Commission of the City of' Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 o'clock P.M., April 28, 1959, with Chairman Acker presiding. PRESENT: Commissioners Acker, Davison, Forman, Michler, Robertson, Stout and Vachon ABSENT: None OTHERS PRESENT: Councilman Balser, Nicklin, Talley and Mrs. Andrews The minutes of the meeting held April 14, 1959 were approved as written and mailed. The Chairman announced that this was the time and place for the hearing on the application of Albert J. Miller for a zone variance or special use permit to allow an addition to the existing mortuary at 500 S. First Avenue. The mortuary is located on the corner of First Avenue and El- dorado Street, and is zoned C-2. This is an application to enlarge the buil ding so tha t a special use permit is necessary. There will be no additional traffic or people involved to attend services extra conven- iences for the families using the mortuary is necessary; and that the smali addition will add ,to the appearance of the buikling. The Secretary tead the staff report showing that the addition proposed is 9 feet 9 inches wide by 37 feet long and on the north side of the building adjacent to Eldorado Street, and consists of added space to the family room a new lounge and rest room and an attendant's room. The original building was built in 1938 when mortuaries were a permissible use in Zone C-2. Additions were made in 1951 and 1954. On December 7, 1954, by Ordinance No. 900 mortua~ies were classed as, a special use, thus making present operation non-conforming. When originally built, the property was in No.2 Fire Zone and the original building and the 1941 addition were wood frame and stucco, In 1948, by Ordinance No. 687, the property was placed in No. I Fire Zone. The 1954 addition complies with Fire Zone No, 1 requirements. The plans as presently requested show frame and stucco construction to match the original building. Because of the nature of the addition it is not pra~~ical to meet present Fire Zone requirements and a variance to the building code will probably be required. At the time the original building waS constructed, the Zoning Ordinance did not require off-street parking and none was provided. In 1956, by Ordinance No, 967, parking space for commercial buildings was required. Planning Commission Resolution No. 139 adopted March 9, 1954 recommended that parking for mortuaries be required at the rate of one space for each four seats provided in the building, This was approved by the City Council by Resolution No. 2526, adopted August 3, 1954. The proposed addition does not affect the general seating capacity of the building. One protest was registered by Dr, Karl Vollmer, 425 S. First Avenue. No other communications were received. Page One April 28, 1959 ---- LOT SPLIT No. 98 CLAR IF ICATION A. Tulleners, 129 Eldorado Stre~t did not object to the addition at the mortuary, but objected to the root beer stand. The Chairman requested those in favor to be heard at this time. No one appearing either for or .against said application, the Chairman announced that the matter would be continued until the meeting of May 12 for reports and a decision, A communication was received from Robinson Brothers, requesting a clari- fication of conditions applicable to the cash deposit previously made for the future opening of Camino Grove Avenue. On May 7, 1957, Lot Split No, 98,. being' the application of Robinson Brothers and W. H. McCauley, for two lot splits at the south end of Encino Avenue was given final approval. One of the conditions imposed was the deposit of $750.00 per lot to apply toward the future extension of Camino Grove Avenue to Sixth Avenue. This deposit was tendered with certain conditions attached. The City Council minutes are not explicit as to whether or not the conditions were accepted. In order to eliminate confusion and uncertainty in the future, the Commission recommends that the following conditions concerning the above deposit be approved: I, In the event Camino Grove Avenue is extended westerly to Sixth Avenue through the formation of an assessment district, these funds so deposited will be used to defray t~e cost of the assessment in this amount, but in the event that aSSEssments are less than the $750.00 deposited, the unused portion shall be refunded wtthoutinterest. 2. In the event tha,t Camino Grove Avenue is extended to Sixth Avenue from voluntary contributions of the affected properties, then this $750,00 discharges the obligation in full. 3, In the event the street is constructed by the use of other funds, other than an assessment district, or that it is constructed by direct payment of the abutting pro- perty owners, or that in the .event that the street is no.t constructed prior to January I, 1968, the $750,00 deposited is to be returned without interest to W. H. McCauley, 1136 S. 6th Avenue and Robinson Brothers, 1114 Lyndon Way, Arcadia, California, their heirs or assigns, 4, In no event ate these two properties to be penalized by having deposited .funds in advance of other properties to the south, nor in turn shall there result a gain to these two properties for having made such deposits. Moved by Mr. Robertson. seconded by Mr. Vachon that the conditions set forth in the communication ~ubmitted with Lut Split No. 98 and herein- above set forth be recommended for approval. NOES: None Page Two April 28, 1959 " MORTUARY PLANS RESOLUTION NO, 329 RESOLUTION NO, 330 LOT SPLIT No, 244 In connection with the approval of the building of the mortuary at 611 W. Duarte Road, a condition was made that before final approval was made the building plans for the remodeling of the residence to the. property would be submitted to the Planning Commission for approval. These plans are now developed and submitted. It followed that the plans were in general conformance with architectural design of the mortuary and therefore would lend itself to the surrounding property. Moved by Mr. Vachon, seconded by ~tt. Robertson and carried that the plans submitted for the residence on the property at 611 W. Duarte Road be approved, The City Attorney introduced Resolut-ion No. 329 entitled: "A Resolution of the City Planning Commission of the City of Arcadia, California, making certain findings and recommendations relative to the proposed amendment of Section 5 of Ordinance No. 760 of the City of Arcadia," The Chairman declared that the public hearing on this matter, which was held on March 24, 1959, was closed, Moved by Mr, Forman, seconded by Mr. Vachon and carried thaI the reading of the full body of Resolution No, 329 be waived. Moved by Mr, Vachon, seconded by Mr. Forman, that Resolution No. 329 be adopted. Said motion was carried on the following roll call vote: AYES; Commissione.rs Acker, Davison, Forman, Rober,tson Stout and Vachon NOES: None The City Attorney introduced Resolution No., 330, entitled: "A Resolution of the City Planning Commission of the City of Arcadia, California, declaring its intention to insti- tute proceedings for the purpose of considering and making recommendations concerning the amendment of SectIon 7 of Ordinance No. 76.0 by amending the regulations for floor area, parking space, driveway and lot area," Moved by Mr. Robertson, seconded by Mr. Davison and carried that the reading of the full body of Resolution No. 330 be waived. Moved by Mr, Davison" seconded by Mr. Stout, that Resolution No. 330 be adopted. AYES; Commissioners Acker, Davison, Forman, Michler, Robertson, Stout and Vachon NOES; None Lot Split No. 244, John R. Fitzgerald - 1417 Loganrita Avenue This is a lot split application that had been denied in Februuy 1958 because certain conditions imposed could not be met. But with the new subdivision being constructed wherein Loganrita Avenue and Altern Avenue will be opened, the conditions heretofore set forth are now removed. This proposed lot is 75 feet wide and contains more than minimum area. It completes the connection between Loganrita Avenue and the new tract to the north. Page Three April 28, 1959 LOT SPLIT NO. 243 TRACT NO. 21618 WATER COM- MISS lONER COUNCIL REPRESENTA- TIVE Moved by Mr, Michler, seconded by Mr, Robertson and carried that Lot Split No', 244, JohnR. Fitzgerald - 1417 Loganrita Avenue, be recommended for approval, subject to the following conditions: 1. File a final map with the City Engineer 2. Install a sewer lateral. 3, Dedicate 48 feet for Loganrita Avenue, 4, Pay $25.00 recreation fee. 5, Install all street improvements required by the sub- division ordinance, including curb, gutter, pavement, sewer, water and gas. 6. Pay $IO.OO for two str~et trees, 7. The City shall dedicate for S'treet purposes the barrier strip north and south of the lot, and the 12 foot future street strip on the east. Lot Split No. 243 - George Fisher, - 474 West Walnut Avenue assigned to Mr, Stout and Mr. Michler to investigate and report, The engineer for the subdivider submitted a communication requesting an extension of time to complete Tract No. 2l618. Conditions had arisen beyond their control and additional time was needed to complete the requirement. Moved by Mr" Robertson, seconded by Mr. Forman, and carried that an extension of one year be recommended for the completion of Tract No. 216l8, Chairman Acker announced that Mr, Frank Vachon, had been appointed by the City Council as Chairman of the newly created Water Board. He expressed congratulations to Mr, Vachon on behalf of the Commission. The Commissioners extended a welcome to Mr, Jesse Balser the newly appointed representative of the Council to attend Planning Commission meetings.
