The P1anni....g Commission of the C;'.t;l of ;.....cadia met in regular session in tbe Council Chambet of the Cf'::y Hall, at 8:00 o'clock P.M., November 12, 1957, with Chairman Vachon presiding. The minutes of October 22, 1957, were approved as written and mailee. The spplicat.'.on of the Church of Religious Science for a change of zone to allow a church to be located appraxtmate1y 300 feet noreh of Sycamore Avenue was considered. The reports of the Staff and the Zoning Committee were read, pointing out instances where the applicant had not met the conditions necessary for the granting of a variance. It wes brought out that perhaps thg ruling should be made as to the Lot Split and the Subdf.vision. Hr. Thompson, one of the Executors of the Oberly E~tate again stated that they were not interested at this time in furthering the subdivision; that they desired to sell a po;,;tion of the property and the Church was willing .. to purchase. Mr. Michler stated that many times when churches have request~~ aoning that the community has a feeling that it should be in some other area than where the application designates. This also has been the feeling, more or less, with the location of a school. It is granted that the needs are there but ths .location should be elsewhere. He felt that the area could be developed in a much better manner than disclosed in the application; that the owner could obtain a better return for the whole area if it were taken as a whole. Motion by Mr. Michler, second by Mr. Forman, that the appli~ cation for a zone variance by the Church of Religious Science be rec~ndcd for denial for the reasons set out in the report cf. the Zoning Committee and that the City Attorney be requested to prepare the necessary resolation. The motion wes carried by the fOllowing' roll call vote: AYES: CommiSSioner Acker, Davison, Forman Michler, Pratt, Robertson and Vachon. NOES: None Revised tentative map of Tract No. 19836 .tocsted north of Sycsmore Avenue at the north extension of Second Avenus was presented showing the proposed grading of the Tract. The Engineer stated that additional information had been supplied as to the grading. It had been agreed upon by the Engineer and the Ap~licant thet a detailed grading plan would be pre- pared at such time es needed to d.eve10p the area. The Engineer for the Estate .has reviewed the problem and it was found that drainage could be worked out by a st.orm drain into the Flood Control cLanne1 when the tract is developed. He stated that as the lot is J IUd out it sbows that the five acre parcel is a reasonable dsve10pment and the overlay on the lot itself as a separate parcel can be developed. Motion by Hr. Michler, sacond by Mr. Acker, that tentaUve map of Tract ria. 19836 be approved subject to the following conditions: 1. All the a~reets within the subdivision, iucluding the north I'i.~o of Sycamore Avenue and the east side of Cakba"."t Lano, shall be fully 1mI!roved as required by the subdivision ordinance. 2. Pay a:l fees and deposits required by the subdivision ordin~~e. including street lights, strest treea, street name signs and recreation fees. 3. Dedicate tbe necessary land for the widening of Sycamora Avenue and Oakhaven Laue. 4. Instsll all necessary drainage structures 88 required by the City Engineer. S. LOT SPLIT NO. 175 PUBLIC HEARING Ross Himes \~-- Walter J. Thompson, co-executor of the Estate of Mrs. Oberly, 167 E. Sycamore Avenue. Discussion wes had as to whether this lot split should be approved i.Msmuch as the zone vaJ:"i.lnce had been rscOllllDended for denie~ and the Tract sc~tted for the bal&n~e of the property I.ad be"n approved. Mr. Thompson stated that con- 4idaratt~~ Sho~ld be given to the fact that the estate had planned t.) aell a portion of the property, whether it be for church 0" tor another purpose and that the estate should not be denie,d the p~:i.vUege of selling the five acre portion. This prop~rty i~ not located on an improved street, but with the approval of the tentative tract map of Tract No. 19836, it. was indicated as a separate piece of property. Motion by Mr. Acker, second by Mr. Pratt, that lot split No. 175 be uacommended for approval subject to the following condition,;!: 1. Furnish a final map prepared by a registered engineer or land surveyor. 2. Provide a sswer lateral by extending the main line north from Sycamore Avenue. 3. Dedicete the extension of Second Avenue; five feet for widening Sycamore Avenue along lots 11, 12 and 13, and for widening Oakhaven Lane. 4. Pay $25.00 recreation fee. 5. Improve the north side of sycamore Avenue end the extension of Second Avenue with curbs, gutters, sewer, pavement, water and gas to subdivision standards. 6. Pay all faes and deposits required by the subdivision ordinance, including street lights, street trees, and street name signs. 7. Realign the north extension of Second Avenue to conform with !ract No. 19836. The motion was carded by the following roll call vote: AYES: Collllllisaioners Acker, Davison, Forman, Michler, Pratt, Robertson and Vachon. NOES: None. Pursu~nt to notice given, a public hearing was held on the application of Ross A. Himes for a zone variance to ellow three 3-story apartment houses on a portion of the property at the northwest corner of Santa Anita Avenue and Las Tunas Drive. The Secretary presented maps of the area. The Chairmen stated that this was the time and place set for the hearing of this application and requested those in favor of tb1B zone variance to present any material necessary. A communication was received from R. V. Senior, 119 West Live Oak Avenue adviSing the COlIIIDission that he was in favor of this development. Mr. Pat H. O'Malley, acting as Engineer for this development spoke in favor. He felt that the opening of Sandra Avenue was beneficial to tbe erea. Mr. Nate Margolin, the developer of the property, stated that this plan was tentative and that the opening of Sandra Avenue was flexible. The new street designated as ''H1mes Place" could be moved over to the westerly property line. The apartments would all face the street and that eproper lletback would be maintained. He said it was planned to have an area for a swtmm1ng pool for the residentll. Each would have a patio or lanai type area. The drive to the rear ZONE VARIANCE Richfield 011 Co. ~ ' '-- would provide area for automobiles to enter to the garages whicb would be perdally basement garages. The drive would be. one way only. Mr. Margolin stated tbat one of the object- ions be had been told was that it would not provide an even flow of traffic. He felt the plan flexible enough to over- come tbis objection and was willing to revise it. The plan calls for 98 or 97 apartments. The Secretary read s letter from the Arcadia-Monrovia Realty Co. in opposition to the granting of tbis variance for the reason that they felt tbat three story apartments should not be permitted. Mr. Robert E. Moser, 62 West Woodruff Ave. presented written objections from 78 people residing on Woodruff Avenue, Sandra Avenue end Santa Anita Avenue. He stated that the meps did not show any of the surrounding property. He bsd had prspared two diagrams, one sboring tbe location of the adjoining proper- ties; one showing the effect of such a development on their properties. An area equivalent to seven 75 foot lots would accommodate 60 families, together rith their visitors--all using this common drive, creeting a thoroughfare. The height of the buildings would shut off circulation of air and tbat apartments this high would deprive residents of privacy in their back yards. He felt that if Sandra Avenue were opened it should be opened to Santa Anita Avenue. He recommended that the variance be recommended for denial. Mr. Al Clark, 109 Sandra Avenue, stated that to allow this type of development would create an island of humanity and no place for children to play. Mr. Kenneth Street, 74 W. Woodruff Avenue stated that if the apartments were allowed,the sunlight would be kept out of the surrounding properties almost entirely during the winter months. Mr, Joseph Kaufman, 50 W. Woodruff Ave. objected to the loss of privacy and depreciation of property as a result of this development. The public hearing was d~clared continued until the next meeting of November 26, 1957 for the purpose of receiving Staff Reports. Pursuant to the continuance of Octobsr 22, 1957, the public hearing was resumed on the application of Ricbfield Oil Co. for a variance to setback regulstions at Santa Anita Avenue and Footbill Boulevard. A Staff and Zoning Committee report was read by tbe'Secretary. It was pointed out tbat botb other service stations at tbis intersection have flood lighting andtbat i.t ls taken care of in such a manner that it does not present a ~poblem, but that none of the signs project over public property. Motion by Mr. Michler, second by Mr. Foreman, and carried, that the variance be recommended for approval in accordance witb the report of the Staff and Zoning Committee and rith the provision that the signs do not project over public property and that tbe City Attorney be requested to prepare the necessary resolution. The applicant is the owner of. two 100 foot parcels of land. An apartment house exists on parcel No. 1 and it is proposed to build an apartment house on parcel No.2. A driveway 8 feet wide exists slong the north line of Parcell. The applicant requests a driveway 6 feet wide along the south line. of Parcel 2. It is proposed that the two driveways be used in common and it is requested that permission be given to encumber the north two feet of percel No. 1 with a covenant providing that in the event of severance of common ownership of the parcels a commu- nity driveway easement will be conveyed or reserved over the northerly 2 feet of parcel No. 1 for the benefit of parcel No.2. Motion by Mr. Michler. second by Mr. Forman and carried that Lot Split No. 182 be recommended for approval, Bubject to the following conditions: 1. File a final map with the City Engineer. 2. Extend Newman Avenue to the east Una of tha tract with a ona foot wide lot at the end to be deaded to the City so as to avoid a land locked psrcel along the Flood Controi channel. . The City Eng~neer explained in detail the reason the acquisition of these easements are necessary in commencing improvement work on the channel. Motion by Ur.. Acker, second by Mr. Davison and carded thet the request of the Los Angeles County Flood Control District fer acquisition of lend for the Santa Anita Wash be con~~dered as follows: 1. That thG acquisition of slope easements at Camino Real Avenue and Longden Avenue be recommended for approval. 2. That the request for ingress easement on City owned property south of Live Oak Avenue isreccmmended for disapproval. 3. That the scquisition of additional land on the east side of the Santa Anita Wash debria basin aree, lying between approximately Orange Grove Avenue and Grand View Avenue be recommended for approval. This is a request of the Bates C~evrolet for a Zone change on Baldwin Avenue. This applic8tionew8s acted upon by the Planning Commission and forwarded to the City Council for action. The City Council denied the change without prejudice and referred it back to the Commission for further study. Mr. Vachon stated that he felt that this matter should be taken under advisement until the whole area could be etudied at one time. The matter was referred to the Zoning Committee and the Steffto study. Mr. Howser stated that they had been delayed by not being able to obtain an architect of their choice, but that tbe obstacle had been overcome and final plans are now being drafted; and that they anticipated starting construction early in January, 1958. Moved by Mr. Acker, seconded by Mr. Michler and carried that an extension ,of time be granted to Wanz MOrtuary for a zone varian~e for a period of six months. LOT SPLIT NO~ 183 Elsie R.
