'. .1 M I NUT E S PLANNING COMMISSION OF THE CITY OF ARCADIA REGULAR MEETING JANUARY 9, 1962 The Planning Commission of the City of Arcadia met in regular session in the Council Chamber of the City Hall at 8:00 P.M., January 9, 1962, with Chairman Golisch presiding. PRESENT: Commissioners Acker, Ferguson, Forman, Michler, Norton,'Rutherford and Golisch ABSENT: None OTHERS PRESENT: Councilman Butterworth, City Attorney Nicklin, Director of Public Works Lortz, Planning Director Phelps and Planning Secretary Talley. The minutes of December 12, 1961 were ordered corrected by Chairman Golisch by changing the name of Commissioner "Forman" to "Michler" under the "AYE" vote on page 6 in the matter of the rezoning of Live Oak Avenue near Louise Avenue, and as thus corrected that they be approved as submitted in writing. The minutes of Dec.ember 26 and 27, 1961 were approved as submitted. '. Chairman Golisch expressed the' Commission's sympathy to Mrs. Melba Andrews, absent from the meeting due to an automobile accident in which she and Mrs. Hazel Schaefer w~re involved, and suggested that a letter from the Com- mission be sent her expressing their best wishes for their speedy recovery. Chairman Golisch also expressed the appreciation of the Commission for the presence of Councilman Butterworth who was substituting for Councilman Phillips as Council's liaison with the Planning Commission, and to Mrs. Dorothy Peasley who was substituting for Mrs. Andrews A publiC hearing was held on the application of S. V. and Ruth J. Hunsaker and Mrs. George Morris, for a zone vari- ance to allow the properties at 930 and 950 West Foothill Boulevard to be used by United Electro Dynamics, Inc., (now located at 200' Allendale Road, Pasadena) for the purpose of research, development, engineering, fabrica- tion, assembly and servicing of electronic and electro- mechanical materials, products and systems. The Planning Director advised that the Planning Commission is aware of the pressure of new and quite often radically different development of land usually attendant on land areas adjOining any new freeway; that it is their desire to formulate appropriate land development policies to in- sure that land use changes induced by the p~nding construc- tion of the Foothill Freeway through the City will be . January 9, 1962 Page One r < . . orderly, compatible and harmonious with the existing de- velopment and character of the entire City. He continued with a summary of the existing land use of the City, and recommended that only residential or residentially com- patible uses should be permitted in North Arcadia; that if any change of zone is considered for the area south of Foothill and west of San Carlos Road the change ought to be more restrictive than the present Zone R-l; that Zone R-O might be more appropriate to encourage the continua- tion ~f high quality residential development particularly characteristic of North Arcadia. The Planning Secretary read the applicants' request for a variance to use the subject property for the purposes above stated and a communication from Stiles & Robert Clements, architects, which describes the proposed future as well as present plans, which was requested to be included and made a part of the application. He read in their entirety the exceptional and extraordinary circumstances which the applicants felt were applicable to the property involved that do not apply to property in the same class., in part, to wit: 1. That the granting of the requested variance will not be detrimental to the public health or welfare or in- jurious to the property or improvements in the vicinity inasmuch as the nature of research precludes irritants such as noise, odors, etc.; 2. That there will be buffers to the south, east and west; 3. That there will be increased taxes, increased payroll and favorable publicity; 4. That the variance will protect a substantial property right of the applicants; 5. That the freeway has already accomplished an adverse effect on R-l zoning. The owners of the property at 930 W. Foothill purchased their property in 1943 and the property at 950 West Foot- hill Boulevard was acquired January 5, 1961. The Planning Secretary also read in full communications from those opposing the requested variance on the follow- ing grounds: Names and addresses: Mr. H. O. Howe, President Reasons in substance: other locations for industry rather thanresidentialj Could open the entire south side of the boulevard for industry and commercial use and destroy the character of one of the City's finest residential areas; Arcadia known as city of homes rather than industryj Deterioration of property valuesj Establish a precedent for spot zoningj Other commercial developments are far removed and have no bearing upon subject area; Increase in traffic on Foothill Blvd. The Planning Secretary than read in full the staff report, which stated in part that the subject properties consist of 812.5 foot frontage on the south side of Foothill Blvd. and a depth of approximately 440 feet to the north line of the proposed Foothill Freeway (8.15 acres) and is in Zone R-l, located on Dexter Avenue, the west line being 1300 feet east of Michillinda Avenue, the east portion of the site being improved with two residences and the west por- tion being vacant. That the staff is. aware that the 'heavy traffic and its noise on Foothill Blvd. poses some problems to a resi- dential area to which the construction of the proposed Foothill Freeway may add but which may reduce the amount of traffic on Foothill Blvd.' That proper screen planting would help reduce the noise factor. That although the plans and descriptions of the use re- quested indicate that the building will be attractive and the business desirable to the .City, in the opinion of the staff there is ample property now zoned for industrial use in the City and that from information submitted in the application that the applicants have not shown suffic- ient extraordinary circumstances or conditions applicable to the subject property to warrant the placing of such a use in the .heart ,of',one of,-the best residential areas in the City, and that the staff recommends the application be denied. Chairman Golisch declared the hearing open on the subject requested' zone variance and inquired if anyone in the audi- ence desired to address the Commission, stating that those in favor of the zone variance would be heard first. The following persons in favor of the requested zone vari- ance addressed the Commission and stated in part as follows: Mr.-Robert Stevens, 2304 Huntington Drive, San Marino, attorney represent1ng'the applicants, spoke at length. He stated in part that the applicants have had several' oppor- tunities to sell their property but have turned them down January 9, 1962 Page Three . . because of unsatisfactory proposed"usage; that the construc- t1.on of the proposed'Foothill Freeway will have a depressing effect on applicants' p~operty; that it will create a prob- lem island of the property; that they are not seeki~g. a variance to rezone the property conimercial, industr'ial or for manufacturing as is permitted under the Code; that the property cannot be'used for the construction of estate , type homes; that the adjacent property owners have been contacted and with the exception of one, (Mrs. Dextra Bald- win McGonagle, 850 West Foothill Blvd.), are in accord with the proposed usage. , . Mr. stevens displayed a drawing of the area a~ter the ad- vent"of the freeway, which showed a subdivision that could be built there which would consist of 170 lots between Michillinda and Old Ranch Road. He added that another pos- sibility for the use of the land would be multiple family dwellings, or a city park. That he estimated that if a subdivision was built there it would consist of houses cost- ing in the neighborhood of between $15,000 and $30,000; that ~partment houses with apartment rentals commensurate with the neighborhood would not, from experience, rent easily due to the adjacent freeway; and that the maintenance cost of a city park would be very high and would not be benefi- cial to ci ty residents; that r.esidentiaL.property taxes would be offset by the additional city services required, such as police, fire, water and additional schools. Mr. stevens further stated that the proposed facility of United Electro Dynamics, Inc. would be both beautiful and functional and would be a desirable solution 'to the prob- lem presented for the area by the advent of the freeway. Also that his client would appreciate any suggestions or modifications and would attempt to cooperate therewith. That their reasop for desiring to locate on the subject property is due t.o in~ufficient parking for their facili- ties on Allendale Road in Pasadena and that they must move in 1962; that they feel the subject property is an ideal site for their employees. He submitted for the inspection of the Commissioners items proposed to be assembled at the proposed, plant. Mr. Robert O. Clements of the Architects-Engineers firm of Stiles & Robert Clements, 830 Wilshire Blvd., Los Angeles, stated in part that he is a resident of San Marino; that 'he felt there is a serious zoning problem in the subject area; and that the best solution to the problem in his opin- ion would be the proposed research park. Mr. Stevens spoke again and summarized the yarious reasons why he felt the requested variance should be granted; in substance, that the proposed construction would not be detrimental to the property valu~s of the area; that it is the desire of the management of, his client to maintain the architectural characteristics and atmosphere of the neighborhood,as exemplified by the facility presently oc- cupied on Allendale; that said company is in the process of negotiating for rights ~to, pU,J;>chase additional property should the requested variance be granted, and reiterated statements previously made. To Commissioner Norton's query as to whether the applicant January 9, 1962 Page Four . . had requested any assistance from the Planning Director or anyone else in the City employ relative to other locations in the City for facilities of this type, Mr. stevens re- plied in the negative, and to Chairman Golisch's request for information as to the number of employees and the per- centage of same that would be professional, Mr. stevens replied that approximately 333 employees were estimated of which 100 would be professionals with degrees, and 200 fabricators. Commissioner Norton commented that since Mrs. Morris has owned the property at 950 West Foothill Blvd. for one year only she must have been aware of the advent of the freeway and consequently she has suffered no hardship. Mr. Stevens also advised, in answer to Chairman Golisch's question, that Arcadia presently realizes a tax of ap- proximately $9000 in the entire area and that this would be increased to approximately $18,000 if the requested variance is approved. Mr. S. V. Hunsaker, one of the applicants stated in part that the character of the property is being changed, that it is not high-class R-l property and will not remain residential; that the proposed construction will not de- press property val~es and that the employees will wish to live near their work and will buy propertu in Arcadia. Mr. Howard Garrison, 870 West Foothill, stated that his house was built to be compatible with his four acres of land eight years ago, but that the freeway will take 250 feet on the west side and 268 feet on the east; that the advent of the freeway will also remove a great deal of the property of his neighbors on both sides, said neighbors being the Monroes and Mrs. McGonagle and no one will wish to build the type of houses that now exist north of the freeway; that only tract houses could be built there which would depreciate property values north of the freeway more than anything else; that he would prefer a building such as proposed by the applicants. Mr. J. S. Monroe, 890 West Foothill, spoke at length, stating in substance that he wished to refute the state- ments made that the proposed type of construction would depreciate property values, and cited examples of property sales in the area and also in the vicinity of the Sears development which showed substantial increase in value in the years 1955 to 1961. He also mentioned that according to ~eports of Foster & Kleiser, County Engineers, and others, traffic flow is re- duced from 25 to 50% on major 'roads with the advent of freeways in the vicinity and cited statistics regarding Ventura ,Boulev.~rd"and ~aurel, Oanydn before and after the advent of the'Ventura Freeway and others. Klinger, attorney for Mrs. 'McGonagle, 850 W. Foot- hill: Reemphasized the position of his client as set forth in communication read earlier; that to permit the start of the proposed construction would result in continued growth of industrial property. Robert Arth, President of Rancho Santa Anita Residents Assn., 1017 Catalpa Rd., representing 775 residents of which 400 were members of the association: that the route of the freeway has not been definiVely settled, in fact a hearing 1s to be held on this in the near future; that there will be adequate space for 1/3 and 1/2 acre lots with homes on t~em compatible with the area; that the construction of the pro- posed plant will be a detriment to the area and will result in other adjacent property owners requesting zone changes; that in his opinion the adjacent property owners who are favoring the requested variance are primarily anticipating the gain of a pro~it on their property. ' George Meeker, 1025 Singing Wood Drive: that the property on the south side ~f Foothill could be developed with homes in the $25,000 to $30,000 class whim in his opinion would not be as objectionable as the proposed plant. That prop- erty values have increased since 1957 in all of Southern California, not only in the vicinity of the Sears develop- ment. Mrs. Robert Arth, 1017 Catalpa Road: that her home and others in her area were built to face the mountains and if the proposed construction is completed she and her neigh- bors will be looking at the rear of the building and park- ing lot. Henry Lane, 766 Singing Wood Drive: That he agrees with the staff report; that in his opinion the adjacent property will not be damaged by the advent of the freeway. No one else desiring to be heard and in keeping with the policy of the Commission, Chairman Golisch inquired if the proponents wished to offer any rebuttal and in such event requested that they only present.facts not covered previ- ously. Mr. Robert Carr, real estate developer connected with the January 9, 1962 Page Six . . Park Investment Company, residing in San Gabriel, stated in part that in his. experience other areas invaded by a f~eeway depreciated in property values; that certain loan companies, such as Glendale Federal will not loan on prop- erty within 300 feet of a freeway; that apartments located along a freeway do not rent easily due to the noise of truck traffic. He alSo mentioned the advantage to Arcadia tax-wise in favor of the proposed plant as compared to residences which require additional city service. Mr. Stevens spoke again and added that he felt sure the City Attorney could cover all conditions necessary in a variance that would protect,! the adjacent properties. No one else desiring to ~e heard, Commissioner Acker moved that the hearing be closed. CoIiunissioner Forman seconded the motion which was carried on roll call vote as follows: AYES: Commissioners Acker, Ferguson, Forman, Michler, Norton, Rutherford and Golisch NOES: None ABSENT: None A general discussion ensued", the Commissioners expressing their thoughts and opinions on the matter in part as fol- lows: Commissioner Forman: The area can be retained for R-l con- struction; loans are available on properties near freeways provided there is ample buffer and landscaping; truck traf- fic will not be a pro,blem on the proposed Foothill Freeway. Commissioner Acker: Proposed construction is premature, the construction of the proposed freeway being apprOXimately five years in the future. He then moved that the variance request be denied. Commissioner Rutherford: Agreed with Commissiorer Acker that the requested variance is not compatible to the R-l zoning'in the area. Commissioner Michler: Agreed th~ an island is being created with the problem to be faced by future commi~sions; that the proposed construction is not compatible to the area and in answer to his question of Mr. Lortz as to the latest information on the proposed ,freeway, Mr. Lortz re- plied that there has been no change in the last four weeks. Commissioner Ferguson: That the' proposed type of operation is desirable for the City but the subject location is wrong. Commissioner Norton: That the proponents have not re- quested or been assisted in locating another site in the City; that the additional revenue would be welcome; that the City has an obligation regarding the so-called island and everything possible should be done to determine its future; also that the staff should approach 'the sub- ject company regarding a more suitable location. Commissioner Golisch: That he concurred with the other Commissioners; that Arcadia is basically a residential area and that a large majority of its people, want to main- tain it primarily as a residential area; that it will be necessary to sc'rutinize closely any changes that will . materially affect the type of living area desired; that the character of the proposed facilities is the type the City would like to have and that the City administration 'should get together with them in an effort to develop other areas more compatible. Commissioner Ferguson then seconded the motion to deny the requ~sted variance mage by Commissioner Acker, which motion was carried on roll call vote as follows: AYES: Commissioners Acker, Ferguson, Forman, Michler, Norton, Rutherford and Golisch NOES: None ABSENT: None Chairman GOlisch ordered a recess at 10:55 P.M. The meeting'reconvened at 11:00 P.M. Dr. H. H. Kettell, 245 LeRoy Avenue. (Previously referred to Commissioners Acker, Michler and Rutherford.) MOTION by Commissioner Acker, seconded by Commissioner Norton and unanimously carried on roll call vote that the Planning Commission indicate its intention to approve Lot Split No. 352, Dr. H. H. Kettell, 245 LeRoy Avenue upon compliance with the following conditions: 1. That a final map be filed with the City Engineer. 2. That a sewer lateral be provided for Parcel 2. 3. That' a re,creation fee of $25.00 be paid. 4. That the garage be moved from Parcel 2 to a legal location on Parcell. 5. That water service shall comply with the Uniform Plumbing Code. Marie L. (Approved 11-14-61) Reconsider co~ditions: The Planning Secretary advised that the plot plan shows a guest'house with kitchen facilities 8 feet from the new house; that the Code requires 15 feet, and that it is 10'6"'from the rear line and the Code requires 25'; that the applicant is requesting reconsideration of the condi- tion that the guest house be removed, the owner desiring to retain it and remove the kitchen facilities. MOTION by Commissioner Forman, seconded by Commissioner Nort,on and unanimously carried on roll call vote that the original motion to approve Lot Split No. ,347 subject to conditions imposed as of November 14, 1961 be sustained. January 9, 1962 Page Eight CHICAGO PARK TRACT (Vacation of Dearborn Street) COVENANT (915 LaCadena Avenue) . . Discussion was held on the request of Mr. Max Goldring for the vacation of certain streets in the Chicago Park Tract, located east of Peck Road and south of the Rio Hondo channel. The Planning Secretary read a staff report on the subject which stated in substance that none of the streets in said tract have been improved except Clark Street and Graham Brothers private access road which runs northeasterly from Clark Street. He displayed a map of the tract and pointed to the subject street. That the condition of title to a portion of the property seems questionable and that most of the lots appear to be owned by Max Goldring, Keith Davidson and Graham Brothers. That the land represented by the requested vacation plus that portion east of Gra- ham Brothers' private road, is about 9.75 acres. That in the opinion of the,~taff, a portion of these roads will eventually be vacated, particularly that portion of Dearborn Street and Monroe Avenue within the area which has a special use permit for quarrying; that if the area is developed in large parcels it could well be that all the streets except Clark Street should be closed; however, that the Planning Department recommends that none of the streets be vacated until such time as plans for the de- velopment of the property are submitted, which plans should indicate that no property is deprived of access to a pub- lic street. Mr. J. M. Hendler, Attorney representing Mr. Max Goldring, addressed the Commission and stated in part that his client's principle interest is the vacation of Dearborn Street from Myrtle Avenue to the private access road of Graham Brothers and desires that the request for the va- cation of all other streets in said tract be deleted. The City Attorney reviewed the matter, describing the area and the zoning and variance actions taken. Commissioner Acker moved that the request of Mr. Max Gold- ring for the vacation of Dearborn Street in Chicago Park Tract from Myrtle Avenue to the access road of Graham Brothers be granted. Commissioner Norton seconded the motion which was carried on roll call vote as follows: AYES: Commissioners Acker, Ferguson, Forman, Michler, Norton, Rutherford and Golisch NOES: None ABSENT: None MOTION by Commissioner Forman, seconded by Commissioner Michler and carried on roll call vote as follows that the request of Ralph M. Burston for the release of the covenant affecting property at 915 LaCadena Avenue, filed to insure the maintenance of a 35 foot side yard on La- Cadena Avenue as well as a 40 foot front yard on Fairview Avenue be released to afford the lot the same privileges as the other three corner lots, on condition that the plot plan as shown to the Planning Commission at this meeting be substantially followed: .I January 9, 1962 Page Nine . . . , HIGHWAY PLAN AUDIENCE PARTICIPATION TRACT No. 26938 (Final Map) . . No one in the audience desired to address the Commission. MOTION by Commissioner Ferguson, seconded by Commissioner Michler and carried on roll call vote as follows, that the Planning Commission accept the recommendation of the Planning Department and approve final map of Tract No. 26938 subject to the following conditions: 1. Remove all buildings and structures within this tract or across the tract boundary. 2. Provide rear line utility easements. 3. Dedicate' a one-foot lot in fee to the City at the west end of the alley. 4. Dedicate Lots 26 and 27 in fee to the City. 5. Dedicate the North 12 feet of the property at 220 East Duarte Road for street purposes. 6. Dedicate the West 12 feet of the properties at 1004, 1010, 1014 and 1026 South Second Avenue for street purposes. 7. The subdivider to'make every effort to secure the dedication of the North 12 feet of the property at 310 and 320 East Duarte Road for street purposes. 8. Install all street improvements required by the subdivision ordinance in accordance with plans and to grades satisfactory to the Director of Public Works. 9. T. Beckwith on behalf of A. H. Rude, 143 Sycamore Avenue, be granted and that a further extension of sixty days from January 6, '1962 be granted to complete the conditions of Lot Split No. 302. After discussion on Resolution No. 435 which would insti- tute proceedings for the amendment of Section 9252.1.4 of the Arcadia Municipal Codel involving the elimination of livestock in Zone R-l, and the protest of Commissioner Norton that he was opposed to the 'institution of such pro- ceedings; and it being the consensus of the Commission that- the subject be held :l,n abeyance until a report is re- ceived from the Health and Sanitat~on Commission, Commis- sioner Forman MOVED that the ~atter be tabled pending a report from said Health and Sanitation Commission. Com- missioner Norton seconded the motion which was carried unanimously. The City Attorney presented, explained the contents and read the title of Resolution No. 436 entitled: "A RESOLU- TION OF THE CITY PLANNING COMMISSION OF THE cr TY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE FOR THE ERECTION OF A CHURCH AND RELATED FACILITIES AT 110 AND ll8 WEST DUARTE ROAD IN SAID CITY". MOTION by Commissioner Norton, seconded by Commissioner Forman that the reading of the full body of,Resolution No. 436 be waived: AYES: Commissioners Acker, Ferguson, Forman, Michler, Norton, Rutherford and Golisch NOES: None ABSENT: None Commissioner Norton further MOVED that Resolution No. 436 be adopted.
