PLANNING COMMISSION OF THE CITY OF ARCADIA
REGULAR MEETING
SEPTEMBER 27, 1960
The Planning Commission of the City of Arcadia met in regular session
in the Council Cham!>er of the City Hall at 8:00 o'clock P.M., September
27, 1960, with Chairman Acker presiding.

Since the minutes of the meeting of September 13, 1960 were not com-
pleted, the Planning Commission could not approve them at this .time.
The Planning Commission held a public hearing on the application of
Arlinic Properties for a zone change from ZonePR-2 to Zone C-2 on pro-
perty at the rear of 1104 and 1108 S. Baldwin Avenue.
The Planning Secretary ~ead from the application Which stated that the
development of West Arcadia has created a demand for more office space
and/or retail businesses; the lots immediately to the north are pre-
sently zoned C-2 and .PR-3 and the construction of the bowling alley
has commenced'.
The applicant felt that the change of zone WDuld not in any way be de-
trimental to surrounding property.
The Planning Secretary at the request of the Chairman pointed out the
location of property concerned while reading the staff report which
stated this is the application. of Arlinic Properties, signed by Dr.
J. Kendall McBane, for a change of zone from Zone PR-2 to Zone C-2.
The front portion of the property, including property to the north and
south, is now in Zone C-2: Property to the east is now in Zone C-3 and
developed as the Gateway Market.
Considerable thought has been given to the idea of opening Arcadia
Avenue to provide access to parking areas at the rear of this property
and the bowling alley to the north, as well as to that portion of
Arcadia Avenue now dedicated .further east.
It is the understanding of the staff that Mr. Shumaker, owner of the
bowling alley property to the north, has .verbally offered to dedicate

one half of Arcadia. Avenue through his property and install curb,
gutter and sidewalk, if the city will install the pavement.. We
further understand that this applicant has made a similar offer pro-
vided the area dedicated will be counted as area devoted to automo-
bile parking.
The area that should be dedicated is 333.35 feet by 30 feet, contain-
ing 10,000 square feet. At 250 square feet per car, this would amount
to 40 spaces. If the available curb parking only along this portion
of Arcadia Avenue were considered, using the so-called "buddy system",
14 spaces are involved.
Some years ago Baldwin Avenue in this area was widened. Only a portion
of the sidewalk area in front of the subject property was dedicated.
If a zone change on this property is to be granted, consideration
should be given to requiring the full dedication of the sidewalk area
on Baldwin Avenue, as well as to the opening of Arcadia Avenue.
The Planning Secretary read a communication signed by M. Fildes, 1431
S.Baldwin Avenue, which stated that on behalf .of the owners of the
West Arcadia Hub on the west side of Baldwi~ Avenue bewteen Duarte
Road and Camino Real we feel that necessity .of maintaining a proper
ratio. of parking area to building area on the land that is up for re-
zoning should be given serious consideration; since we have attempted
to provide sufficient parking for our own establishments. The letter
concluded that this ~atter should be given every consideration by the
commission.
The Chairman stated that this was the time and place for public hearing,
ana asked for those in favor of the ,granting of this zone change to
please come forward and give their names.
~k. Henry Hege, 651 W. Duarte Road, represented Dr. McBane the appli-
cant. He stated that he had very little to add to the application and
the information contained in the staff report, but would be happy to
answer any questions that the commission might have. Dr. McBane is
willing to go along With the dedication for the extension of Arcadia
Avenue, providing he is allowed equivalent parking space for the amount
that is dedicated for street purposes.
Mr. Hege stated that the sidewalk area of 10 feet on Baldwin Avenue
was built by Arlinic Properties and is being maintained by Arlinic
Properties, and it is the desire of Dr. McBane that he be allowed to
retain this sidewalk, and he would not like to have this area become
part of public property.
Mr. Rege pointed out with reference to the parking problem, that the
Gateway Market area is .immediately adjacent to the east" and then
there would be the parking at the bowling alley which is now under
construction. He believed that there could be an arrangement with Mr.
Shumaker to use this parking area for the proposed development.
Considerable discussion ensued in connection with parking.
Commissioner Golisch wished to have some idea of what the cost of pav-
ing Arcadia Avenue might 'be.
The Director of Public Works estimated roughly that for the 333 feet
of street involved, he would say the city would have an expense of
between $5,000.00 and $6,000.00. This would only include the paving;
no curbs, gut ters or sidewalks.

The Planning Secretary stated, in answer to questions,that the
agreement with Mr.. Shumaker to install curb, and gutter was verbal.
The Chairman asked for those opposed to the granting of this variance
application to please come forward. No one responded.
The Chairman stated that questions which have come up during the dis-
cussion tonight W9uld, he thoug~ indicate the necessity for referring
this matter to the Zoning COllllllittee and staff for further study and
a .report.
Moved by COllllllissioner Forman, seconded by COlllllli$sioner Norton and
carried to refer this matter to the Zoning Committee and staff for
study and a report.
The Planning CQmmission held a public hearing on the application of
Albert R. Schoof for a zone variance to permit a second dwelling at
1218 S. Second Avenue.
The Planning Secretary read from the application Which stated that the
existing house has a deep setback, which does not conform. The proposed
residence would be built to conform with the other houses on the street.
The Planning Secretary read the staff report which stated this is the
application of Albert H. and Edna C. Schoof for a zone variance to
allow a second dwelling on the lot at 1218 S. Second Avenue.
The lot is 60 feet by 285,92 feet containing 17,155 square feet, and
is in Zone R-l. It is presently improved with one single family dwell-
ing located 135 feet back of the front line. It meets all the require-
ments of the zoning ordinance for a second dwelling except that it is
1595 square feet shori: of the required area.
The proposed new dwelling will be the minimum 1000 square feet area
.withan attached one-car garage, and will be located at the building
line.
Seven .surrounding property owners have signed their consent to the
granting of the variance. Two other signatures are on the application,
but they do not show as property owners on the tax roll.
If this request is grante~ consideration should be given to dedicating
12 feet for widening Second Avenue.
The Chairman declared that this is the time and place for public hear-
ing, and asked for those in favor of granting this variance to come
forward and give their names.
Mr. Albert Schoof, the applicant, 1218 S. Second Avenue, stated he
was under the impression that any additional ground to be dedicated
for the widening of Second Avenue had been discontinued, since the
widening of Santa Anita Avenue was taking place.
The Planning Secretary stated that dedications have been contlnued
and had been required of subdivisions and lot splits all along Second
Avenue; and he explained that the present setback is 35 feet from
the present property line, and that building line, or setback line
would remain the same; it would set back 23 feet from the new pro-
perty line.
Mr. Schoof continued that the existing home is approximately 900
square fee!:, and was builtin 1947; he had intended to build another
dwelling in front of this present dwelling. He stated that he is

no longer physically able to take care of the large front yard, and
he is not in a position financially to pay someone to take care of the
landscaping; the best way he could preserve the appearance of the pro-
perty would be to build a house there.
The Planning Secretary displayed plans for the commission's considera-
tion. He explained tha~ this plan shows a garage attached to the front
of the house, but the floor plan indicates that the garage has been
moved to the back of the house, resulting in a slightly different
elevation than the one on display. There is plenty of area to pro-
vide additional parking.
Mr. T. R. Bousman, 1224 S, Second.Avenue, who lives immediately south
of the property in question spoke. He was in favor of the granting
of this variance; in justice to the man's problem the commission should
look favorably on this application.
The Planning Secretary stated that several property owners had signed
in favor of this variance which was indicated on the map by light
green. There are 25% of the properties in the block already developed
with more thall one dwelling,and the onl.y condition the applicant
does not meet is the r~quired lot area.
Commissioner Michler stated that he would like to have the opportunity
of viewing this property and the surrounding area himself, and he moved
that the public hearing be continued until the next regular meeting
to allow further study and a report from the Zoning Committee and staff.
The motion was seconded by Commissioner Rutherford and carried unani-
mously,
Commissioner Michler .requested that the Chairman set aside item No. 3
on the Planning Collllilission Agenda in the interest of expediting the
proceedings. He suggested that the commission consider the lot splits
fiu.t. .The Chairman so acted and the commission consider the. lot
splits next.
LOT SPLITS
No, 303 - F. C. McIntosh, 76 W, Palm Drive, The Planning Secretary
read the engineer's report which stated that this is a request to
divide a 100 foot lot into two 50 foot lots, in an area where lots are
predominately much wider; an existing garage extends across the line
on parcel 2. In 1954 a similar request on this street was denied be-
cause of the 50 foot width.
Commissioner Forman stated that he and Commissioner Ferguson had
viewed this property, and actually with one or two exceptions all of
the lots in the vicinity are from 75 to 100 feet in width. He felt
that it would be doing. a disservice to the community in general to
start a small lot development .in an area where the majority of the
lots are 90 feet to 100 feet wide.
Commissioner .Forman moved that lot split No. 303 be recommended for
denial. His motion was seconded by Commissioner Ferguson who con-
curred with the analysis; the motion was carried unanimously.
No. 304.- 1428. S. First Avenue - Mabel pinter
The Planning Secretary read the Engineer's report, after which Commis-
,sioner Ferguson stated that he and Commissioner Forman checked this
lot, and he felt that there would be no objection to th:ls split.

AMENDMENT
CammissianerFarman stated that this split is actually increasing
the size .of the lat to the rear and all awing far a better building
site. Althaugh there has been same discuss.ian in the past regarding
the keeping .of straight rear lat lines, there is already a fairly
irregular line belaw this praperty, therefare this split would nat re
creating same thing that daes nat already exist.
Maved by Cammissianer Farman, secanded by Cammissianer Nartan and
carried ta recammend the. appraval .of Lat Split Na. 304, subject ta
the fallawing canditians:
1. File a final map with the City Engineer.
2. Remave all existing buildings from parcel Na. 2.
3. Remove the 6 foot high chain link fence fram the
front .of lat4, or lawer it ta meet code require-
ments.
Na. 305 - Paul Schmidt - 220 W. Foothill Boulevard
The Planning Secretary read fram the engineer's repart; in 1955 and
1956' llppl ications ta divide this lat inta 3 parcels were denied as
nat can forming with tqe surrounding properties.
Mr. Bill Faith, 126 E. Colarado, Monravia, representing Mr. and Mrs.
Schmidt, submitted a proposed hause plan to be constructed an the
newly created lot. The hause waulrl face Rancha Raad. It would con-
tain approximately 2500 square feet.
Cammissianer Farman stated that he and Cammissianer Fergusan viewed
this prapased lat split alsa, and he fel t that any hause buil t in the
area wauld be an impravement over what is there naw; he wandered if
it would be possible ~o in~rease the new lat in depth by 10 feet, which
would result in a lat 100 feet by appraximately 145 feet facing an
Rancho Road. The .owner stat~d that this would be agreeable.
Moved by Cammissianer Farman, secanded by Cammissianer Fergusan ta
recammend the appraval of Lat Split Na. 305.
Commissioner Narton des'ired ta cautian the commissian against estab-
lishing a pal icy which cauld bring farth additianal requests far
similar type lat splits in an area where wide, deep lats prevail.

particular properties involved in this hearing.
He stated that the staff and commission have met a number of times
with the owners and various members of the Downtown Arcadia Business
Association and the Chamber of Commerce. Recently, Mr. Wentworth
of the Chamber of Commerce met with the City Attorney and the Plan-
ning Secretary and they have suggested a definite recommendation, in
the form of a letter signed by Mr. Wentworth.
The Planning Secretary read the communication which accompanied the
points of suggested procedure, and then read the 10 points which were:
1. No new buildings to be constructed .and. no existing
building to be extended to a line nearer than 25 feet
from the south line of the alley.
2. Buildings now existing and encroaching into this
25 foot area may not be further extended or en larged
into that area.
3. When buildings are constructed, extended or altered,
an R foot wide sidewalk shall be constructed the
full width of the lot and at the 25 foot line.
4. Concurrent with the building construction, a marquee
8 feet wide will be required.
5. The 17 foot strip of land between the sidewalk and
the alley shall be used as a loading zone only.
6. One-story buildings may be constructed, enlarged or
al~ered as specified above without any further con-
tribution for parking,
7. Any construction or enlargement of a building more
than one-story will require a contribution to the parking
fund for all the floor area in excess of the area of
the first floor in compliance with the present require-
ments of the zoning ordinance.
8. Additions and alterations allowed by this variance are
for the sole purpose of providing additional entrance
and display area for customers entering from the pub-
lic parking lot. Such entrances. shall provide con-
tinuous access for customers through the building to
Huntington Drive. It is definitely not to provide
area for a separate and independent tenant unless
such continuous customer access to the front portion
of the building is provided.
9. Any addition or extension of the main building on lot
8 shall require the removal of the existing independ-
ent building now located within the rear 25 feet of the
lot.
10. Plans for all such additions shall be subject to approval
by the Planning Commission.
The Planning Secretary read a communication from the City Manager
which, stated in brief, that it is the. opinion of the office of the
City Manager that the compromise procedures as outlined in the re-
port :dated September 21 would eventually contribute much to the area.

The Planning Secretary stated that the suggestians which had been made
by the staff cancerning signs had nat been received with much enthu-
siasm by the merchants; there are no. particular regulatians an the
signs an the frant af the. building, but they prapased no. raaf signs
an the rear. That regulatian daes nat apply an the frant; the way
this suggested pracedure is drawn naw, it would leave the back af the
building the same as the frant; the sign wauld have to. camply with
the Building Cade insafar as being safe, etc.
Cammissianer Nartan stated that withaut Same stipulatian af cantral

The Planning Secretary stated that if the cammissian wished cantral
af the signs., item No. 10 shauld be madHied to. include the erectian
and installatian af signs.

Mr.. Mel Pratt, 21 E. Huntingtan Drive, stated he cauldn't be happier
than he was with the campramise presented tanight, and wished to.
thank the cammissian and the staff far their effarts tawards the salu-
tian af the. merchant I s prablem. He was /!load that the idea af having
parking alang the backs afthe cammercial. establishments had been
abandaned, due to. the heavy flaw af traffic which exists an the alley.
He didn't think the merchants hawever, would be taa happy abaut the
cantral af signs.
Cammissianer Michler explained to. Mr. Pratt that the idea wauld be
to. assure same sart af unifarmity in the signs.
Dr. Kramb, 19 E. Huntingtan Drive, stated that he awns the lat at
the carner af Wheeler and Santa Anita, which is also. included within
the Municipal Parking District. He thaught the cammissian recammenda-
tians were wanderful, but he did nat feel that they went far enaugh.
Dr. Kramb cantinued tbat if he were to. came into. City Hall with a set

of plans for a building on the corner of Santa Anita and Wheeler
he would have to provide all of the parking spaces which the code
required for a new building within a parking district; he had paid
$1,600.00 into the parking district, yet if he wanted to build a"
new building, he would have to provide additional parking spaces.
He did not feel that it would be quite fair that properties which
are already improved could eliminate additional parking, and yet on
a new construction within the parking district, that,the individual
would have to provide parking spaces.
Mr. Harry McMahon, owner of property at 33 E. Huntington Drive,
wished to go on record as being in favor of the proposals.
Moved by Commissioner Forman, seconded by Commissioner Norton and
carried to close the public hearing on this matter.
The Chairman declared that he thought this matter was ready to be
forwarded to City Council for action with full commission recommenda-
tion of the 10 points considered with a slight modification relating
to signs.
Commissioner Michler withdrew his motion to refer tbis matter back
to the Zoning Committee and staff for further study, and it was moved
by Commissioner Nor,ton, seconded by Commissioner Golisch to request
the City Attorney to draw up a resolution on the 10 points recom-
mended by the commission affecting property on the north side of Hunt-
ington Drive between Santa Anita Avenue and First Avenue with the
addition of "Signs" to item No. 10.

The Planning Commission continued the public hearing on the application
of Elrovia Corporation and Hinshaw's Department Store for a zone vari-
ance to permit a customer service building and annex at the rear of
1429 S. Baldwin Avenue.
The Planning Secretary read the Zoning Committee and staff report
which stated this is the application of Elrovia Corporation and Hin-
shaw's Department Store for a zone variance to allow a customer ser-
vice building and annex at the rear of property located at 1429 South
Baldwin Avenue.

A public hearing on this application was held on september 13, 1960,
at which time there was some support for the petition, and also con-
siderable protest.
A protest petition bearing 20 signatures was filed. These represented
13 parcels of property. Of these, 1 is from property now zoned C-2,
1 from property which has requested C-2 zoning, and 2 from outside the
300 foot line from the subject ,property. The protest was on the basis
that the establishment of this use would reduce residential property
values.
Mr. Don Ehr, representing Hinshaw's stated that the building would be

one-story, concrete construction; would face east into the present
parking lot; with no openings on the north, west or south abutting
the residential property. Also that .no deliveries would be made
before 8:00 A.M. and normally none after 5:00 P.M. The building
plan shows some landscaping,
In the opinion of this committee a building such as shown on the plan
submitted and used for the purposes requested in the application, is
needed for servicing the department store, which is a definite asset
to the area and the city at large, Also, that if the building is
properly screened and landscaped, and the hours of use regulated,
that its establishment will not be detrimental to surrounding resi-
dential property, most of which abuts the site only at the rear line
of the lots.
We, therefore, recommend that the variance be granted, subject to the
following conditions:
1. That the building be constructed substantially in accord-
ance with the plan submitted and at the location shown
on the plot plan.
2, .That no openings be permitted in the north, west and
south walls.
3. That an ornamental concrete block wall, 6 feet high,
be constructed at or adjacent to the north, west
and south property lines, and returned to the build-
ing at the northeast and southeast corners.
4. That the area between the building and the wall~ along
the north, west and south sides of the building, be
landscaped with trees or tall shrubs, ,
5. That the building be used only for the purposes set out
in the application.
6. .That the delivery of goods to and from the building be
limited to not earlier than 8:00 A.M., and not later
than the regular closing hours of Hinshaw's Department
Store.
The Planning Secretary in answer to the request of Conunissioner
Norton explained the previous discussions and reconunendations on
this matter.
Mr. Don Ehr, representing Hinshaw's Department Store, stated that the'.'
planting definitely would be on three sides of the building; they
would be acceptable to a concrete block wall around the property, if
this is a necessary condition for the granting of the variance, how,
ever he would l-ike to point out if a chain link fence were in good
repair, he believed it wOuld appear to lengthen the property of the
adjacent resiaences. If they put up a block wall then the adjacent
properties would end at the block wall; he believed that to view the
concrete building with the planned landscaping would be a more
attractive sight than a concrete block wall, landscaping which would
probably not be seen, and then another concrete wall of the building.
Conunissioner Forman wished to make certain that whatever landscaping
would be planted would be kept in good maintenance at att times.

Mr. Don Ehr stated that he would have to refer to Hinshaw's years of
experience on Mr. Clayton's property, and he believed that the com-
mission would find that whenever trees have died, they have been re-
placed in some cases as many as five times, and he believed that
Hinshaw's could stand on its record in this regard.
Commissioner Norton wished to clarify the times of anticipated deliv-
eries,
The Planning Secretary interposed by saying that due to the possibility
of the store being opened during the evening, there should be a modi-
fication in the tillle limit so that del iveries or pick ups could be made
after 5:09 P..M.
Mr. Don Ehr stated that normally deliveries are not made after 4:30
P..M.; however, in the conduct of their business they should have access
to the cuSComer service building until after the closing of the store
which would be 9:00 P.M. or 9: 30 P..M. at n;l,ght. He stated that if they
were opened during the evening hours, they would probably find it nec-
essary to make one or two trips down to the proposed new building du~
ing an evening. Normally, during the year they are opened three nights
a week, Monday, Thursday and Friday; however, from Thanksgiving until
Christmas they are open six nights a week probably until 9:30 P.M.
Mr. Henry Cordelius, who owns jincome property at 747 W. Camino Real,
stated that he had built this income property at considerable expense,
and he was very concerned about the noise which might have its source
from the proposed building, particularly if the noise were continued
during the evening houllS. He def1nite~y felt that the concrete wall
should be made a condition of granting this variance rather than a
chain link fence being allowed. He made reference to the $1,400.00
a year he paid in taxes to the City of Arcadia, ,and he believed he was
entitled to consideration.
Chairman Acker recommended the possibility of a compromise which would
limit activity at at the customers service building to 3:00 P.M.
Moved by Commissioner Michler, seconded by Commissioner Forman and
carried to close the public hearing on this matter.
Commissioner Golisch wished to be certain that the commission would
not be ,doing a disservice by not considering the parking problem by
allowing this building in an area now paved for parking, particularly
in relation to future development.
The other members of the commission did not believe it would cause
any future detriment to business development if the proposed building
were allowed. There is plenty of space between the proposed building
and the future buildings anticipated along Baldwin Avenue for future
parking.
Commissioner Golisch also wished to know if there would be any selling
on the ouside of the building.
Mr. Don Ehr stated that they intend to use possibly an area about 20 x
20 which would be set aside for the display of garden or outdoor furn-
iture.
Moved by Commissioner Rutherford, seconded .by Commissioner Forman to
instruct the City Attorney to draw up a resolution recommending the
granting of this variance, subject to the conditions outlined in the
Zoning Committee and staff report, dated September 22, 1960, with. the

modification to Item No. 6 to read that the delivery of goods to and
from the building be limited from 8:00 A.M. and not later than 8:00
P.M., and also the addition of "and maintained" to item No.4.

The Planning Commission considered a communication from Carl Pearson
427 W. Duarte Road, regarding the zoning of his property.
The Planning Secretary pointed out on the map the location of the pro-
perty under consideration which is on Duarte Road between La Cadena
and Holly; it is an area on Duarte Road which has been under consid-
eration for zoning for two years or more. The Planning Commission
recommended R-3 zoning on both sides of Duarte Road with the condition
that Arcadia Avenue would be opened; also that a street be opened on
the south side of Duarte Road. The only action which had been taken
on property in this vicinity are two parcels which have been rezoned
for the Methodist church on the south side. Now the opening of Arcadia
Avenue has been abandoned, consequently the request from Mr. Carl
Pearson for reconsideration. of. the rezoning of Duarte Road at this
location.
The Planning Secretary read the communication signed by Carl Pearson
which stated, i~ brief, that he had in the past been in favor of open-
ing Arcadia Avenue behind his property, and had cooperated fully
towards this end. . Since it was apparent that action on the opening
of Arcadia Avenue was abandoned, he was requesting rezoning of his
property from R-l to R;3 in order that his property could be developed
to its fullest,.
The Planning Secretary also .read a communication from the City Manager
addressed to Mr. Carl Pearson which outlined the action of the City
Council in the abandonment of the proceedings for the opening of Arcadia
Avenue, and also stated that it was the intention of the council in the
passage of the resolution that all pending zoning matters should be
reviewed again by the Planning Commission in light of the action taken.
The letter concluded by informing Mr. Pearson that this matter would
be brought to the attention .of the Planning Commission by the Planning
Secre tary.
The Planning Secretary stated that to date Mr. Pearson had not filed
any formal application requesting a zone change. In talking to Mr.
Pearson over the phone., the Planning Secretary stated that he expre ssed
the opinion that to rezone one lot would certainly constitute spot
zoning, and that the Planning Commission would look upon such zoning
unfavorably. Within the past week, Mr.. Sorg, who lives at 457 W.
Duarte Road and who was the actua'l signer of the application in past
proceedings, was in the office requesting information as to the pos-
sibility of rezoning to R-3"R rather than to R-3. The Planning Sec-
retary stated he gave Mr.Sorg the application forms; that if the
people in the area were interested and .he could get enough of them

to show a majority .interest in a zone R-3-R, or even a Zone R-3 if
that's what they still wanted, that he would bring the application
to the Planning Commission and see whether or not they might wish to
institute proceedings by its own motion due to the fact that these
people paid' quite a considerable filing fee two years .ago on their
application, and had still had no definite action.
The Planning Secretary stated that in his opinion .the commisst on
could not take any definite action outside of instructing the Plan-
ning Secretary what course to follow.
After considerable discussion t~e Planning Secretary was instructed 00
notify Mr. Pearson of the possibll.ity of Zone R-3-R and ask him to work
with Mr. Sorgo
