot 10. Tract No. 12834. and 84.5 feet by 140 feet from the front portion of Lot 11, leaving a lot on the rear por- tion of each lot with access to Sycamore Avenue through a 3D-foot private driveway. A oommunication from R. W. Guiwitz. 238 East Syca- more. living on a lot similarly divided in 1948. reoommended that the request be granted. Mr. Pratt stated that a similar request had been den.ied as being poor planning to create a lot in the rear with access only by a private drive. Motion by Mr. Pratt, seconded by Mr. Vachon and carried. that the request be recommended for denial and that the applicant be advised to attempt a better solution by study and subdivision of the entire area. Application of Rady F. Cross.. 210 East Sycamore Av'enue, to divide property was considered. This request was to divide a lot 80 feet by 150 feet from the front portion of Lot 12. Tract No. 12834, leaving the rear portion of the lot with access to Sycamore Avenue only by a 2O-foot private driveway. A~. Pratt stated that this a-pplication was exactly similar to the t of D. C. Wheeler above men- tioned and that the same conditions applied. Another application rom Patricia Hughes. 250 East Sycsmore, requested permission to divide a lot 79.61 feet by 140 feetfromt he front portion of Lot 7, Tract No. 12834. leaving the rear portion with access to Sycamore Avenue by a 2O-foot private drive only. It was pointed out that this application was exactly similar to the others mentioned above. Motion by Mr. Pratt, se~onded by Mr. Vachon and carried. thst the application of Rady F. Cross and that of Patricia Hughes be recom- mended for denial and that they be advised to confer with other property owners in the vicinity in an attempt to work out a subdi- vision of the entire area. Tentative map of Tract No. 21200. looated on Coyle Avenue east of Third Avenue, was considered. A communication from Charlotte L. SUtton, SUbdivider. stated that she is attempting to buy additional land to add to the subdivision In order to provide more frontage to the lots but that no definite decision had yet been reached. The matter of resubdividing a portion of Lot 15. Tract No. 19593. to provide additional area in this tract was discussed but was not - 2 - 2/23/55 . . considered feasible. Motion by Mr. Pratt, seconded by tJr. Vachon and unanimously carried by roll call vote, that tentative map of Tract No. 21200 be recommended for approval subject to :the following conditions: 1. '~at the subdivider secure not less than 15 feet frantag~.fran Lot 106, Arcadia Acreage Tract, to be added to this tract to 'increase the lot frontages; 2. That all improvements, deposits and fees required by the SUbdivision Ordinance be complied with; 3. 'fhat a 5-foot planting and sidewalk easement be provided on each side of Coyle Avenue. Final map of Tract No. 21033., located on Doolittle Avenue was considered. This area had tentative approval as a portion of Tract No. 00600.' As shown on'the tentative map of Tract No. 20600 all of the lots except Lots 5 and 6 of this Tract No. 21033 contained over 7500 square feet. In the present final map all .of the lots are slightly under the required 7500 square feet and have a frontage of less than 75 feet. In the opinion of t~e Commission the lots as shown are in substantial compliance with the requirements of the Subdi vis ion Ordinance and are not inconsistent with other prop- erties in the vicinity. Motion by Mr. Pratt, seconded by Mr. Daly and unanimously carried by roll call vote, that final map of Tract No. 21033 be recommended for approval as being in substantial com- pliance with the Subdivision Ordinance, subject to the following con- ditions: 1. Deposit for ten street trees at ~5.OO each; 2. Payment of recreation fee of ij,25.00 per lot; 3. Deposit for street lights to be determined by Edison Com- pany's plans; 4. Lot 7 to be dedicated in fee to the City for the control of future extension of the street. The Commission considered Tract No. 20642, located south of Foothill Boulevard and east of San Carlos Road, which had previously been recommended for approval but had been denied by the City Council until more access was provided. A report of the Safety Committee to the City Council, dated December 30, 1954, stating that more access was deSirable, was read. Mr. Salsbury, Subdivider, and Mr. Finley, Surveyor, addressed the Commission and stated that they had made every attempt to secure cooperation from the owners adjacent on the east for the extension of the street but had not met with. any suc- cess. A copy of a communication from the Division of Highways to Mr. Finley stated that the Division would not recommend an additional roadway opening into Foothill Boulevard at this location, as 11:; would cause too many intersections in close proximity. The Subdivider and Surveyor were informed that there was no further action that this Commission could take and they were advised to resubmit the matter to the City Council. Pursuant to notice given, a public heE.ring was held on the appli- cation of George and Edith J. Bartron, owners, and the Church of the Good Shepherd (Methodist), purchaser, for a change of zone on a por- tion of Lot I, Tract No. 4090, located at 424 West Duarte Road, from Zone R-l to Zone R-2. A communication from the Church of the Good Shepherd requested that the setback on this particular pr~perty be changed from 50 feet to 30 feet to correspond with the setback now existing on the prollerty owned by the Church. Mr. .Edward Butterworth, 1145 Slngingwood Road, represented the Church. He stated that .it was their intention to purchase the Bartron property and add it to the prollerty now owned by the Church and to improve it and use it for - 3 - 2/23/55 . . . . church purposes. He stated that all of the o~ners of property within 300 feet of the site except three had signed the ap~li~ation as being favorable to the zone change. Rev. Thatcher Jordan stated that parking on the site plus park- ihg now permitted on the Holly Avenue. School grounds would meet the requirements of the ordinance. The City Engineer recommended that 12 feet be dedicated for the future widening of Duarte Ro~d. Mr. Butterworth stated that he was sure the church board Vlould agree to such a de.dioation. No other party desire d to be heard. Motion by Aw. Pratt, seoonded by Mr. Acker aQd carried, that the City Attorney be instructed to prepare a resolution recommending the granting of the application for a change of zone from Zone R-l to Zone R-2, sub- ject to the dedication of 12 feet for the future widening of Duarte Road and that the request for change of setback from 50 feet to 30 feet be recommended for approval. Applioation of Myer Wolkoff, 654 West Huntington Bo~levard, for a change of setbaok from 35 feet to 15 feet was disoussed. This re- quest had been held in abeyance pending the deoision on proposed zone ohanges on Huntington Boulevard. "I'he COllimission discussed the fact that no off-street parking is provided on this lot except in the front setbaokarea and that a chaQge of setback would require all parking to be on the public str.eet or on property owned by. other parties. Motion by Mr. Sorenson,. seconded by Mr. Daly and carried, that because of the lack of parking soace, the application for change of setback be recommended for denial. \ \ ( The Commission again considere.d <;Jounty territory west of Bald- wih Avenue for ~ossible future annexation to the City. It was thought that itmlght be an advantage to the City to have all or a portion of this property annexed in order to control zo~ing and future development. A report from the Planning Consultant recom- mended that if property were annexed, it should include to a line 660 feet west of the center line of Baldwin Avenue. Motion by Mr. Acker that the Planning Commission would look with favor on petitions to annex area located generally east of a line 660 feet west of the center line of Baldwin Avenue and extendihg from Duarte Road to Live Oak Avenue. Said motion was seconded by Mr. .sorenson and carried by the following vote: AYES: Commissioners Acker, Daly, Pratt, Sorenson and Vachon NOES: Commissioner Balser ABSENT: Commissioner Robertson The Secretary informed the Commission that a petition for annexa- tion of property south of' Longden Avenue and east of Sixth Avenue had been filed with the City Clt;lrk. This petition covers certaih property included in Tract No. 18820 and Tract No. 21122. fhe an- nexation of this property was a condition recommended in the approval of the above numbered tracts. Motion by Mr. Pratt, seconded by Mr. Vaohon and carried that approval or this annexation be recommended. Final ma'p of Tract No. 21454, located on Sixth Avenue south of Leda Lane, \'Ias considered. Report from the City Engineer stated that the map conformed to the approved tentative mati. Motion by Mr. Pratt, seoonded by Mr. Vachon and carried, tha,t final map of Tract No. 21454 'be re.conmended for approval subject to the following con- di tions: 1. Payment of recreation fee of ~25.00 per lot for the 5 lots; 2. Ten street trees at ;~5.00 each; 3. Two street name signs at $25.00 each; 4. Deposit for street lights as required by plan to be sub- mitted by the Edison Company. - 4 - 2/23/55 t ~ . . . . Mr. Joe Earll addressed the Commission rega.rding the matter of proposed change of zone to Zone C-O or C-l on Duarte Road. He sub- mItted a copy of his remarks including a list of 14 questions and requested that the questions be answered. !lir. Bal.:Ier briefly answered some of the questions. He st&.ted that at times the Commis- sion held hearings on zoning to determine the wishes and at.tHude of the public and tna.t recommendations of the Planning Consult~nt were not always followed in full. Also that it was not practical to delay decisions 'J)ending a full attendance of all the members of ,the Commis- sion. The letter was ordered filed. Mr. Balser questioned the City Engineer regsrding the widening 0 of Duarte Road and pointed out the hazardous condition adjacent to the High School. Mr. Rogers stated that work was now under way to secure right of way to widen portions of Duarte Road and that the budget for expenditure of fund's for the coming year had not yet been prepared. He stated that the matter would be followed up as rapidly as po ssible. The City Attorney presented Resolution No. 182 recommending that no change be made 1n the zoning on Huntington Boulevard between Michillinda Avenue and Holly Avenue at the present time. The find- ings in the resolution were relld and discussed. Motion by ,Mr. Vachon, seconded by Mr. Pratt and carried, that the reading of the entire body of the resolution be waived. Motion by 1;lr. Merriam for a zone variance to permit the construction of a medical building located west or 540 West Huntington Boulevard. The findings in the resolution were read, discussed and amended. Considerable discus- sion was held regarding the requested pharmacy, which was not recom- mended for approval by the Commission. Motion by IIlr. Daly, seconded by Mr. Vachon and carried, thut the reading of the entire body of the resolution be waived. Motion by Mr. Sorenson, seconded by Mr. Daly and unanimously carried by roll call vote, that Resolution No. 183 be adopted. The City Attorney presented Resolution No. 184, recommending that no change be made in the zoning on Duarte Road between First Avenue and Second Avenue at the present :time. The findings in the resolution were read and discussed. Motion by Mr. Paly, seconded by }w. rratt and carried, that the reading of the entire body of the resolution be waived. Motion by Mr. Sorenson that Resolution No. 184 be adopted. Said ,motion was seconded by Mr. Daly and carried by the following vote: AYESI Commissioners Balser, Daly, Pratt, Sorenson and Vachon NOES: Commissioner Acker ABSENT: Commissioner Robertson Mr. Robbins requested permission to examine reports submitted by the Plannlng Consultant. He was told tlmt these reports are public records and could be viewed in the office of the Planning Commission. Mr. Acker inquired about action on the proposed architectural de- sign zone submitted by the Planning Consultant. Chairman Balser in- formed him that the repor.t had been duplicate'd and given each Commis- sioner for study and could be brought up for discussion at sny time destred by the Commission. '!'he City Attorney stated that before this design zone could be put in operation, it must be included as an amendment to Ordinance No. 760.
