TO: ALL CITY COUNCnMEN AND PLANNING COMMISSIONERS SUBJFX:T: PLANNING COMMISSION MINUTES The City Planning Commission met in regular meeting with Vioe Chail'll1an 'Vachon presiding. PRESENT: Commissioners ACker. Balser. Daly, Sorenson and Vachon. ABSENT: Commissioners Pratt and Robertson. OTHERS PRESENT: FOrbes. Mansur, Nickl1n, McGlasson and Talley. The minutes of the meeting of January 6, 1957, were approved as written and mailed. Pursuant to notice given, a public hearing was held on the proposed change to Zone C-M with a "D" overlay on property bounded by Las Tunas Drive, Live Oak Avenue and El Monte Avenue. A COllllllunication from R. V. Senior, 119 West Live Oak Avenue. requesting favorable consideration of the proposed change, was read. The Secretary read a cOllllllUnication from l1r. and Mrs. Duke Westland, Route 4, Box 2150, Vista, California, owners of the property at 151 West Las Tunas Drive. protesting the zone change on the basis that it would allow for encroachment of induatry into a residential area. A colllll1Unication from Mr. and Mrs. John T. S1mpson, 2715 El Monte Avenue, filed August 21, 1956, was also read, in which they protested the proposed change on the basis that it would cause devaluation of property values. Mr. Balser asked whether those invo~ved understood the CooM Zone and the restrictions of a "D" overlay. The secretary read the allowable uses in the C-M Zone and the requirements of the "D" overlay. Mr. Ardene BOller, attorney representing R. V. Senior, Mrs. Coates and Ludwig A. Z1ma, spoke in favor of the proposed change to Zone C-M. He stated that this was an adequate and proper solution to the "triangle" problem. He pointed out the measures taken to protect adjacent residential property. Mr. Everett J. Till, representing Ralphs Grocery COl11pany, urged the Commission to approve the zone change. 'He expressed the opinion that adequate consideration had been given to proper development of the area.. Mr. Ross Himes. owner of approximately 10 acres on the north side of Las 'J)unas Drive at Santa Anita Avenue, stated that he isin'.1'avor of' the proposed .change. . .Ur. W. S. 5PaU14ing, 175 West Live Oak Avenue, also spoke in favor of the proposed ohange. Mr. John Orsi, 241 Woodruff Avenue, presented two petitions protesting the proposed rezoning, each bearing 16 signatures of property owners. He stated that the group which he represented had respect for the work that the Commission had done on this matter, but were totally opposed to the solution. He stated that he wants Il10re time, and requested that there be no :l.mmediate decision. Mr. Bill Messick, 156 Sandra Avenue, presented two petitions protesting the proposed rezonimg, one bearing 23 signatures, and the other 20 signatures. He also requested additional til1le to study the situation. Mr. Balser requested that a committee be fonned to meet wi:t;h the residential property owners adjacent to the triangle in order to clari1)r the uses allowable in Zone C-M and the restrictive conditions of the IIDII overlay. Mr. Vachon expressed the opinion that the proposed plan would upgrade the area cOl11pared to its present usage. Motion by Mr. Balser, seconded by Mr. D~ and carried that a committee consisting of Conunissioners Balser, Daly and Robertson meet with property owners adjacent to the triangle before the next regular meeting in an effort to c1ari.1}r the situation, with the public hearing to be continued to the meeting of February 13, 1957. The Secretary was instructed to arrange a date tor this meeting. Pursuant to notice given, a public hearing was held on the proposed change to Zone C-M with a "D" overlay of property on the west side of FUth Avenue north of !funtington Drive. The Secretary read the application trom 1-22-57 Dale L. Harvey and Resolution No. 239, which adds to the original application. The Secretary read a communication from the City of Monrovia requesting that the proposed zone change be held in abeyance until Fifth Avenue can be re- surfaced' to handle commercial traffic. Mr. Dale 1. Harvey, owner of part of the property in question, addressed the Commission in favor of the zone change. He stated that he was considering selling the property which was..notoccup~ed.. by apartments. He stated that D. B. MilliIren, owner of a portion of the subject property is also strongly in favor of the zone change. Mr. E. J. Altmeyer, owner of the ~Tagon Wheel J:.lotel and other property north of Huntington Drive, east of Fifth Avenue, expressed opposition to the proposed change. He stated that the property should remain in Zone R-3 or be placed in general commercial zone rather than Zone C-M. r10tion by Mr. Acker, seconded by l-lr. Sorenson and carried that the hearing be continued at the next meeting on February 13, 1957, for the sole purpose of receiving reports from the Staff and the Planning Consultant. The Oity Engineer was requested to contact the City of J:.!onrovia regarding repaving Fifth Avenue. The proposed rezoning from Zone R-l to Zone R-2 of property at the rear of 900 to 1010 North First Avenue, was oonsidered. The report of the Planning Consultant, recommending that the zone change be granted, was read. Motion by Mr. Sorenson, seconded by 111'. Acker and carried that the .City Attorney be instructed to draw the necessary resolution to recommend the rezoning of pro- perty looated at the rear of the dwellings at 900 North First Avenue to 1010 North First Avenue from Zone R-l to Zone R-2. Lot split No. 39, being the request of D. C. Wheeler, Jr., to divide property at ;!28 East Sycamore Avenue, was reconsidered. This split had bean referred to Mr. Balser and l-lr. Sorenson to investigate. Mr. Balser stated that he was in sympathy with l.u-s. l'iheeler. He pointed out the diffioulty of obtain- ing land for street dedication at the rear of the property due to the commercial devel"pment on Foothill Boulevard. He mentioned a siInilar lot split which had been made at 242 East Sycamore, prior to adoption of the Subdivision Ordinance. Mr. Sorenson concurred with r1r. Balser. He st.ated that the split should have been carried the full length of the lot. Motion by Mr. Balser, seconded by Mr. Sorenson and carried that the request to divide portions of lots 10 and ll,Tract No. 12834, be recommended for approval subject to the following conditions: 1. That a tinal map be tiled with the City Engineer; 2. That a sewer lateral be provided for both new- parcels; 3. That a recreation fee of ~50.00 be paid (previously paid)) 4. That curb and gutter be installed along Sycamore Avenue for the full width of lots 10 and ll; 5. That two separate l~;j~oot drivewavs be provided for access to the rear of the lots. Lot split No. 137, being the request of J. A. Stoker to divide property at ll32 South Fourth Avenue, was considered~ The report of the City Engineer was read. Mr. Vachon stated that all requirements have been met. He pointed out that the utility poles are at the front on 'Fifth Avenue, whereas they would have been better located at the "rear of the new lot. Motion by l-lr. Acker, seconded by Mr. Daly and carried that the request to divide the easterly 150 feet of the southerly 100 feet of lot 47, Tract No. 808, be recommended for approval sub.1ect to the following conditions: 1. That a final map be fUed with the City Engineer; 2. That a recreation fee of $25.00 be paid. Lot split ~o. 138, being the request of Lois Eberly to divide property at S08 l'Test Lemon Avenue, was considered. The report of the City Engineer was read.. Mr. Vachon stated that this split conforms with others previously granted in this area. l1otion by Mr. Acker, seconded by Mr. Daly and carried that the - 2 - 1-22-57 /- the request to divide the southerly 180 feet of the westerly 65.70 feet of lot 69. Tract 4869, be reconunended for approval subject to the follOldng coriditions: 1. That a final map be filed with the City Engineer; 2. That a sewer lateral be provided for parcel 2; 3. That 59 feet of the lot be dedicated and improved as required by the Subdivision Ordinance for the extension of Wistaria Avenue, including dedication in fee of a 1 foot strip along the southerly and westerly sides of the lot; 4. That a recreation fee of ~5.00 be paid. Lot split No. 139. being the request of Dora H. Georgan to divide property at 1406 S.outh First Avenue, was considered. The report of the City Engineer was read. llr. Sorenson pointed out that this split would create a landlocked parcel, but that there was an attempt being made to subdivide at the rear of this property. He stated that Urs. Georgan had expressed willingnesS' to dedicate 30 feet for future street development. He stated that parcel 2 should be an even 150 feet instead of 150.92 feet. Mr. Sorenson asked the City Attorney whether the split could be approved contingent on the provisions of Mrs. Georgan's letter of January 14, 1957, and future subdivision of the area. The Secretary was requested to read Mrs. Georgan's letter in which she agreed to dedicate and improve 30 feet for the extension of Greenfield Avenue. Mr. Hege I, attorney for ~!rs. aeorgan, el>.llressed the opinion that a covenant could be drawn controlling the 15 foot access e3.sement and the future street dedication. He stated that the property transaction was in excrow dependent on granting of the lot split. He further stated that the excrow terms require adequate ingress and egress. The City Attorney stated that the 15 foot easement should automatically cease tThen ingress and egress are available from public streets. The City Attorney inqtU.red about item 2 on the City Engineer's report, regarding a reservation of right to dedicate rear line utility easements over parcels 1 and 2. The Assistant City Engineer stated that this item had been included, because the exact position of such easement could not be determined at this time. Mr. Balser stated that he would agree to the 15 foot easement. provided it was used only for maintenance of the property. Mr. Sorenson inquired about removal of unusable builciings. i1r. Hage I stated that it would be less expensive to remove these buildings ~Jhen the grading work for a new subdivision was done. 110tion by Hr. Sorenson, seconded by Mr. Balser and oarried that the request to divide the northerly 174 feet of lot 4, Tract 806;' be recollllll8nded for approval subject to the following conditions: 1. That a final map be filed ,41th the City Engineer; 2. That a recreation fee of $25.00 be paid; 3. That parcel 2 be 150 feet depth; 4. That the easterly 30 feet of parcel 2 be dedicated and improved all Greenfield Avenue when the street is opened in the area; 5. That there be a reservation of right and agreement to dedicate rear line utility easements over parcels 1 and 2; 6. That the adjustment of side lot lines shall conform t9 a future subdivision; 7. That the 15 foot easement along the south line of the property be used solely for maintenance of the property, and further that said said easement be vacated when Greenfield Avenue is extended; 8. That no buildings be constructed on parcel 2 until access is available from Greenfield Avenue; 9. That the nonconforming bulldings be removed. It l-TaS further stipulated that conditions 4, 5, 6. 7, 8 and 9 shall be included in a oovenant recorded with the property. - 3 - 1-22-57 ,~ Lot split No. 140, being the request of WIn. J. Hornung to divide p1!operty at lll.4 Sunset Boulevard, was referred to Mr. Balser and Mr. Vachon to investigate. The Secretary read a'collllllWlication from the City Engineer relating to right of wq for the east branch of the Arcadia Wash. The report requested approval of location of this right of wq as shown on Map No. 10$-ML-J.4. as submitted by the Los Angeles County Flood Control District. Motion by Mr. Balser, seconded by Mr. Sorenson and carried that the location of right of wq for the east branch of the Arcadia Wash be recommended for approval. Vice Chairman stated that Ma;yor Camphouse had requested the COIlIII1ission to make suggestions for items to be included on the agenda of a joint meeting with the City Council to be held on January 29, 19$7. The COIIIIIliasion suggested the following matters for discussion: 1. Future planning and zoning on Duarte Road between Baldwin Avenue and Filth Avenue. 2. Proposed rezoning to Zone C-o with "D" overlq on the south side of Huntington Boulevard from Baldwin Avenue to Holly Avenue. 3. Future zoning on the north side of Live Oak Av.enue. 4. Comprehensive plan of the City proposed by the City Council. $. Annexation of territories to the City. 6. Plans for future use of the property recently acquired by the City at Santa Anita Avenue and Duarte Road. The City Attorney presented Resolution No. 240, recolllD1ending the reclassi- fication of certain real property on i~orth First Avenue from Zone R-l to Zone R-2. l-Iotion by Mr. Acker, seconded by Hr. Daly and carried that the reading of the full body of the resolution be waived. Motion by Mr. SOrenson, seconded by Mr. Balser and carried that Resolution No. 240 be adopted.
