SEPTEMBER 11, 1962
Tbe Planning Commission of tbe City of Arcadia, California, met in
regular session on September II, 1962, at 8:00 p.m., in tbe Council
Cbamber of tbe City Hall, witb Cbairman Forman presiding.
Cbairman Forman led in tbe pledge of allegiance to tbe flag.
PRESENT: Commissioners Ferguson, Forman, Goliscb, Kuyper and
Parker.
ABSENT: Commissioners Micbler and Norton

Tbe minutes of tbe meeting of August 28, 1962, were approved as
written and mailed.
Tbe tentative map and staff report by tbe Planning Department was
presented as follows:
Tbis tentative map sbowing tbe division of tbe property located on
tbe east side of El Monte Avenue, about 198 feet soutb of Las Flores
Avenue, was approved by tbe Planning Commission on Marcb 27, ~962.
Tbe City Council concurred witb the Planning Commission's recom-
mendations and approved tbe tentative map on April 3, 1962.
One of tbe conditions of the tentative map approval gave tbe sub-
divider tbe option of dedicating a one foot strip of land on the
south side of tbe proposed street in fee to tbe City or to place
the title of this strip in a trust witb a Title Company. The
latter course of action bas been selected by tbe developer. Tbe
purpose of tbis trust is to probibit use of tbe new improved street
until sucb a time as tbe abutting property pays tbe pro rata share
of the cost of tbe improvements benefiting the property. In this
matter tbe City Council Resolution No. 2512 requires a notice of
tbis intent to be sent to the property affected by tbe trust and
a public bearing by the Planning Commission. Tbis notice bas
been sent to Joseph C, Domenico, tbe owner of tbe property at
2112 III Honte Avenue.
Tbe Engineering Division of the Department of Public Works has
submitted a report pertaining to the total expense involved in
the placing of improvements in the subject tract and the pro rata
expense applicable to the property to the south of the tract, wben
and if this property proposes to use these improvements. The report
states:

"The owners of the property south of the subdivision
and abutting the street in this subdivision have by
the dedication of a new public right of way (and
improvement of the same) been placed in 'a position
of possibly creating one lot of similar proportion
to those in said subdivision. The benefit received
is calculated to be l/5th of the cost of the land
value, improvements and incidentals and is summa-
rized as follows:

The tract is partially in Zone R-O and R-l. At the time tentative
approval was given the Commission and Council modified the front
setback from 30 feet to 2S feet and placed a 20 foot side yard
requirement on Lot 1. This action permits a proper location of
the future homes.
The final map substantially complies with the approved tentative
map and is recommended for approval subject to the following
conditions:
1. The deed restrictions of Tract No. 13113 shall be
released or so modified that residences on lots I, 2
and 3 will not be in violation.
2. The subdivider shall make every effort to secure 10
feet dedication for street purposes, including the corner
cutoff, from the property at 2112 El Monte Avenue south of
"A" Street. If the dedication is not received the sub-
divider shall remove that portion of the unused private
driveway within the dedicated street and shall install an
appropriate radius curb return to the satisfaction of the
Director of Public Works. If, in the future, the property
at 2112 El Monte Avenue is divided, the necessary dcdicat ion
shall be required and the short radius curb return shall be
removed and a standard radius curb return shall be con-
structed at the expense of the applicant for the division
of the lot.

3. Dedicate all necessary rear line utility easements.
4. The front setback line on lots 1, 2 and 3 should be
25 feet. The side setback for lot 1 should be 20 feet.
5. Remove all buildings from the tract. Remove all
trees from the street right of way.
6. Install all street improvements, including drainage
facilities, required by the subdivision ordinance and
Public Works Department in accordance with plans and to
grades satisfactory to the Director of Public Works.
7- Pay the following fees and deposits:

8, Authorize the subdivider to establish a trust in accordance
with City Council Resolution No. 2512 on the property at 2112
El Monte Avenue for the amount of $3709.90.
PUBLIC HEARING
Chairman Forman announced that this was the time and place fixed
for the hearing of the trust to be established along the property
of 2112 El Monte Avenue.
PROPONENTS:
Mr. Kenneth Williams, 156 East Norman, Arcadia.
Hr. Kenneth Williams is of the opinion that it is a fair share of
the cost of street improvements and thinks that the man who is likely
to benefit from this, should pay his share of it.
OPPONENTS:
Mr. Joseph C. Domenico, 2112 El Monte Avenue, Arcadia. Mr. Domenico
questioned whether he would have to bare all the costs of the curb
return? Mr. Forbes stated that we wanted to be able to put a
standard curb radius which is normally a 25 or 27 foot curb return.
This is impossible within the limits of the dedication that we now
have. It will be necessary to put a substandard curb return in
with a 12 to a 15 foot radius which is the best we can do with what
we now have. If Mr. Domenico or some subsequent owner should come
in and wish a lot split, or any other action, one of the conditions
would be the curb radius be extended to the normal 27 feet and
that 10 feet be dedicated for El Monte Avenue. These would be
recommended conditions of any lot split or any other type of action.
Mr. Domenico mentioned that he had read an article in the newspaper
about a situation almost the same as his that was occuring on
Norman. On Norman, they a~v6cated $3,000.00 as a basis, and isn't
$3,709.,90 somewhat high!

The City Engineer explained how the trust ,figures were determined.
A short subdivision can get very expensive because there is a certain
amount of deadhead sewer, that is a sewer that is not serving anyone.
It is bound to be 10% or 20% higher than it would be on a large type
of development.

that the public hearing on the trust placed on 2112 El Monte Avenue.

BACKGROUND:
On February 20, 1962, the City Council by unanimous vote adopted
Resolution No. 3470. This action sustained Resolution No. 440
adopted by the Planning Commission on January 23, 1962, recom-
mending approval of the application of the Shepherd of the Hill s
Evangelical Lutheran Church to permit the construction of a,
church on property located at the northwest corner of Foothill
Boulevard and Santa Anita Avenue. The site has a frontage of
349.79 feet on Foothill Boulevard and 250 feet on Santa Anita
Avenue. A square 250' on the corner is zoned C-2, with a service
station on the immediate corner. Lot 77 upon which the major
portion of the current development is proposed has a frontage uf
99.79 feet on Foothill Boulevard and is zoned R-O with no tract
restrictions.
This resolution as adopted, set forth the following conditions:
a. That the entire development shall conform substan-
tially with the plot plan and ultimate site plan submitted.

b. That the parking lot shall be paved and separated
from the adjacent residential property. held under separate
ownership by a 6-foot masonry wall and a landscaped area in
substantial compliance with the plot plan submitted; said
masonry wall to be erected concurrently with the construction of
the building.
c. That drainage of the property, including the parking
lot, shall be to the satisfaction of the Director of Public
Works.
d. That any lighting of the parking lot and grounds shall
be directed away from adjacent residential property,
e. That a variance from the provision of Fire Zone No. 1
shall be granted so that the construction of the church
builHing may correspond with other churches outside of
No. 1 Fire Zone.
f. That a variance from the setback requirements shall be
granted affecting Lot 71, Tract No. 11074, to allow the
building at 25 feet from Foothill Boulevard instead of the
required 50 feet.
g. That the final plot plan, landscaping plans and building
plans shall be submitted to and first be approved by the
Planning Commission before issuance of a building permit.
h. That sidewalks of a minimum width of 5 feet shall be
constructed on all portions of Santa Anita Avenue and
Foothill Boulevard where there are no':existing sidewalks.
On August 8, 1962, the applicant submitted a set of architectural
drawings which were carefully studied and evaluated jointly by the
Planning Department and the Department of Public Works.
This review turned up several basic planning and design deficiencies
and in addition, a lack of compliance with some of the conditions
of approval recommended by the Planning Commission, A list of
these deficiencies with suitable recommendations was complied and
at a subsequent meeting between the applicants architect and the
Planning Staff these recommendations were fully detailed.
On September 5, 1962, revised plans were submitted to the Planning
Department and a final review indicated substantial conformance with
the original plot plan submitted, and complete compliance with the
conditions of approval adopted by the Planning Commission.
The development of this property in the manner indicated on the
revised plans represents a development consistant with good planning
practice and in complete harmony with the neighborhood in which the
property is located,
The Planning Department recommends that the plans be approved con-
tingent upon the condition that all the improvements on the subject
property be made in conformance to the final plans submitted to the
Planning Department by the applicants architect on September 5, 1962.

A copy of a contract entitled "Wall Agreement Between A. J. Vogel
and Shepherd of the Hills Lutheran Church," A. J. Vogel is the
property owner immediately north of this property.
The contract reads as follows:
A. J. Vogel does hereby give permission to raise the concrete
block wall located on the Vogel property adjacent to the Shepherd
of the Hills property at the corner of Foothill Boulevard and
Santa Anita Avenue in Arcadia, California, to a height of 6 feet
for approximately 300 feet in length.
1. The additional construction of the wall shall
be of similar color and quality as the existing wall.
2. Shepherd of the Hills is to besr all of the
construction and material cost.
3. The additional blocks shall become the property
of A. J. Vogel on completion of the work.
Signed by A. J. Vogel, 1125 N. Santa Anita Avenue, Arcadia and
also by Henry Nelson, President, Shepherd of the Hills Lutheran

Church as submitted to the Commission, subject to the conditions
indicated in the staff report.

the Planning Department as follows:

surveyor.
The Planning D~partment recommends that Lot Split #376 be approved.

and unanimously carried that the reading of the full body of the

OF A ZONE VARIANCE TO PERKIT THE USE
OF PROPERTY AT 716 HUNTINGTON
DRIVE FOR A NURSERY SCHOOL AND DAY
CAMP.
It was pointed out to the Commission that if tbis resolution is
adopted that the use of the property for a nursery scbool is
recommended to the City Council for approval. However, one of
the conditions of approval (that the building conform with
regulations of the No. 1 Fire Zone) appears to be too difficult
to meet because of the expense involved in making the required
structural changes. Due to tbis condition perbaps tbe property
will not be used for nursery school purposes as recommended by
the Commission.
The Commission discussed the advisability of deleting this condition
or of modifying some of the other conditions in the resolution but
decided that on the facts available to them that they will not alter
the resolution. However, if additional information proved that
the building could safely be used for this type of occupancy,
tbat the City Council could consider the merits of deleting this
condition of approval.

PARTICIPATION
Mr. Luben Balabanoff, 1625 South Second Avenue, Arcadia, addressed
the Commission and informed them of the structural conditions of the
building at 716 West Huntington Drive. He mentioned the cost would
be prohibitive to bring this structure to compliance with the No. 1
Fire Zone regulations.
REPORTS
Zone Variance - 315 Le Roy Avenue
This application has been referred back to the Commission from the
City Council because the attorney representing the applicant
informed the City Council that new evidence was going to be presented
which was not presented to the Commission. The Commission should
instruct the City Attorney to prepare the necessary resolution
setting this application for public hearing.
Appeal from the Decision of Modification Committee:
Mr. 60 Mrs. E, T,. Carney of 331 Monte Vista Road, have constructed
a poolside cabana which does not comply with the yard requirements
of Zone R-l. The Committee after reviewing the application voted
to deny the application and directed that the cabana be relocated.
The Commission should set a date of public hearing on this matter.
The Commission set October 9, 1962, as the date to hear this appeal.
