HomeMy WebLinkAboutOCTOBER 22, 1957 MINUTES PLANNING COMMISSION OF THE CITY OF ARCADIA REGULAR MEETmG OCTOBER 22, 1957 The City Planning Commbsion of the City of Arcadia met in regular session 'in the Council Chamber of the City Hall, with Chairman Vachon preaiding. ROLL CALL PRESENT: Commbsioners Acker, Forman, Michler and Vachon MINUTES LEAVE OF ABSENCE TRACT NO. 19836 and LOT SPLIT NO. 175 ABSENT: Commissioners Davison. Pratt, and Robertson OTHERS PRESENT: Councilman Phillips, Nicklin, Carozza, Talley and Mrs. Andrews. The minutes of the meeting held October 8, were approved as written and mailed. Moved by Commissioner Vachon, seconded by Mr. Michler, and carried that a leave of absence of 30 days be granted to Commissioner Robertson because of illness. This covers a portion proposed to be used for Church purposes. Mar' designating this property was presented. The report of the Subdivbion Committee and the Staff was read showing that the general street pattern indicated by the original tentative map With the overlay forms an acceptable street pattern. In general, the lots formed thereby are of standard size and shape. The five acre parcel now under consideration for a zone variance was studied and a tentative layout made for the subdivbion of this area. This should be used in the event'the variance is .not,: granted, or if granted, not used. This' is s hillside area and thereby presents some definite problems regarding drainage and building site preparation. No grading plans have been indicated, nor is there a method shown for disposal of the drain~ge of this subdivision. Mr. Carozza advised the Committion of the various problems in connection with this subdivision as indicated in the Report of the Staff and Subdivision Committee. Mr. Egil Hopen, 311 W. Las Flores Avenue. Arcadia, stated that the tract was laid out for the reason that at the time a map was submitted for the lot split which is for the 5 acres out of the 50 acres, he was requested to layout the subdivision. To do that a topography of the hills had to be made, and this would cost in the neighborhood of $2.000.00. The map as sub- mitted about 30 days ago, is not officially a subdivision map but only to show.how this particular piece of land to be used by the Church fits In with the street pattern as a whole. The grading plan was not considered, and the Oberly Estate had no desire to subdivide at this time. The Commission had in mind to conaider the 17 acrea at one time, the subdivision and the lot,aplit. This was for the purpose of those people living in the area being apprised of what the dev- elopment of the rest of the property Would be. The location of access roads into the area was important to the future dev- elopment of the land. 10/22/57 - 1 - , ZONE VARIANCB (Church of Ret. Science) YARD VARIANCE (Seimer) r-. "'--_/ Mr. Walter J; thomSon" one of' the executors of the Oberly Estate, stated he had filed a petition for a lot split approximately 6 to 8 weeks ago, representing about 5 and a fraction acres, for the purpose of permitting the Church of Religious Science to develop the area. He was told that it would be necessary to file a ,tentative subdivision map because this proposed lot split predicated a future subdivision. The estate had no plans at the present time for do,ing anythi~g more than selling the 5 + acrea to the Church. A future subdivision, while a possibility, was not under consideration at this time. He felt that it would make a hardship on the estate to incur additional expense and delay the matter for a considerable time. Mr. Vachon stated that in order to seU tbe 5 + acres, it would be necessary to go along with tbe subdivision because of the necessity of obtaining an access road to this area. This is essential, otherWise the 5 acrea would be a land-locked parcel of land. Mr. Thomson stated that Mr. Hopen had made provision access roads and had made changes from time to time. stated that the Estate did not intend to develop the at this time. for the He again subdivision Mr. Nicklin inquired if the estate had plans to dispose of other parcel a in the near future and was informed there was no other deal pending. It was brought out that for tax reasons the Oberly estate planned to sell no more than 5 parcels within a one year period. Because of illness, members of the subdivision committee were not present. The chairman requested permission to continue the matter. Mr. Thomaon, speaking for the Oberly estate, stated that he would waive, the 'necessity of acting on the subdivision within the time limit specified in the8tate Subdivision Map Act. Motion by Mr. Ac!ter, second by Mr. Nicbler and carried that since the estate waived the limitations in the statute, Tract 19836 and Lot Split No. 175 be held over to November 12, to allow the Subdivision Committee to again review the matter. Inasmuch as this particular application is for land included in Tract No. 19836 and Lot Split No. 175, which were held for further review, motion was .made by Mr. Forman, second by Mr. Acker and carried, tbat tbe zone variance for the Church of Religious Science, which was held over for staff reports, be continued until November 12. Pursuant to the continuance of October 8, Mr,. Acker presented ,the report of the Modification Committee. The original request of. the applicaDt to build two new houses with detached garages met all yard requirements. The applicant had requested permission to construct attacbed garages to make the houses appear larger. .Thisplan allowed 30 feet 10 inches and 32 feet between the attached garages and the existing house. The Modification Committee agreed with the attached garage plan and granted tbe request. Mr. Meldrum, 1212 South Sixth Street, stated the driveway doesn't meet present requirements as it is a public street going back to a business and must be open for trucks. Mr. Carozza explained tbat no driveway can be'.interpreted as a street in any respect because of tbe uSa. Mrs. Genevieve Dexter, 1205 S. Sixtb, inquired why a house was permitted to be built 3 feet short ~f the 35-ft. limit on the back of the lot. It was explained that the MOdification Committee had preferred that the garage be attached to the bouse; that had the applicants followed the plan originally submitted, they were within their right to build under the ordinance in effect then. .,~- ;. LOT SPLIT NO. 179 ,r-' '-_/ Motion by Mr. Il'.orman, second by Mr. Michler and' carried, that the appeal from the decision of the Modification Committee be denied and that the yard variance be allowed as recommended, with the stipulation that the egg house could not 'be devel- oped as a building unit. Pursuant to notice given, a public hearing was heldon the application of the Richfield Oil Corporation for a zone variance to allow installation of flood lights and signs on property located at the northwest corner of Santa Anita Avenue, and Foothill Boulevard. The proposed plot plan was submitted. The Chairman stated this was the time and place for public hearing of this application for zone variance and asked for public comment. Don G. White, manager of real estate for Richfield Oil, 645 S. ~~riposa. Los A~geles: stated they proposeino buil- dings in the set-back area; only the normal type signs granted by municipalities are requested for advertising, and flood lighting adequate for the driveways and operation of the station. The signs would extend beyond the set-back 'area'and two posts would support the signs over the sidewalks because"of trees. Raymond Dam, 340 E. Green Street, Pasad~na, developer of the property, requested explanation of the ordinance which might prevent part of this property on Santa Anita from being used for another business. l1r. Nicklin explained that this is a matter of division of property, and that the owner of the property should be notified, before a building permit is issued, that the appli- cation must be considered as one covering the entire lot, so that he can take whateyer action he deems advisable for future use of the remaining portion. The Chairman asked to hear from those opposed to the zone variance. A. J. Vogle, 1125 N. Santa Anita, inquired if this would be the proper..time to request a buffer zone for landscaping, to block the station from view. D. A. McElvary, 1134 N. Santa Anita, stated that, the residents are proud of their neighborhood and opposed to anything that Would detract from it. Mrs. Keaton, 1120 N. Santa Anita, stressed the annoyance which would be caused the residents by too much flood- lighting and glare from headlights. The hearing was continued to November 12, 1957 for staff reports. Robert Nichols, 81: Palm Drive Motion by Mr. Acker,' second by Mr. Michler and carried, that Lot Split No. 179 be, recommended ,for approval subject to tbe following conditions: 1. File a final map with the City Engineer. 2. .Provide a sewer lateral for the new lot. 3. 'Pay a recreation fee of $25.00. 4. Record a covenant that the SO foot by 57.5 foot parcel will not be used as a building site until Birchcroft Street is extended and other land is secured to provide an approved lot. 5. It will be necessary for the City' to dedicate for street purposes a portion of the one foot atrip retained aiong the south line of Birchcroft Street. -3- 10/22/57 . .' . Motion by Acker, second by FC1~n and carried, that this tentative map be recommended for approval, subject to the following conditions: 1. Increase the frontage of lot 8 on the new street by 20 feet. 2. Adjust widths of lots 9 to 14 accordingly. 3. Install all stree~ improvements required by the sub- division ordinance, including curb, gutter and pavement on Colorado Place and Colorado Boulevard adjacent to the tract. 4. Pay all fees and deposits required by the subdivision ordinance, including s.treet lights, street name signs, street trees and recreation fees. 5. Reconstruct the existing sewer to place it within the new street right of way adjacent to lot 8. 6. Reconstruct manhole tops as necessary to provide clearance from the new curb. The City Attorney presented Resolution No. 266 recommending the denial of the request of Arcadia Parking, Inc. for a zone variance to permit a veterinary clinic office at 727 West Duarte Road. The findings of the resolution were read and dbcussed. Motion by Mr. Acker, second. by Mr. Forman and carried that the reading of the full body of the resolution be waived. Motion by Mr. Michler, seconded by Mr. Acker and carried that Resolution No. 266 be adopted. The City Attorney presented Resolution No. 267 recommending the granting of the request of Reuben. V. Senior for a zone variance to permit a pet hospital at 108 West Las Tunas Drive. The findings of the re301ution were read and discussed. Motion by Mr. Vdchler, seconded by Nr. Acker and carried that the reading of the full body of the resolution be waived. Motion by Mr. Acker, seconded by Mr. Forman and carried that Resolution No. 267 be adopted. The Secretary discussed a request which had been received to construct a dwelling at 21 W. orange Grove Avenue. Said property now has a dwelling on the rear portion. The City Attorney stated that because the rear dwelling was a portion of another lot and tract and that the front portion was entirely vacant that no proceedings were necessary to allow the front dwelling, but that a covenant must be recorded to insure that the two parcels of land will be used jointly and not be held in separate ownership.
