November 25, 1958,. \-Jith Chairman Acker presiding', ROLL CALL PRESENT: Commissioners Acker, Davison, Forman, Robertson, Stout and Vachon. LOT SPLIT No. 221 LOT SPLIT No. 222 ABSENT: Commissioner Michler OTHERS PRESENT: Councilman CamPhouse, Cook, Nicklin, I.ortz, Talley and Mrs. Andrews. No. 221. Property of Marc Harris, 1930S. Second Avenue., had been referred to Mr. Michler and Mr. Stout. Engineer's report WaS read showing that this lot is 120 feet wide by 196.5 feet deep and now is improved with two houses, side by side, at the front building Hne. The request is to dIvide the property i.nto two lots being 55 feet and 65 feet wide. The proposed new lots are less than the required width and narrower than the majority of the surrounding lots, but contain more than the required area; and due to the fact that both lots are now improved with houses, the condition on the street will not be changed. Motion made by Mr. Stout, seconded by Mr. Vachon and carried, that Lot Split No. 221 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2,. Provide a .sewer lateral to parcelL 3. Dedicate 12 feet for the future widening of Second Avenue. 4. Pay $25.00 recreation fee. 5. Widen the driveway approach and the driveway on Parcel 2. 6. Construct a driveway approach and widen the driveway on Parcel 1. 7. Remove a shed at tached to the garage to clear. the new lot line. 8. Construct a new garage on Parcell.. 9. Install a new water service and water for Parcel 1 and separate the water systems between the 2 lots. No. 222. Property of Arcadia-Monrovia Realty Company, 1115-1121 Louise Avenue, refer,red to Mr. Mi.chls: and Mr. Stout. The report of the Engineer was read showing that these proposed lots con- form with the pattern now established on Louise Avenue; although they are less than 75 feet wide, they are wider than the adjacent lots to the north. Page One November 25, 1958 Moved by Mr. Stout, seconded by Mr. Davison, and carried that Lot Split No. 222 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2. Pay $25.00 recreation fee. 3. Deposit $50.00 for installation of street lights,. LOT SPLIT No. 223 No. 223. Property of Robin E. Beckwith, 2432 S., Sixth Avenue had been referred to Mr. Stout and Mr. Michler.. The report of the Engineer was read showing tihat this is a small plot, 25 feet square, in the rear corner of the property to be sold to the o\;ner of &15 Sandra Avenue, to provide area to build a swimming pool. The rear lot lines in this area are now irregular, and this change will not materially alter the condition. Moved by Mr. Stout, seconded by Mr. Davison, and carried that Lot Split No. 223 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2. Make satisfactory arrangements with the Edison Company for the re-location of ,a power pole and anchor. LOT SPLIT No. 224 No. 224. Oscar E. Brandt, 1200 Louise Avenue, assigned to Mr. Robertson and Mr. Davison for investigation. LOT SPLIT No. 225 No. 225. Roy Ashby, 535 Workman Avenue, assigned to Mr. Forman and }Ir. Vachon for investigation. RESOLUTION No. 318. The City Attorney presented Resolution No. 318, entitled: No. 318 "A Resolution of the City Planning Commission of the City of Arcadia, California, recommending the granting of a variance for the construction and operation of a temple and religious school at the corner of Foothill Boulevard and Second Avenue." Moved by Mr. Robertson, seconded by Mr. Stout and carried, that the reading of the full body of the resolution be waived. Motion by Mr. Vachon, seconded by Mr. Forman, and carried that Resol~- .tion No. 318 be adopted. RESOLUTION No. 319. The City Attorney presented Resolution Nb. 319, entitled; No. 319 "A Resolution of the City Planning Commission of the City of Arcadia, California, recommending the granting of a variance for the construction and operation of a convalescent home at 452-4&4 W. Huntington Boulevard." Discussion followed as to the elimination of any possibility of accepting alcoholics, narcotics, or mental patients. It was felt that the restriction should be made through the type of 1 icense that is issued to the convalescent home rather than the type of building specified. The City Attorney stated that the type of building could be omitted, and require a type of license that would preclude alcoholics, narcotics and mental patients. Motion by Mr. Forman, seconded by Mr. Vachon and carried that the reading of the full body of Resolution No. 319 be waived. Motion by Mr. Forman, seconded by Mr. Vachon and carried that Resolution No. 319 be amended by deleting "in that type of building or" as set out in Section 2 of said Resolution. AYES: Commissioners Acker, Davison, Forman, 'Robertson and Vachon. NOES: None ABSENT: Commissioner Michler NOT VOTING: Commissioner Stout RESOLUTION No. 320. The City Attorney introduced Resolution No. 320, entitled: No. 320 "A Resolution of the City Planning CO!l11Ilission of the City of Arcadia, Cal~fornia, recommending the denial of a zone var- iance to allow the erection of a double garage with an apart- ment above same at 614 S. First Avenue." Motion by Mr. Stout, seconded by Mr. Forman and carried that the reading of the full body of Resolution No. 320 be waived. Moved by Mr. Stout, seconded by Mr. Robertson and carried that Resolution No. 320 be adopted. TRACT NO. 24181 New tentative and final map of Tract No. 24181 was presented by the Secretary. This tract is located west of Santa Anita Avenue and north of St. Joseph Street. The original tentative map was approved by the Commission on August 13, 1957, and by the Council on September 3, 1957. The State Subdivision Map Act provides that if a final map is not recorded within one year of the approval of'~he tentative map all proceedings are terminated. The Sub- divider, Robert M. Lynn, has refiled the tract as a new tract. The original owner's stlltement read that all buildings within the tract, except the 40' x 60' steel building were to be removed. The owner's new statement reads that the 30' x 40' building on Lot 1 may be removed, depending on the purchaser; the 40 I x 60 I building on Lot 5 to remain, and all others are to be removed. There .are still a couple of frame build- ings on Lot 5 which should be removed. The final map ,conforms substantially with the original approved tentative -map. If the final map is approved it should require the following: 1. Dedicate an easement for water lines along the east line of Lot 11. 2. Remove the frame buildings from Lot: 5. 3. Pay all inspection fees. 5. All street improvements to be accepted by the City Council before final approval of the tract. Discussion followed as to the re-filing of the statement. It was brought out that certain requests were made in the new statement that did not appear in the former one, and were not included in the approval of the former map. Mr. Nicklin stated that inasmuch as there were changes, it would constitute a new filing, ana should therefore be submitted to the Subdivision Committee, for a report and decis'ion. Moved by Mr. Robertson, seconded by Mr. Davison and carried, that the Page Three Nov. 25, 1958 LOT SPLIT R"O Area VARIANCE Auto Laundry MODIFICATION Signs Tentative and final map of Tract No. 24181, located west of Santa ~nita Avenue and north of St. Joseph Street be referred back to the Subdivision Committee and Staff for report inasmuch as there are ~wo changes requested that did not appear in the approved tentative map. Sidney Broffman, Attorney, 1745 Holly Avenue, Arcadia, addressed the Commis- sion, representing Duncan Howard, who resides at 379 W. Lemon Avenue on the northeast corner of Lemon Avenue and Holly Avenue on a lot 100' x 384'; ,Mr. Howard desired a lot split so that he could divide two lots ,facing Holly Avenue. He desired information as to procedure in a R-O area'. There have been no approved lot splits in an R-O zone inasmuch as the zoning ordinance allows only one house per lot. Mr. Broffman understood that there were no deed restrictions on this lot at this time. He explained that if a lot split could be granted, it would still allow a dedication of 30 feet for the con- tinuance of Sharon Road. This would conform to the lots across on the west side of Holly Avenue. Mr. Howard is willing to dedicate 30 feet for the extension of Sharon Road. He felt that it would improve the appearance of Holly Avenue. Lot splits in this area had been denied by the Planning Com- mission and City Council in 1950 and 1951, because it did not conform to the area. Other lot. splits south of this in Zone R-O have been denied. Mr. Broffman was requested to take the usual procedure of filing an application. The Commission could then study the wh6ie area with a view of recommendations for the entire area when the deed .restrictions expire. Mr. Knut Larsen, representing the American Lutheran Church, 1424 S. Baldwin Avenue, stated that they had not received notice of the pub11c hearing for the car wash on Baldwin Avenue. They were opposed to the installation of the mechanical equipment. The Chairman informed Mr. Larson that this matter was now in the hands of the City Council, and. any protest he might have should be addressed to the Council. . Mr. Nicklin stated the status of the variance and that the Council Was apparently willing ,to hear from those people in the area who were protest- ing the application, ev~n though th~ time for hearing had passed. They had wanted to view the premises themselves and get a first hand picture. All protests now should be addressed to the City Council, either at the time the matter was being considered or by directing a communication to ,them care of the City Clerk. Mr. Vince Rizzo. a property owner within the 300 foot area also voiced his opposition and stated that he too had not received any notice of the public hearing. The matter is on the agenda at the next Council meeting, and all protests should be directed to the Council. The Secretary presented an application that had come before the Modifica- tion Committee for a sign 8' x 5' at 739 Arcadia Avenue, where 'a new 28 unit apartment building is being buil t. This sign to be to show that the apartments were for lease, and that there would be air-conditioning, swim- ming pool, etc. They desired this sign until the completion of the build- ing. This matter came befOre the Modification Committee and in line with what the Committee had done in the past on a first application it is now being presented to the Commission as a whole to determine a policy. There had also been a call from Highland Oaks for a large sign. Discussion followed. It was determined that there waS a valid sign ordi7 nance in affect and the 'four square foot regulation should be adhered to. Moved by Mr. Vachon, seconded by Mr. Robertson and carried that the appli- cation for the sign at 739 Arcadia Avenue, as presented to the Modification Committee be denied. Page Four November 25, 1958 APARTMENT Arcadia Ave. opening ADJOURN ~, ! '>---/ During the past year there has been considered the re-zoning of Duarte Road from Holly Avenue west. This was recommended by the Commission, contingent upon certain street ooenings being made by the 'property owners. There 1:s now pending in the Bulld~ng Department an application for' a permit to con- struct a 40 unit apartment house at 602 Fairview Avenue, and ~he Secretary requested consideration to determine what action should be taken when such a building permit is requested. If the permit, now pending, is issued, it ,would place a building at the rear lot line, and would thereby prevent the extension of Arcadia Avenue. ' Moved by Mr. Davison, seconded by Mr. Vachon, and carried that the Commis- sion recommend that the City Council adopt an emergency ordinance prohibit- ing f~r a period of six months the erection of any buildings that would interfere with the opening of Arcadia Avenue, on the basis that the entire area is being studied for possiblere.zoning, and for the working out of a street pat'tern.
