November 26, 1957, with Chairmen Vachon presiding. PRESENT: Comm~ssionerB Acker, DaviBon, Forman, Michler, RobertBon and Vachon. ABSENT: CommiBBioL~~ Pratt orHERS PRESENT: Councilmen PhillipB and Reibold, Cook, Carozza Talley and Mrs. Andrews The minuteB of November 12, 1957, were approved as written and mailed. Pursuant to the continuance of November 12, 1957, the public hearing was resumed on t4e application of Ross A. HimeB for a zone variance to allow three 3.story apartment housas on a portion of the property at the northweBt corner of Santa An~ta Avenue and Las Tunas Drive. A Btaff and Zoning Comr4ttee report was read by the Secretary pointing out that a majority of the Bubject property iB presently zoned R-l with Bmall parcelB in zones R-2 and R.3. The applicant proposes to extend Sandra Avenue to the east and open Himes Place, connecting to LaB TunaB Drive, witb tlolO three-Btory apartments facing Sandra Avenue and one three-Btory apartment facing Himes Pla::e. The Committee report Btated that the use of the land for wultiple dwellingB would not be detrimental to R-l property with certain reBtrictionB as to height, yards, wallB, landscaping and street opening. Mr. Michler Btated that he lolOuld recommend that: the Z.:lne variance be recommended for approval. Mr. Vachon stated that by gr.anting a variance ' , in an R-l zone tlIo story apartments could be constructad. ,Mr. Acker felt that 1t would be better to stick to the Ordi.nance as it now stands. At the last Council meeting there was a strong feeling that vurianceB should not be granted except in extreme caBes. VariancsB are BpOt zoning and spot zoning 1B not good for the beat development of the City. Mr. Davison said it appeared to him to be allowing an R-3 development 10 an R-l,zone. This' property is. as Btated, partly R-l, R-2 and R-3. With the variance, some control could be maintained aB to the height of the building, etc. Mr. Carozza Btated that there had been numerouB objectionB filed in connection with thiB variBnce and the Btaff felt tbat a height of 35 feet would be detrimental to the neighborhood. Mr. Davison felt that this waB not the right approach. Mr. Robertson and Mr. Michler f!llt that any zoning req,uestB on thiB property would be met with proteBts. He felt that thiB waB a place where the proper study of land UBe might prove beneficial. Mr. Michler. therefore, moved that the application of Ross A.HimeB for a zone variance to allow three 3-BtOry apartment bouBes on a portion of the property at the nOl:thwest comer of Santa Anita Avenue and Las TunaB Drive be recolDIIISnded for approval, subject to the conditions in the Zoning Committee and Staff report aB follows: NovEllDber 26. 1957 PA!lfl 1. A solid masonry wall 6 feet high shall be erected and maintained along the east side of Himes Place and the south side of Sandra Avenue east of Himes Place, except that such wall shall not exceed 3'6" feet in height from Las Tunas Drive to a point 25 feet north. 4. A strip of land five feet wide on the east and south sides of the masonry wall shall be landscaped and maintained. 5. Sandra Avenue and Himes shall be dedicated and fully improved as provided in the subdivision ordinance. and that the City' Attorney be instructed to prepare the necessary resolution and that the hearing be continued for the adoption of the , resolution. Said motion was seconded by Mr. Robertson and lost by the following roll call vote: AYES: NOES: ABSENT: CollDDissioners Michler, Robertson and Vachon. ColllDlissioners Acker, Davison and Forman COlllDlissioner Pratt The attorney suggested that the hearing. be continued until the maeting of December 10, 1957, for a full attendance of all of the COlIDDission members. Motion by Mr. Michler, seconded by Mr. Robertson and carried, that the hear:l.ng on this variance b!" continued until the next meeting of December 10, 1957. ' Elsie R. Jirschefske and Myrtle W. Null 1140 Eighth Avenue and 1202 Eighth Avenue. Mr. Acker stated that he had viewed this .property and talked to some of the owners. They expressed the desire that the proposed subdivision of the rear of the property be considered before the lot split is recOllmlended for approval. Motion by Mr. Acker. seconded by Mr. Michler, and carried that Lot split No. 183 in the nama of Elsie R. Jirschefske and Myrtle W. Tbe Secretary statedtbat he bad maps and the lagal description for the annexation of the ~ortion of property located on the east sids of Sixth Avenue at the south extension of Eighth AVeD\ls. This annexation was discussed at a previous Planning Commission meeting in cOnjunction with the subdivision that is being developed in this area. Mr. Davison moved that the annexation a8 presented be recommended for approval. Said motion was seconded by Mr. Acker and carried. November 26, 1957 l"2'.~e ?(, LOT SPLIT NO. 185 ZONE VARl'ANOE Richfield Oil Co. DECEMBER MEETING RESOLUTION NO. 268 RESOLUTION NO. 269 Retha M. Mitchell, 1602 South 10th Avenue. The Secretary presented this Lot Split only for the purpose of having it referred to a Committee. Chairman Vachon referred this lot split to Mr. Acker and Mr. Michler. I The matter of the Richfield Oil Company for a variance to setback regulations at Santa Anita Avenue and Foothill Boulevard was presented. The Secretary stated that this was a matter that could bave been handled tbrough tbe MOdification Committee under autbority of Ordinan- ces covering same; tbat tbis variance waG minor in nature and the reason for discussing it at this time was to correct the procedure. The original application bad been made as a variance from the zoning Ordinance., wbile :!.t should, have 'been a modification of' other setback ordinances. Moved by Mr. Michler, seconded by Mr. Robertson and carried that the application of the Richfield Oil Company for a ~dification for set back to allow flood lights and signs in the 10 foot set back be recommended for approval provided that no portion oftbe signs over- hang in the public right of way. The Secretary announced that tbe next meeting of the Commission would be held on the 10th of December witb the second meeting on December 24, Chris tIlIas Eve. It was the opinion of the Commission that the meeting of December 24 should not be held. Motion by Mr. Robertson, second.. by Mr. Acker, and carried that the regulal: meeting to be beld on tbe 24th of December be beld over until the meeting of January 14, 1958. The City Attorney presented Resolution No. 268, Which is a resolution of the Planning Commission recommendingtbe denial of a zone variance to pertll1t the construction and operation of a churcb located on the extension of Second Avenue, northerly from Sycamore Avenue. MOved by Mr. Forman,seconded by Mr. Davison, and carded that the readina.of the body of the resolution be waived. MOved by Mr. Acket:, seconded by Mr. Davison, and carried that Resolu"!l rion No. 268 be adopted. Roll Call as follows: AYES: COlIIIDif.lsioners Acker, Dav!,6on. ~'Q:::'lQ.n. The AS8istant City Attorney presented Resolution No. 269 to initiate proceedings to place vaterinary hospitals in Se~tion 17 of the Zoning Ordinance as a speciel use. Mr. CaJ:ozza .stated that by the last action of the City Council, tbis matter was referred to tbe Planning Commission to consider such a change. Councilman Phillips said that he had stat~d he ~ilIl'ld support reconsidar- ation of s special use. Coun~ilman Reibold adv~8ed tbat this matter was discussed at the COU11(;1.l lI'eeting and sl'peared in t!H tt::'.u:tes, but thore was no IDOtion. After <liccussion of this matter it ~7E>;3 ciaf:ermined that the Resolution was pr~ture in coming before the Planning Commission at this time. Therefore. no action was taken.
