MINUTES PLANNING COMMISSION OF ARCADIA, CALIFORNIA ,-, REGULAR MEETING April 10, 1962 The Planning Commission of the City of Arcodia, Californio, met in regulor session in the Council Chomber of the City Hall, at ,8:00 o'cl ock P.M., April"_ 10', 1962, with Chairman Golisch presiding. PRESENT: Commissioners Ferguson, Forman, Michler, Norton and Gol isch ABSENT: Commissioners Acker and Rutherford. The minutes of March 27, 1962 were amended to show a unanimous vote on each of the two lot splits; otherwise they were approved as written and mailed. The Planning Commission considered the application of Saeed E. Murad for a zone varionce to allow a second dwelling at 931 S. Eighth Avenue which hod been before the Commission on March 27, 1962, and referred to the Zoning Comm ittee for further study. Commissioner Norton stated that he had been unoble to get the committee together, but in reviewing the matter he felt that the area was predominantly R-2 and according to the conditions for a second dwell ing this lot met all of the requirements without coming before the Commission with the exception of the rear portion not having been subdivided. He felt that if a restriction could be placed on the property that the size of the house would be a minimum of 1300 sq. ft. then if the property were sold a house compatible with the area would be constructed. Commissioner Forman had re-visited the area and while he was opposed to the granting of the voriance originally, he felt that the orea is alreody developed with two or more dwellings and other lots in the same block may be developed with no application before the Planning Commission. He now felt thot this use should not be denied the applicants because of the foct thot the rear of the property had not been subdivided. There is no apparent way in which it could be to meet the code. He felt that withlthe other lots on the west side of Eighth Avenue being able to meet the code requirements, a new house on the front of this lot would enhance the area and would be compatible. Commissioner Ferguson concurred in this statement. He stated the Murad~ were so close to camp lying with the requirements of the zoning ordinance that it would be unfair to deny them the privilege. The City Attorney stated thot often the Commission specifies conditions of approval in the resolution and can make conformance with the plot plans a condition. It would be appropriate to fix the minimum size for the house and in this case 1300 sq. ft. would be appropriate. The condition should also be imposed that the Commission reserves the right to make minor changes and modifications of design and plot plan if this will occomplish 'the full intent of the variance. April 10; 1962- Poge One , MOTION , TRACT NO. 26497 . . Chairmen Galisch stoted that he felt the Commission should not make recommenda- tions on technicalities. In this particular situation there were two units on various lots in the area, but this area is on the upgrade and he felt it would be more beneficial to the area as well os to the city to try to maintain os much as possible the true residential character. He Felt the property is valuable enough that a fine house would be built on it in the future. He recognized that it is a technicality that a decision would be made, but felt it would be better for the neighborhood to retain the R-I standords. Moved by Commissioner Norton, seconded by Commissioner Ferguson, that the application of Soeed E. Murad for a zone voriance to allow a second dwelling at 931 South Eighth Ave. be recommended for approval under the following conditions: I. That the plot plan as submitted be accepted; 2. That a minimum of 1300 sq. ft. of floor orea be maintained within the house; 3. That the Commission reserve the right to make minor chonges and modifi'- cations of design and plot plan in order to accomplish the fulP)ntent of th is variance. 4, That the existing car port be removed; 5. That the present curb be closed and a new driveway and approach be constructed; Said motion was corried on the following roll call vote: AYES: COf!1missioners Ferguson, Forman, Michler, Norton, NOES: Commissioner Golisch. ABSENT: Commissioners Acker and Rutherford. The Planning Commission considered the final map of Tract No. 26497, locoted at Santa Anita Avenue and Palm Drive, containing 6 lots. A map of the area was presented, and the staff report read by the Planning Secretary as follows: "This tract consisting of 6 lots, is located on Santa Anita Avenue at Polm Drive. The final map con forms with the approved tentative map and is recommended for approval, subject to the following conditions: I. Provide all necessary rear line ,utility easements. 2. Install all street improvements required by the Municipal Code in accordance with plans ond to grodes satisfactory to the City Engineer. 3. Pay the following Fees and deposits: I steel street light @ $115.00 $115.00 10 street trees @ 8.50 85.00 2 street name signs @ 35.00 70.00 6 lots recreation fee @ 25.00 150.00 TOTAL $ 420.00 4. All water services sholl conform with the Uniform Plumbing Code. April 10, 1962 Page Two " MOTION ZONE VARIANCE EXTENSION MOTION PU8L1C PARTICIPATION . . Moved by Commissioner Ferguson, seconded by Commissioner Formon, and unanimously carried that the final map of Tract No. 26497, be recommended for approval, subject to the conditions set forth in the staff report. A cammunication had been received from Robinsan Brathers for an extension of time for the voriance at the southwest and northwes t corners of Baldwin Avenue and Callita Street. A plot plan was exhibited of the proposed medical arid dental building to be constructed on the southwest corner of Callita and Baldwin Avenue. Also presented was an elevation of the bui Iding. A communication was also received from D. H. Hertfelder, A.I.A. 623 S. Lake Ave. Pasodena, California. The parking lot provides over twice the space that is required under the present ordinance. If the extension is approved, preparation of the final plans would commence immediately. As soon as the Building Department approves these plans, the tenants in the house located on the property would be notified to vacate and the house would be demolished. The northwest corner of Baldwin Avenue and Coli ita Street has a sign for lease and numerous calls have been received, but since it is a restricted C-I zone appropriate tenants have not been obtained. Within the next six months concrete plans wi II be developed for this corner. The architect has been retained to design the building and complete the drawings if the extension is granted. Discussion followed as to the time the present house on the property would be vacated and demolished. Mr. Horry Robinson stated four months should give ample time to complete the drawings and give thirty days notice to the tenants and to demolish the building. 1 Moved by Commissioner Forman, seconded by Commissioner Norton, ond unanimously carried that an extension of time be granted Robinson Brothers for the varionce which will expire May 15,.1962, for a period of four months with the further provision that if at the end of this period, the house has been removed from the property, a further ext~nsion of two months would be granted, extending the time to the full six months allowed,under the Code. I ,j -, A request wos made for Mrs. Marie L. Myler, 1004 South Tenth Avenue on a lot split which was previously gronted on November 9, 1961; wherein permission was as~ed to keep a guest house wh ich is now on the property. Th is was not granted. They were requesting further consideration on this matter as the guest house is bui.1t on 0 concrete slab and could not be moved. The Chairmon stated that it would be in order to return it to the committee that previously reviewed it with the report to come back to the Commission at its next meeting. A number of students from the Arcadia Hig~ School were present. They were welcomed by the Chairman. April 10, 1962 Page Three , . REPORTS (Modification Appeal) LIVE OAK REZONING . ; . . The'Planning Secretary odvised that on March 13, 1962, a matter wos before the Modification Committee to add to a house on EI Vista Circle. The Committee viewed the property and on March 27, 1962 approved the modificotion. This matter has been appealed and a hearing date is requested. The Commission fixed April 24, 1962 as the date of hearing on the oppeal from the decision of the Modification Committee. The Planning Staff had met with the property owners and business men in connection with the recent study of property located on Live Oak Avenue from Santa Anita Avenue to Second Avenue. Mr. Robert Warrilow, Planning Technician, who had made the study and met with the groups, made a presentotion of the zoning proposed by the staff. This report is to be forwarded to the City Council and the recommendation of the Commission is that the original application of W. H. Rowland, et. al. for a change of zone for certain properties locoteel on live Oak Avenue be denied by tile City Council and the matter referred back to the Planning Commission in order that proceedings may be instituted to consider the entire area in accordance with the report as out lined. The Planning Director reported thot he had received a communication from the South Arcodia-Live Oak Business Men's Association to the effect that they felt the PlannintJ Staff's recommendation for the rezoning of the n'orth side of Live Oak Avenue from Santa Anita Avenue to Second Avenue had much merit. Before they would endorse it, however, they desired the Commission consider the following: Those on the south side of live Oak, opposite the land in question, feel that a large~lock of land being labelled only for office use might have an adverse effect if the Margolin property farther to the west should be developed. They would feel it necessary to have commerCial development across the street in order to compete more effectively if the Margolin variance should be completed. In this case if the area is zoned c-o they would have no way to compete. They would like to withhold 'any recommendation or endorsement at this time until they knew definitely what is to become of the Margolin center. They did not feel that there wos demand for this amount of office buildings. The property could probably be put to better use in C-2 rather than C-O. The City Attorney stated this action was appropriate ond if the Commission considered the rezoning they should speCify in the notice of hearing the type of zoning for the area, and this should be the least restrictive zoning they would consider. April 10, 1962 Page Four . MOTION RESOLUTION NO. 444 MOTION MOTION . . Moved by Commissioner Forman, seconded by Commissioner Ferguson that the Planning Secretary be instructed to forward a letter to the City Council advising them of the action of the Planning Commission in recommending that the zone change request of W. H. Rowland, on Live Oak Avenue, be denied and that the matter be referred back to the Planning Commission so that pro- ceedings may be instituted for considerotion of the zoning of the entire area from Santa Anita Avenue to Second Avenue. Roll Call vote showed the motion carried unanimously. The City Attorney presented Resolution No. 444, entitled: "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF THE VARIANCE TO ALLOW A SECOND DWELLING AT 931 SOUTH EIGHTH AVENUE IN THE CITY OF ARCADIA, CALIFORNIA." Moved by Commissioner Ferguson, seconded by Commissioner Forman, and unonimously carried, that the reoding of the full body of the Resolution be waived. Moved by Commissioner Norton, seconded by Commissioner Forman, that Resolution No. 444 be adopted. Said motion was carried on the following roll call vote: AYES: Commissioners Ferguson, Forman, Michler a nd Norton, NOES: Commissioner Golisch, ABSENT: Commissioners Acker and Rutherford.
