PRESENT: Conun.1ssioners Acker, Balser, Daly, Pratt, Robertson, Sorenson and Vachon ABSENT: None OTHERS PRESENT: Hulse, Mansur, Nicklin, Rogers, McGlasson and Talley The minutes of the meeting of July 12 were approved as written and mailed. (c.O The request of James Kosturas, 220 West Foothill Boulevard, to divide property was reported on by Mr. Pratt and Mr. Robertson. A tePortfrom the City Engineer pointed out that if the lot split were granted it would entail the construction of a new sewer main from Rancho Road and the dedication of an easement for the sewer. . Also that tract restrlc.tlons appeared to prohibit more than one single family dwelling per lot. Mr, Robertson stated that t~e proposed lot would meet requirements as to frontage and area but that the two lots proposed facing Foothill Boulevard would require 50-foot setback leav- ing very little available building space. '\. Mr. Sheldon Milliken of Baker-Marlowe Company spoke on behalf of Mr. Kosturas and stated that in his opinion there were conflicting statements in the deed restrictions. He stated that they had a pro- Bpective purchaser for the corner portion of the lot who planned to build a $30,000.00 residence. Due to the fact that tract restrictions apparently allow only one house per lot, motion was made by Mr. RObertson, seconded by Mr. Balser and carried, that the request for division be recommended for denial. ~ The request of Charlotte L. Sutton to divide propert,yon Third v , Avenue at Las Flores waf! reported on by Mr. Sorenson and Mr. Acker. i A report from the City Engineer pointed out that this division contem- II plated the exte.nSion of Third. Avenue t.o connect with Las Flores Avenue and that all improvements would be required to meet the Subdivision 'I Ordinance. Parcel No.2 was shown as having a width of 71.42 feet ~ which conforms to adjacent lots in the area. Motion by Mr. Sorenson, ! seconded by Mr. Acker and carried, that permission to divide portions ; of the South 180 feet of Lot 106, Arcadia Acreage Tract, be recom- , mended for approval subject to the following conditions: 1. That a final map be filed with the City Engineer; 2. That a sewer lateral be installed to service the new lots; (p l '. , 3. That Third Avenue and Las Flores Avenue be dedicated for '\ street purposes and improved as required by the Subdivision Ordinance; , . 4. That a two-foot strip along the northerly line of the parcel lbe deeded 1n fee to the City to control street extension; J 5. That 12 feet be dedicated for the widening of Second Avenue; 6. That recreation fees of $25.00 each be paid for the two new ~ts created. The request of .Maude P, Kelso, 844 MUrietta Drive, to divide property w~s reported on b~ Mr. Va~hon.and Mr. Balser. The request.. - 1 - 7/26/55 .. . was to divide a narrow strip from Lot 84, Tract 11215, to be used with Lot 85. A communication from Rancho Santa Anita, Inc. stated that the remaining portion of Lot 84 conforms to all tract requirements. Motion by Mr. Vachon, seconded by Mr. Balser and carried, that permis- sion to divide the easterly portion of Lot 84, Tract No. 11215, having a width of 13 feet along Murietta Drive and 45 feet at the rear of the lot be recommended for approval subject to the filing of a final map with the City Engineer. Because no new lot is being created, no recreation fee will be required. . The request of Dewey T. Capps, 456 West Lemon Avenue,was re- ported on by Mr. Balser and Mr. Daly. This division would create a lot 71.41 feet wide by 130 feet deep, being larger than adjacent lots to the west. A report from the City Engineer stated that such a divi- sion would require the easterly extension of Wisteria Avenue. Motion by Mr. Balser, seconded by Mr. Daly and carried, that the request to divide the South 190 feet of the west 71.41 feet of Lot 65, Tract No. 4869, be recommended for approval subject to the following conditions: 1. That a final map be filed with the City Engineer; ,3 2. That Wisteria Avenue be extended east including dedication and improvement as required by the Subdivision Ordinance; '2. 3. That a two-foot parcel at the end of Wisteria Avenue be dedi- cated in fee to the City to control street extension; 4. That a recreation fee of $25.00 be paid; 5. That the one-foot parcel existing at the present end of Wis- teria Avenue be dedicated for street purposes. n The request of Margaret A. Scheffk, 1012 South Mayflower Avenue, to divide property was reported on by Mr. Acker and ~~. Sorenson. This division would create two lots having frontages of 53.75 feet which conforms to other divisions previously approved in this area. ~ach parcel would have more than the required area. Motion by Mr. ) Acker, seconded bY.Mr. Sorenson and carried, that permission to di.vide the South 107.5 feet of the west 208.78 feet of Lot 17, F. A. Geier Tract, into two lots each being 53.75 feet wide be recommended for ~4 ~pproval Bubject to the following conditions: 1. That a final map be filed with the City Engineer; 2. That a recreation fee of $25.00 be paid for the additional lot created. Tentative map of Tract No,. 22087, located on Louise Avenue north of Woodruff Avenue was considered. A report from the Planning Staff Committee called attention to the fact that Lot 2 would have less than 75-foot width at the building line and recommended that the northerly line of Lot 2 be moved to the north to provide 100-foot width at the rear line of said lot. The Subdivider also requested permission to change the width of Lot 6 from 81.25 feet to '75 feet and Lot 8 from 75 feet to 81.25 feet. Mr. Hopen, Engineer for the Subdivider, ~pproved changing the dimensions of Lot 2. Motion by Mr. Robertson, seconded by Mr. Vachon and carried, that tentative map of Tract No. 22087 be recommended for approval subject to the following conditions: 1. Increase the width of Lot 2 to 100 feet at the rear line; 2. Change the width of Lot 6 from 81.25 feet to 75 feet; 3. Change the width of Lot 8 from 75 feet to 81.25 feet; 4. All 1mprovementsto meet the requirements of the Subdivision Ordinance including recreation fee of $25.00 per lot and 14 street trees at $5.00 each; 5. Street lights to be installed in accordance with plan to be submitted by the Edison Company. - 2 - 7/26/55 . . Revised tentative map of Tract No. 19107, located north of Syca- more Avenue and east of the Santa Anita Wash, was considered. A re- port from the Planning Staff Committee called attention to the fact that the Flood Control District state that the tract would be subject to a flood hazard. Also, that a triangular piece of property lying east of Lot 21 would be a substandard lot. Mr. Beckwith, Subdivider, stated that this land would be transferred to the adjoining property to the south; also that a narrow strip of land east of Oakg1en Avenue and across from Lots 12, 13 and 14 would be dedicated for street or added to adjacent property. Motion by Mr. Robertson that revised tentative map of Tract No. 19107 be recommended for approval subject to the following conditions.: . 1. That any work required by the Flood Control District be done to reasonably protect the tract from flood hazard and that such pro- tection be subject to the approval of the City Engineer; 2. That the right of way at the northerly end of Oakglen Avenue be widened to provide a turn-around; 3. That the two small parcels of adjacent property be trans- ferred to other properties; 4. That ~ll improvements and deposits be made as required by the Subdivision Ordinance. Said motion was seconded by Mr. Vachon and carried by the following vote: AYES: Commissioners Balser, Daly, Pratt, Robertson, Sorenson and Vachon NOES: Commissioner Acker Request of Anthony J. Foto for a change of setback at the north- east corner of Santa Anita Avenue and Live Oak Avenue was considered. A zone variance previously granted on this property has expired but the property is included in that now under consideration by the City Council for possible .zone change to some commercial zone. Because of the additional time required for setback change proceedings, Mr. Foto requested tha'l; t):1ose proceedings be iniUated prior to the final de- termination of the zoning. Ha stated that a portion of the property at the corner had been leased to Union Oil Company for the erection of a filling station, leaving a portion facing Santa Anita and a portion facing Live O~{ included in the former variance with no present plans for development. The Commission agreed that they were not in favor of business property faCing Santa Anita Avenue north of the proposed filling station site but had no objection to the elimination of the setback requirements on the portion to be used commercially. viotion by Mr. Balser, seconded by Mr. Daly and carrit!d, that this Commis3ion recommend the removal of the setback requirement on Live Oak Avenue and also the removal of the setback requirement on Santa AnitaAvenue for a distance of 125 feet north of Live Oak Avenue. Motion by Mr. Balser, seconded by Mr. Vachon and carried, that the attention of the City Council be called to the fact that rezoning on Live Oak Avenue, as recommended by the Planning Commission, would include a commerc.ial lot north of the above mentioned filling station site and that in the opinion of the Commission this area should remain in Zone R-3 and sl10uld be given such consideration in the fir,ul determination of the City Council affecting the zoning on Live Oak Avenue. The request of Rancho Santa Anita, Inc., for a change of setback to allow a commercial sign at the property line of Huntington Drive located at the Rancho shopping ~enter was considered. Mr. Davies presented a plan of the proposed sign. The actual signboard ha~ a size of 12 feet by 22 feet and the overall height of its supporting structure is 41 feet, 6 inches. The sign was' to be located in the Rancho parking area with no encroachment over city property. Mr. Robertson stated that in his opinion there should be some regulation to control the size and height of signs within the City. Motion by Mr. Sorenson, seconded by Mr. Acker and carried, that this Commission - 3 - 7/26/55 .. . recommend to the City Council that the necessary proceedings be taken to amend the setback ordinance to allow the erection of this requested sign at the property line and with no encroachment over the public street. The request of Carpenter'.s Santa Anitan Cafe for a change of set- back to allow the erection of a sign at the property line at 125 West Hunt~ngton Drive was reconsidered. This proposed sign has a height of 25 feet. 9 inches. Mr. Robertson again raised the question of con- ' trolling height and size of signs, Motion by Mr. Acker, seconded by Mr. Daly and carried. that this Commission recommend to the City Council that the necessary proceedings be taken to amend the setback ordinance to allow the erection of this requested sign with no en- croachment over the public street. The matter of increasing the size of allowable lath houses and glasshouses for private use was reported on by a committee composed of Mr. Acker. Mr. Sorenson and Mr. Vachon. This committee had met with a group of hobbyists and it was the general opinion that the present 11mdt of 500 square feet was not of ample size to allow the various conditions required for the raising of tropical plants. Some discussion was held as to whether such plant raising might develop into commercial business if the size of glasshouses were increased and it was the consensus of opinion that this would be a matter of enforc- ing zoning ordinances and that the size of the building probably would not contribute to violations. Motion by Mr. Vachon. seconded by Mr. Sorenson and carried, that the City Attorney be requested to prepare the necessary reso~ution to recommend changing the present limite on glasshouses and lath houses substantially as follows: 1. That the size of such houses not exceed 10% of the vacant rear yard of the property mea~ured from a point 25 feet to the rear of the dwelling and that in.no case should such houses exceed 1500 square feet in areaj 2. The proposal to annex certain property west of Baldwin Avenue and south of Camino Real was again considered along with possible zoning which might be established in the area. Mr. Gacomsk~. owner of a se~ert- ~partment building at 1530 South Baldwin Avenue, objected to further southerly extension of commercial zoning, sta~i~g ~hat it would be det1.'imental to his investment. Miss Vinsonhaler. J.602 South Baldwin Av~nue, stated that ther~ was no demand for residential property on B~ldwin Avenue. In view of the fact that an amended petition for annexation is to be filed and that the amended description of the boundary of the annexation had not yet been secured from the Bound.ary "o!1llllission. no act,ion was tn.ken on the matter. The Planning Consultant recommended that a new zone be created to be designated as Zone CM. Motion by Mr. Vachon. seconded by Mr. - 4 - 7/26/55 . . " . . (/ It Daly and carried that the City Attorney be requested to draw the. necessary resolution to institute proceedings to amepd the Zoning Ordinance by the creation of a new Zone CM and that the Planning Con- sultant prepare a list of proposed uses to be allowed in the zone. The matter of possible rezoning on West Huntington Boulevard was again considered. Mr. Vachon stated that it was his opinion that the City Council desired a zone to perm1t certain professional uses with- out the need of considering variances for each individual case but that in his opinion rigid control should be maintained by the Planning Commission because of the fact that Huntington Boulevard is the main entrance to the city. Motion by Mr. Vachon, seconded by Mr. Acker and carried, that the City Attorney be requested to draw the necessary resolution to institute proceedings to establish a limited C-O Zone which might be applied to the property located between Baldwin Avenue and Holly Avenue.. Under this limited zone,restriction would be placed 'on the height of buildings, the setback from the street, required parking, landscaping, etc. The matter of acceptance of a deed from the Unified School Dis- trict for Camino Grove Avenue was considered. ~he deed which had been executed by the School District and tendered to the City proposed that the westerly two feet of the street be retained in fee by the School District to control the future extension of the street. Motion by Mr. Robertson, seconded by Mr. Sorenson and carried, that the acceptance of the deed by recommended to the City Council. The City Attorney presented Resolution No. 198 recommending the granting of the application of Ben F. Smith, Inc., for a zone variance to permit the construction and operation of a service station at 250 West Colorado Boulevard. The matter of the height of a required fence along the southeasterly line of the prqperty was discussed and the resolution amended accordingly. Motion by Mr. Daly, seconded by Mr. Acker and carried, that the reading of the entire body of the resolu- tion be waived. Motion by Mr. Sorenson, sec.onded by Mr. Acker and carried, that Resolution No. 198 be adopted. Chairman Pratt appointed Mr. Robertson, Mr. Balser and Mr. Vachon to serve 0::1 the Subdivis;1,cn Committee for the coming year.
