REGULAR MEETING
SEPTEMBER 10, 1958
The Planning Commiasion of the City of Arcadia met in regular session
in the Council Chamber of the City Hall at 8:00 o'clock P.M., September
10, 1958
PRESENT:

Motion by Mr. Robertson, seconded by Mr. Vachon and carried that the
minutes of August 12, 1958 as submitted in writing be corrected by
deleting from Page 6, Line 23, the following words:
"The Chairman declared the hearing closed."
and thus amended that they be approved.
Minutes of the meeting of August 26, 1958 were approved as written and
mailed.
Pursuant to notice given, a public hearing was held on the application
of Fred Rovanen, Lessee, for a zone variance to permit the installation
and use of mechanical equipment in a hand operated auto laundry at 1414
S. Baldwin Avenue.
The staff report, as read by the Secretary, reflected the applicants
request to add the following equipment:
1. 5 H.P. vacuum cleaner
2. AU,tomatic wheel washer
3. Automatic body brushes
4. Conveyor chain
5. Drying blowers
The report further stated that a mechanically equipped auto laundry
of this type is normally classified in Zone CoM. By Council Resolu-
tion No. 2810 a variance for an automatic laundry in Zone C-2 at 66
W. Las Tunas Drive was granted on September 18, 1956.
That variance contained the following stipulation:
"That all compressors, boilers and exhaust fans be
constructed and maintained in a closed section of
the structure and adequately sound-proofed, all to
the satisfaction of the Building Department and the
Planning Commission. II
The Chairman called for any written communication whereupon the
Secretary read a letter from Mr. J. L. Murray, Arcadia Parking Inc.,
advising the Commission that he had no objection to the proposed
variance.
The Chairman then declared the public hearing open:

Flores realized the competition involved in such an operation and
voiced his approval of the application.
Mr. Fred Kovanen, the applicant, reiterated his application and aaked
if the members of the Commission had any questions.
General questioning ensued. Mr. Paul Garfinkle, as owner of subject
property stated that many prospective patrons are going elsewhere for
faster and cleaner service, and he would like to see the variance
granted in order to bring business back to the Hub area.
Mr. Frank Spallibo, co-owner and operator, stated that the equipment
would be placed in the building and would benefit the area.
Noone desired to speak in opposition to the variance and the matter
was continued for a Zoning Committee report at the 'next regular meet-
ing of the Planning Commission.
Pursuant to notice given, a public hearing waS held on the application
of Sherwood E. Wise, 17 S. Fourth Avenue, for a zone change classifica-
tion from C-2 to R-3 on property located south of Huntington Drive and
west Of Fourth Avenue, described as Lot 5, Tract No. 5205, except the
northerly 215 feet thereof.
A plot plan of the subject property was presented, and it was indicated
by the Secretary that' access into this C-2 property is from Fourth
Avenue across an R-3 lot. Section 15.1 of the Zoning. Ordinance states
that no property in a more restricted zone shall be used for ingress to
or egress from property in a less restricted Zone, other than for purp-
OSes permitted in such more restricted zone.
No communications were received.
The Chairman declared the hearing open. No one spoke in favor of or in
opposition to the variance.
Mr. Vachon declared that the area had been studied previously, and the
only access to the rear of the lot is from Fourth Avenue. As a result
of an alley dedication on Lot 5, Tract No. 5265, subject property WaS
zoned from R-3 to C-2.
Motion by Mr. Vachon, seconded by Mr. Forman and unanimously carried
that the City Attorney be instructed to prepare the necessary resolu-
tion to recommend the zone reclassification from C-2 to R-3 on pro-
perty located south of Huntington Drive and west of Fourth Avenue.
Pursuant to notice given, the public hearing was held on Resolution
No. 305, proposing a change of zone from Zones C-O & D to Zone R-3 on
certain property at the rear of 728 W. Huntington Boulevard.
This zone change deals with the north 205 feet of the south 305 feet
of the west 80 feet of Lot 22, Tract No. 2731. As a condition of
tentative map, Tract No. 24499 this certain portion of property was
to be changed to Zone R-3. This would place all lots within the pro-
posed tract in Zone R-3, and thus insure a uniform development and use.
The balance of the old lot, facing Huntington Boulevard would remain in
Zones CoO and D.
There were no opponents or proponents to this matter.
Motion by Mr. Vachon, seconded by Mr. Robertson and carried unani-
mously that the City Attorney be instructed to prepare the necessary
resolution to recommend the zone classification from COO and D to R-3
on property located at the rear of 728 W. Huntington Boulevard.
Consideration was given the application of the Foothill Jewish Commun-
ity Center for a zone variance on property at Foothill Boulevard and
Second Avenue.
At this time Dr. Kent Nebeker, 150 E. Sycamore, wished to clarify
certain statements that had been made by the applicant, Mr. Lapson.

At the previous meeting held on August 26, 1958, the applicant had
stated that the property owner to the west of the subject property
was agreeable to a street opening in the area. Dr. Nebeker declared
that he wished to go on record as opposing any such street and/or
subdivision that would involve his property.
Because the applicant had not been contacted the Zoning Committee did
not submit any recommendation at this meeting.
Motion by Mr. Robertson, seconded by Mr. Forman and carried unani-
mously to continue the hearing on the zone variance for the Jewish
Center until the next regular meeting of the Planning Commission
pending further study, contact of the applicant and a zoning report.
This matter was continued from the regular meeting of August 26, 1958,
pending report from Zoning Committee, The Secretary presented a letter
from the applicant, H. R. Riggins, 85 W. Lemon, requesting withdrawal
of the application.
,Mr. Stout commended Mr. Riggins on his nice attitude' and community
spirit in this matter.
The City Attorney then presented Resolution No. 311 recommending denial
of the variance to permit the reten~ion of kitchen facilities in a
guest house at 85 W. Lemon Avenue.
Motion by Mr. Robertso~, seconded by Mr. Stout and carried unanimously
to waive the reading of the full body of Resolution No. 311
Motion by Mr. Forman, seconded by Mr. Vachon and carried that Resolu-
tion No. 311 be adopted.
A letter from the Park Investment Company was read wherein the appli-
cant requested postponement of the pending applicstion for a variance
to allow a parking lot at 1150 W. Foothill Boulevard until November 12,
1958.
The body of the letter stated that the validity of the deed restric-
tion on subject tract will come before the Superior Court for hearing
on October 14, 1958 in the case of Menninger vs.. Madsen. Inasmuch as
the Commission would find it difficult to render a decision on the
application until the legality of the deed restrictions are clarified,
the matter should be postponed.
Motion by Mr. Robertson, seconded by Mr. Vachon and. carried to contin-
ue the hearing until November 12, 1958 and instruct the Secretary to
mail out notices of a hearing prior to the aforementioned meeting.
The Commission reviewed the petition of some 27 property owners along
Huntington Boulevard requesting a setback change from 50 feet to 35
feet on the south side of Huntington Boulevard from Baldwin Avenue to
the west City limits. The petition stated that lots have increased
in price, and that by adding 15 feet to the building site, the land
cost per unit would be substantially reduced and more attractive to
buyers.
A general discussion ensued whereby Mr. Vachon related that the zone
change to c-o & D on Huntington Boulevard clearly stipulated a 50
foot fro~setback. Mr. Robertson stated that the medical center is
at 50 feet. A change in setback now would create a staggered buil.d-
ing effect.
Mr. P. S. Rose, 904 Huntington Boulevard addressed the Commission
stating that the present 50 foot setback is not practical for the
contemplated growth along Huntington Boulevard. Furthermore, the
petition filed contains close to 100 % of the property owners, and
he is definitely in favor of a change to 35 feet.

Alice Slater claimed that two more signatures had been obtained
bringing the total representation to almost 100%.
Motion by Mr. Robertson, seconded by Mr. Vachon and carried to
instruct the Planning Staff to make a complete study of setback
status on Huntington Boulevard ~rnm Baldwin Avenue west to the
City limits and submit a report !rOm the Zoning Committee at the
next regular meeting.
Final map of Tract No. 20952, located on Magna Vista Avenue eaat of
Lynden Way, containing 11 lots. The conditions of the recommendation
for final approval of the map we~~ read as follows:
1. Provide the necessary easement for the sewer and street
drainage into Le Roy Avenue.
2. The City should abandon the present drainage easement and
the subdivider remove the structures.
3. The subdivider shall install all street improvements
required by the subdivision ordinance.
4. The subdivider shall pay all fees and deposits required by
the subdivision ordinance.
5. The subdivider shall deposit a proportional share of
the estimated cost of opening a future street into
LeRoy Avenue.
6. Provide all necessary rear line utility easements,
7. The subdivider shall grant in fee to the City Lots
12, 13 and 14 to control future extension of the street.
8. The City shall dedicate for street purposes Lot 12 of
Tract No. 19656 at the present end of Magna Vista Avenue.
The City Attorney then questioned Item No. 5 as to what the amount
of the required cost would be for opening a future street into
LeRoy A venue.
The matter was ordered, held for a determination of the amount to be
deposited.
NO. 308. The City Attorney presented Resolution No. 308, entitled:
"A Resolution of the City Planning Commission of the City
of Arcadia, California, recommending the reclassification
of certain real property from Zone R-3 to Zone C-2 and
Zone D, located on the north side of Live Oak Avenue in
said City."
Condition "c" regarding entrances to the build:lng was questioned by
the City Attorney. As outlined in the proposed resolution it was
not specific as to the limitation to be imposed. Mr. Vachon
recommended that a definite limitation should be applied to the item
concerning itself with side street entrances. He suggested that no
entrances to buildings from side streets should be permitted more than
ten (10) feet from the front building line.
A general discussion followed after which the City Attorney wrote the
above recommendation into Resolution No. 308.
Motion by Mr. Stout, seconded by Mr. Vachon and carried that the
reading of the full body of Resolution No. 30B be waived.

tion No. 308 be adopted.
NO. 309. The City Attorney presented Resolution No. 309, entitled:
"A ResC'lution of the City Planning Commission of the City
of Arcadia, California, recommending the establishment of
certain real property at the corner of Las Tunas Drive
and Baldwin Avenue in said City in Zone D (Architectural
Overlay) in addition to the basic zoning applicable or to
become applicable to said property and specifying Arrhitec-
tura1 restrictions to be imposed thereon under such Z.,ne D."
Moved by Mr. Stout, seconded by Mr. Forn~n and carried that the read-
ing of the full body of Resolution No. 309 be waived.
Motion by Mr,. Vachon, seconded by Mr. Forman and carried that Resolu-
tion No. 309 be adopted.
NO. 310. The City Attorney presented Resolution No. 310, entitled:
"A Resolution of the City Planning Commission of tlie City
of Arcadia, California recommending reclassification from
Zones CoO & D to Zone R-3 of certain real property at the
rear of 728 W. Huntington Boulevard, in said City."
Motion by Mr. Robertson, seconded by Mr. Vachon and carried that the
reading of the full body of Resolution No. 310 be waived.

tion No. 310 be adopted.
The City Attorney raised an inquiry concerning the tentative approval
of Tract No. 21618.
On May 27, 1958, the Commission recommended tentative approval of Tract
No. 21618, located on Greenfield Avenue north of Pamela Road. Condi-
tion No. 1 provided that the City start condemnation action to acquire
the east 30 feet of the parcel at 1416 South First Avenue, which was not
a part of the tract, for street purposes. The cost of the proceedings
to be borne by the subdivider.
On June 4, 1958, the City Council approved this tentative map subject
to the condition that the prope.rty needed for the street be acquired
and improved for street purposes by any appropriate proceedings with-
out cost to the City.
It is not practical to condemn this property before the adjoining
street is dedicated.
Motion by Mr. Robertson, seconded by Mr. Vachon and carried that the
tentative !lPproval of Tract No. 21618 be amended to require the sub-
divider to deed in fee to the City a one foot wide strip around the
boundaries of the parcel in question; that the City acquire by condemna-
tion the east 30 feet of the property at 1416 S. First Avenue; and that
the subdivider deposit with the City the estimated cost of conducting
the proceedings, the acquisition of the property and its improvement
for street purposes; such deposit to remain with the City at least
five years after the completion date of the tract or until such time
as the acquisition and improvement has been completed, and any unused
portion of the deposit to be returned to the subdivider. Mr. Stout
abstained from voting, because he was not a member of the Commission
at the time of the tentative approval of the tract.
There being no further business, the meeting adjourned..
