Pursuant to tbe continuance of July 23, 1957, tbe public bearing was resumed on 1lesolution 259, deal.ing witb the reclassification of the north wst eorner of Second aad . .;Live oak Avenues to Zone D. Tbe Secretary read the report prepared by the Zoning CollllD1.ttee and the staff, recommending that if tbe Commission as a whole deems it necessary that Zone ,D requil'elll8nts be placed on the property, that they should pertain to the construction of a wall,landscaping and lighting. Mr. Michler stated that ha and Mr. Forman had met with tbe Secretary and studied the eusting requirements of Zone C-l and felt that these additional recommended requirements would safeguard tbe res1dential property and not be detr:lmeDtal to the subject property. Mr. ADderson objected to the recommended change to Zone C~~. stating that his original application was for Zone C~2, and that the application pointed out that it 1IOuld not be econ01ll1.cally poss1ble to give the land for the new: street in the proposed subdiv1sion to the north unless a change to Zone C-2 ware granted. He referred to the giving of the land for street purposes as a price to be paid for zoning, stating that he was willing to pay such a price foe Zone C-2 but not for Zone C,.I. It was pointed out that at a previous study of this entire area, the Commission determined that no commereial zoning should be granted along the north side of Live Oak Avenue unless and until necessary street widenf.Dg was assured. that an alley be opened to serve tha rear portion of the property, and necessary streets opened to serve the reSidential property te~tba.DOrtb. Park. subdivider of the property to the north. stated that in return for about 11,000 square feet of land for the street in the new subdivision. Hr. Anderson was to receive a 7,5000 square fool: lot on the new street, I and that the improvement of the new street would be paid for by the subdivider. Hr. Robertson stated thet in his 6pud.on. the discussion should be limited to the '. qOostion of the Bone D requirements and that tbe question of whether the land should be placed in Zone C-l or Zone C-2 was not a matter for discussion. because the Commission had already made e ret:Ollllllellclati01l to the Citf Council. Mr. Anderson stated tbat if tbe recommended Zone D restrictions were in reference to Zone C-2 be would have 110 objection to thSlll. but that stalle they were with reference to a proposed Zone C-l. he felt that bis application had in effect been clanied and that he saw no point 1n stattag whether he favored or opposed tbe matter. )btion by Hr. The City Attorney presented and reae the Utle of Resolution 261 recommending tbe classifieation of certain real property at the northwest corner of Sec:ond Avenue and Live Oak Avenue to Zone D in addition to the baSic zoning heretofore reco~nded, and recollllll&I1ding the architectural restrictions to be applicable thereto. The contents of the resolution were s\lllllllarized end discussed. Motion by Mr. Robertson, seconded by Mr. Acker and c8%ried that the reading of the full body pf the resolution be waived, Motion by !>II'.
