MINUTES PLANNING COMMISSION OF THE CITY OF ARCADIA REGULAR MEETING DECEMBER 9, 1958 The Planning Commission of .the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 o'clock P.~, December 9, 1958 with Chairman Acker presiding. PRESENT: Commissioners Acker, Forman, Robertson, Stout, Michler and Vachon ABSENT: Commissioner Davison OTHERS PRESENT: Councilman Reibold, Lortz, Cook, Talley and Mrs. Andrews. Pursuant to notice given, a public hearing was held on the matter of amend- i!lg Section 2 of the Zoning Ordinance by re-defining "building height" and "half-story" and Sect;ons 4, 5, 6, and 7 by reducing building height to two stories, as contemplated by Resolution No. 317. The Chairman asked that those in favor of amending said ordinance be heard. No one appeared. He then called for those opposing said .amendment. There was one desiring to be heard in opposition. The Chairman declared the hearing held' over until tne next regular meeting of December 23, 1958 for the .purpose of receiving Staff and Zoning Committee reports,. at which time a decision will be made. No. 224. - Oscar .E. Brandt, 1200 Louise AVenue, referred to Mr. Robertson and Mr. Davison. This lot is 92.5 feet by 130 feet on the long side. Engineer's report was read showing that this split conforms witb the established pattern on Louise Avenue. Moved by Mr. Robertson, seconded by Mr. Michler and carried, that Lot Split No. 224 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2. Pay $25.00 recreation fee. 3. Deposit $25.00 for street lights. 4. Pay $35.00 for water connection, without meter, advanced by the City. 5, Remove the 20' x 30' abandoned chicken house. Lot Split No. 225. - Roy S. Ashby, 535 Workman Avenue, referred to Mr. Forman and Mr. Vachon. The Engineer's report was read showing that this is a parcel of land 41 feet lying at the rear of the above address. This follows a pattern set on Lot 40 to the west by Lot Split No. 120 oriSeptember 4, 1956. The intention of the purchaser (Mr. Stogsdill) is to use this land for park- ing in connection with the property to the north. Two bird houses with Page One December 9, 1958 J wire enclosed flying areas are now on the property, and should be removed to provide legal clearance from the new owners~ip line. A communication was read from Mr. Stogsdill requesting a period of 60 days after the final approval for the remo~al of the above bird houses. Also that an easement has been procured for 3-1/2 feet on the westerly portion of the above lot for the purpose of drainage of the rear portion of the lot to Workman Ave- nue. Moved by Mr.. Forman, seconded by Mr. Vachon and carried that Lot Split No. 225 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2. Remove the two bird houses with flying pens to provide legal clearance from the new ownership line. 3. Execute an agreement that the above buildings will be removed within sixty (60) days after the date of final approval. 4. File a covenant with the City to guarantee that the said lot will not be used as a separate building lot, and will only be used with Lot 27, Tract No. 6641. LOT SPLIT No. 226 Krecker No. 226. - Almira Mary Krecker, 1122-1126 Louise Avenue, assigned to Mr. Robertson and Mr. Davison. The Engineers report was read stating that this lot split conforms to the established pattern of Louise Avenue. Moved by Mr. Robertson, seconded by Mr. Vachon and carried that Lot Split No. 226 be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer. 2. Provide a sewer lateral to Parcel 1 on .First Avenue. 3. Pay $50.00 recreation fee. 4. Deposit $50.00 for street lights. 5. Pay $70.00 .for two water connections, without meters, advanced by the City. TRACT NO. 24181 New tentative and final map of Tract No. 24181 was considered. The Engin- eering and Planning Division report was given showing. that this tract is located west of Santa Anita Avenue and north of St. Joseph Street. The original tentative map was approved by the Commission on August 13, 1957, and by the Council on September 3, 1957. The State Subdivision Map Act provides that if a final map is not recorded within one year of the approval of the tentative map all proceedinga are terminated. The subdivider has re-filed the tract as a new tentative and final map. The original owner's statement stated that all buildings within the tract, except the 40'x.6.0' steel building were to be removed. The new owner's state- ment states that the 30'x60' building on Lot 1 may be removed, depending on the purchaser . The 40' x.60' building on Lot 5 to remain, and all others are to be removed. Tbereare still a couple of frame buildings on Lot 5. The original tentative map showed that the property facing Santa Anita Ave- nue would be divided into two lots, ,with the existing building extending across the lot line. The revised tentative and final map shows only Lot 1 facing Santa Anita Avenue, so that tbe location of the building is not a problem. The building is frame and stucco, and was constructed in 1947. Page Two December 9, 1958 It appears to be in good condition, and there is no good reason to require its removal. The frame building on Lot 5, including the frame garage on temporary mud sills, should be removed, or there should be a written agree- mentthat they will be removed within a definite specified time. The final map conforms substantially with the original approved tentative map. Mr. Hoffeditz of the Arcadia Engineering Company spoke in favor of the Tract, and requested that an extemHon of time be granted for the removal of the building. He said that. a new building was proposed, and it would work a hardship on the subdivider to remove the old building at .this time. Questions arose as to a D Overlay for .this tract. There was a question as to whether or not a D Overlay could be required in an M Zone. This 15 a matter that would have to be considered at a later time and under separate proceedings. Moved by Mr. Robertson, seconded by Mr. Forman and carried that the revised tentative and final map of Tract No. 24181 be recommended for approval, sub- ject to the following conditions: 1. Dedicate an easement for water lines along the e.ast line of ,Lot 11. 2. Remove the fj:,ame buildings from Lot 5, a new building on Lot 4, or within one occurs first. upon completion of year, whichever date 3. Pay the following fees and deposits: 17 lots recreation fee. @ 28 street 10 rees @ 1 street name sign @ 3 steel street lights @ $25.00 5.00 25.00 150.00 $425.00 140.00 25.00 450.00 4. Pay all inspection fees. 5. All street improvements to be accepted by the City Council before final approval of the tract. VARIANCE Car Wash The request of Fred Kovanen for a variance to allow mechanical equipment in an auto laundry at 1414 S. Baldwin Avenue was returned by the City Council for a re-hearing for the reason that several of the property owners within the 300 foot radius had stated they had received no notice of pub- lic hearing. Motion by Mr. Vachon" seconded by Mr. Stout and carried that- the re-hearing on the application for a variance be set for December 23, 1958 at 8: 00 o'clock P.M., and that the Secretary prepare notices and mail them in accordance with City Council request by registered return-receipt mail.
