Pu,suant to notice given, a public bearing was beld on the application of Carl Sugar for a zone variance to allow the erection of an 8 X 14 foot roof sign over a restaursut erected at 600 W. Las Tunas Drive in a Zone C-l. The sign to be erected would read "Sugar's Broiler". Tbis" would be neon, non-flashing or moving. Pictures of the sign had been presented to the Commissioners. The Chairman stated that this was the ~ time and place for the bearing of this application and rec;uested those in favor of tbis zone variance to present any material necess8=Y. Puruu8nt to the continuance of November 26, 1957, the Secretary presented the report of the Zoning Committee on the. application of Ross A.Himes for a zone variance to allow three 3-stoty apartments on a portion of the property located at the northwest, corner of Santa Anita Avenue and Las Tunas Drive. The Committee reports that about 25 or 30 applications ior variances ara heard each year. In most case., the determination was greatly influl',nced by the. cpinion of tbu people directly affected. The Committee felt that Ordinance No. 760 wao not suf:ficient in a city such as Arcadia. The matter was held for furtber atudy. It was felt tb~. t anything put in a special use becomBs an in- decisive way ot selling. A special use permit theoretically can be put in _ location. It becomes subject to a political iSl!ue that has .no business in planning ths City. It was felt that if it were set up anel classified, and if it beloup in M-l it abould' be left tbare. A special use is a veriance. Hr. Nicklin stated thst there was special distloction bet:weeft a variaqce and a special use. A variance is granted because of SomB particular conditfDn of a given piece at' parcal, as a result of which a strict application of the basic zoDing-appli- cable to that lot denies tbe person the same privileges as some- body else has.' A special use by the very definition in the ordinance relates to the cbaracter of the use irrespective of the land. Certa1n uses are special uses, based upon the fact that all the uses possess characteristics of special form so as to make impractical their being automatLcally included in any class of uses under tbe ordinance. The City Attorney presented Resolution No. 269, instituting , proceedings to amend the zoning ordinance and Classify veterinar] hospitels as a special use. Moved by Hr. Acker, seconded by Mr. Pratt, and carried, that tho resding of the body of Resolution 1110. 269 be _Lved. Motion by Mr. Acker, second by Hr. Pratt and carried that Resolution No. 269 be adopted. Discussion was had on tbe application for a zone change on Duarte Road between Holly Avenue and La Cadena Avenue frOlll Zone R-l to Zone R-3. The Secretary was instructed to hold tbis application for consideration with the land use survey now being made. Communication frOlll Charles P. Lester, appealing a decision of tbe Modification COIIlIIIittee. The request was for a 60" eave overhang on a portion of an attached garage on a new house at 1223 Oakglen Avenue. Moved by Mr. Acker, seconded by Mr. Robertson and carried that the application of Charles P. Lester for a variance to allow additional eave overhang be granted. It waa suggested that t~e Secretary send a communication to the Contractor on tbis job advising h1m to have his plans correct before ha commences any future buildings. Elizabeth M. Eakin, at 823-825 Pairview Avenue - Assigned to Mr. Forman and Mr. Vachon . Comm1cation from Air Logistics Corporation, 3600 E. Footbill Boulevard, Pasadena, California, stated they were considering leasing tbe premises st 324 North Second Avenue, being the old location of Arcadia Door Co. and more recently used by Day and Nigbt Water Heater Co. Thia property in Zone M-l, is comprised of approximate~y 2 acres of land with buildinga covering approx- imately 19,250 sq. ft. It is adjoined by tbe Flood Control Channel on the north and east end on the south by tbe City of Arcadia Water Department. There are no residential or industrial properties adjacent to tbis property. The manufacturing oper- ation proposed for tbe Plastic's Division of Air Logistics Corporation involves the mixing, molding a~d fabrication of fiber.- ______L___.^ .....I!'~ .'- .. Mov~d by Mr. FOl~an, seconded by Mr. Robertson and carried, that the reading oftha bocy of Resolution No. 270 be waived. Moved by Mr. Acker. seconded by Mr. Forman and carried, that Resol~tion No. 270 be aoopted.
