PLANNING COMMISSION OF THE CITY OF ARCADIA
REGULAR MEETING
JUNE 23, 1959
The Planning Commission of the City of Arcadia, met in regular session
in the Council Chamber of the City Hall at 8:00 o'clock P.M., June 23,
1959, with Chai~n Acker presiding.
PRESENT: Commissioners Acker, Davison, :Forman and Stout
ABSENT:
Michler (Mr. Robertson entered the meeting at 8:09 P.M.

The minutes of the meeting held June 9, 1959 were approved as written
and mailed.
Consideration was given the application of the Shepherd of the Hills
Evangelical Lutheran Church for a zone. variance to allow the use of
property @ 290 W. Foothill Boulevard for church purposes.
Chairman Acker recognized Herbert Chambers, 1653 Perkins Drive, member
of the' church council. Mr. Chambers spoke i'n favor of the application
relating that a traffic count had been conducted on Foo.thill Boulevard
at a time when the church services would be in session. Their findings
showed approximately 40 to 50 vehicles counted in a five minute period;
for this reason they could foresee no traffic hazard.
The protest petition's claim that a church devaluates property was
challenged. It was stated' that in some areas of Arcadia properties
located near church sites have actually increased in value. The appli-
cant's anticipate a 1/4 million dollar investment in church facilities.
Bert Cobb., District Chairman of the Boy Scouts of America, Rancho Dis-
trict, stated that there is a definite need for scout sponsors in the
Foothill area of Arcadia. Because the Lutheran church sponsors scout
activities the variance Should be granted.
James 'Florvik, member of church site cODDl1ittee, felt that Foothill
Boulevard is now less desirable for residential living because of the
heavy week day traffic. Some of the lots in the area north of the
tracks and south of Foothill Boulevard have remained vacant due to
this condition.
Pastor Ray Hanson, submitted a population distribution map of Arcadia'
members. The point was made that there are only four churches serving
two-thirds the area of the city. Only one Christian Church exists north
o"f the A.. T.&S.F. RR. Another church is proposed on Foothill Boulevard
east of Santa Anita Avenue. A survey of 80% of the homes north the
tracks indicated that less than one-half are attending a church.
Pastor Hanson reiterated that there is no possible site, other than the
one at'290 W. Foothill Boulevard, on which to locate their Lutheran
Church.

on a parking problem' were not accurate. At the present there is an
area equipped to handle 16 car.s on the lot. Future plans call for
an increase of about 100 cars.'
Francis S. Wright, 1120 San Carlos Road, opposed the variance on the
ground that churches devaluate surrounding properties.
H. S. Bryson, 291 W. Foothill Boulevard reviewed the accident rate
along Foothill Boulevard, and failed to see how the church goer could
leave the lot without endangering the 'lives of members and passersby.

Mr. Forman also stressed the four points that must exist before a
variance can be granted. Particular exphasis was placed on the items
pertaining to (1) the granting of a variance will not be materially
detrimental to the public welfare, and (2) the granting of a variance
will not adversely affect the general plan.
Mr. Rober.tsonstated that subdivisions have gone into the area as resi-
dential developments, and this residential area .should De preserved.
Mr. Davison agreed tha~'churches are a welcome institution yet it is
regrettable when they ask .for a permit under a variance procedure. It
. is the Planning Commission's function and responsibility to see that
the zoning development is not broken down.
Mr. Acker added that church variances are usually granted where other
churches enjoy the same benefit of location.
Motion by Davison, seconded by Forman and carried to recommend denial
of the aforementioned variance and instruct the attorney to prepare the
necessary resolution.

Inasmuch as a Zoning Committee report was not available, Mr. Acker
suggested the consideration on the proposed changes in Zone R-3 require-
ments be postponed until the first regular meeting in July.
Motion by Mr. Davison, seconded by Mr. Stout and carried to postpone
a consideration of deciSion on the proposed R-3 Zone changes until July
14, 1959.
Motion by Da~ison, seconded by Mr. Stout and carried to postpone a con-
sideration of decision on the proposal to amend rear yard requirements,
as contemplated by Resolution No. 32l.until July 14, 1959.

The engineer's report WaS read. The Commission felt that the proposed
split would tend to straighten an already irregular rear property line.

Motion by Mr, Acker, seconded by Mr. Stout and carried to re.commend
approval of Lot Split No. 253, subject. to ,the foUowing condition:
1. File a final map prepared by Registered Engineer or
Licensed Surveyor.
The secretary presented final map of Tract No. 24499 located on South-
view Road east of Hungate Lane, cqnsisting of 11 lots. The map con-
forms substantially with the approved tentative map.
Motion by Robertson, seconded by Stout arid carried unanimously to
recommend approval of final map of Tract No. 24499, subject to the
following:
1. Install all street' improvements .required by the sub-
division ordinance.
2. Pay the following fees and deposits:
2 s.treet lights @ $150.00 ea.
16 street trees @ $5.00 ea.
11 lots recreation fee @ $25.00 ea.

3. Dedicate lots 12 and 13 to the. city in fee.
4. Provide a satisfactory drainage easement from the
northariey.
5. The city shall dedicate Lots 8, 9 and 10, Tract No.
22220 for' street and alley purposes.
6. Pr.ovide necessary utility easements.
7. Record a covenant on Lot 11 stipulating that upon
change of ownership of the lot or, upon application
for a building permit. to. develop it, the south 20
feet of the west 5.06 feet of Lot 11 will be deeded
in fee to the City of Arcadia, and in any case, shall
be deeded in fee to the City of Arcadia at the end
of a 10 year period.
ZONE VARIANCE A letter received from the Foothill Jewish Community Center was
(Jewish Center)presented. The body of the letter requested an extension of time of
the.ir approved zone variance at the northwest corner of Foothill
Boulevard and Second Avenue. The present variance expires July 6,
1959.

Mr. Stout cautioned the commission on establishing policies of
variance extensions.
Motion by Robertson, seconded by Forman and carried unanimously to
grant the Foothill Jewish Community Center a six month extension of
time of their previously approved zone variance.
Tentative map of Tract 'No. 25103 was received from the Los Angeles
County Regional Planning Commission for recommendation. The proposed
subdivision lies west of the city boundary and north of Duarte Road
in County territory, consisting of 7 lots. Chairman Acker instructed
the secretary to inform the Regional Planning Commission that the lots
sizes do not meet the city minimum standards', and further recommend
that, if approved, the existing cul de sac be eliminated and the
curbs be reconstructed' on a straight line.
The Commission was advised that the Southern California Fringe .T.F. Com-
pany had made app1icationfor a business license to install a master T.V.
antenna on Lot 3, Tract No. 23145 in the Santa Anita Highlands. This mas-
ter antenna would serve as a booster to the fringe areas in the last
three tracts of the Highlands. Wires from

the antenna would lead to and be carried on the Edison and Tele-
phone poles with lead tn wires to the various homes. Because the
utility poles and wires would'be utilized, approval of the Edison
and telephone companies is necessary.
Matt Hunt representing the George Elkins Company spoke of the definite
need of this type of service for the fringe area. Many of the
unsightly tall individual T.V. Antennas would. be eliminated if the
master tower was instafled.
Leo Arranaga and Herbert .Hunt of the Southern California fringe T.V.
Company, Glendale 5, California, explained in detail how the antenna
would "e installed and operated. Similar service is being conducted in
La Canada, La Crescenta and Sun Valley, California. Subscription to
the service would be approximately $4.50 per month with an .added $90.00
installation fee'. ,-
Mr. ~icklin stated that this type of operation is not classed as a
permissible' use. in .the zoning ordinance. The cOlDIDission should recom-
mend that the installation and use of such a T.V. antenna be classified
as a use permissible in a specific zon~ or as a special use subject to
the regulation of a special use permit application.
A general question and answer session ensued.
Motion by Rob'ertson, ,seconded by Forman and carried to recommend the
classification of a master T.V . antenna as a special use and to instruct
the attorney to prep~re the necessary resolution.
Mr. Nicklin advised the'T. V. company that in areas where their company
lines encroach on public property a franchise similar to that granted
by the city to the Edison and telephone companies might. possibly be
needed.

The Proposed zone change of property located south of Duarte Road to
C~ino Real Avenue and east of Baldwin Avenu~ to Lovell Avenue was
discussed. The change as contemplated would classify the above pro-
perty into Zone C-3 and D with the exception of existing Zone C-2

property. The present R-2 lot on Baldwin Avenue (Lutheran Church)
will be recommended for Zone C-2.
Motion by Davison, seconded. by'Robertson and carried to instruct the
attorney to prepare the necessary resolution instituting proceedings
and to hoid a publ1chear1t\gon Augus.t 11, 1959 for a zone change of
property from Zone R-l and R-2 to Zone C-3 and D bounded on the north
by Duar'te Road, the south by Camino Real Avenue, the west by Bald'win
Avenue and the east by Lovell Avenue; excepting the presently zoned
C-2 property and excepting the presently Zoned R~2 property on Baldwin
Avenue (Lutheran Church) which. is recommended for Zone C-2class.1fica-
t10n.

Mr" D. L. Robertson announc~ed his' resignation after an eight year
tenure of office as a.City Planning commissioner. Mr. Robertson
reflected that a great deal had been accomplished by the Commission
and there was even more to be accomplished in the years ahead.
The Commission acknowledged Mr. Robertson's fine record of service and
expressed their regret in his termination of office.
There being no further business the meeting adjourned.
