MINUTU PLANNING COMMISSION, ARCADIA, CALIFORNIA Adjourned Regular Meeting October~, 1962 The Planning Commission of the City of Arcadio, C...lifornia, met in adjourned regular session, October 30, 1962, at 8:00 o'clock P.M., in the City Council Chamber, City Hall, with Chairman Forman presiding. Commissioner James Parker led in the pledge of allegiance. PRESENT: Commissioners Ferguson, Forman, Golisch, Kuyper, Norian and Parker ABSENT: Commissioner Michler OTHERS PRESENT: Asst. City Engineer Fran~ Forbes Planning Technician Ernest Mayer, Jr. Planning Director William Phelps The minutes of the meetings of October 9th ;and October 23rd were approved as written and moiled. The final map of Tract No. 21997, located approximately 246 ft. north of Camino Real on the east side of Fourth Avenue was considered. A public hearing on this tract to consider a trust on the easterly 75 ft. of the large parcel located on the southeast corner which is not a part of this tract was held. STAFF REPORT "The subject tract is located on the .east side of Fourth Avenue, about 246 ft.- north of Camino Real. It contains an area of about 2-1/2 acres which is to be divided into six single-family lots. Tne one large parcel at the southeast corner is not a part of this tract. A notice of the public hearing has been sent to the property owner advising him that the subdivider proposes to place a trust on the easterly 75 ft. of this parcel to spread the appl icable improvement cost. The Planning Department recommends that this tract be approved subject to the following conditions: I. Remove all trees from the street righ.t of way 2. Install all standard street improvements required by the subdivision ordinance. Improvements, grading, grades and drainage shall be to the satisfaction of the Director of Public Wor,(s 3. Provide all necessary rear line overhead utility easements 4. Dedicate 15 Ft. corner cutoff at Fourth Avenue 5. Remove all structures within and/or across the tract boundary. The wor., shall be done in compliance with the Uniform Building Code. October 30, 1962 Page One , . . 6. A covenant in 0 form approved by the City Attorney shall be recorded agreeing that for the purposes of Article IX of the Arcadia Municipal Code the exterior boundary of soid tract shall constitute the rear lot I ine of lots 4 and 5 8. Authorize the subdivider to establish a trust in accordance with City Council Resolution No. .2512 for a distance of 75 ft. from the west line of lot No.6 for the amount of $2,840.32 Commissioner Norton,stated this is a final map and it conforms with the tentative map which has been approved. He stated this again was a cul-de-sac approach to the development ci the City and it i.s not completely compatible with the development concepts for the remaining portions of land that exists in the City of Arcadia. He felt the Commission had not had the full opportunity to evaluate this type of development; also with this type of development the City would end up with less than the desired type of development. He did not refer to the type of homes, etc. bu t the amount of space limited to the home and he felt immediate action,should be taken towards the total overall picture and the ultimate effect of this type of development. He did not have specif ic reference to the tract being considered but he felt there would be a continuous invasion of this type of development. He wanted to go on record at least of placing a "quarantine" on this type of development because it is becoming infectuous and there has not been an opportunity to stop it before it invades the city. MOTION Moved by Commissioner Ferguson, seconded by Commissioner Golisch that the final map of Tract No. 21997 located north of Camino Real and east of Fourth Avenue be recommended for approval. Roll call on the motion was withheld until after the publ ic hearing on the trust was held. PUBLIC HEARING The Chairman announced this was the .:time for the hearing on the trust in connection with Tract No. 21997, on the easterly 75 feet of the property west of lot 6. The Trust calculations were presented and amounted to $2,840.32. PROPONENT Mr. Hans Wilmsen, 1525 South Fourth Ave. stated he was not opposed to the trust but asked if the trust ran for the period of 20 years as he had understood, could the property "then be split -,and have the use of the new street if the ,property owner so des ired. This question was answered by the Assistan't City Engineer to the effect that the trust did run only for 20 years, aft~r that time the City had title to the one foot strip and the property owner could apply far a lot split facing the new street without beil)g requir~c! to participate in the trust. OPPONENTS No one desired to be heard. Moved by Commissioner Norton, seconded by Commissioner Golisch ond unanimously carried that .the public hearing on the trust be closed. . The roll call was then token on the original motion approving the finol map of Tract No. 2/997: AYES: Commissioners Ferguson, Forman" Golisqij" Norton and ParKer ; NOES': None ABSTAINED: Commissioner Kuyper ABSENT: Cammission.er Michler Final map of Tract No. 22199, located on. the east side of First Avenue about 884 ft. north of Camino Real was considered. STAFF REPORT "The subject tract is located on the east side of First Avenue about 884 feet north of Camino Real, opposite the Dana School. It consists of two properties i<nown os 1406 and 1332 S. First Avenue. It contains 1.8 acres divided into 8 single-family lots. This tract substantially compl,ies with the approved tentative map and is recommended for approval to the Planning Commission, subject to the following conditions: I. Remove all buildings and structures within the tract boun~ary or, if any are to remain, they shall comply with all building code and yard requirements in all respects. All building removals and relocations shall be complete prior to ,the signing of the finol map. 2. Remove all trees from the street righ t of way 3. Provide all necessary rear line utility easements, 4. Install all standard street improvements required by the subdivision ordinance. Improvements, grading, grades and drainage shall be to the satisfaction of the Director of Publ.ic Works. Minimum grade of 0.4% will be. required. October 30, 1962 Page Three . . 5. A covenant in a form approved by the City Attorney shall be recorded agreeing that for the purposes of Articll! IX of the Arcadia MunIcipal Code the exterior boundary I ine of said tract shall constitute the rear lot I ines of lots 3 to 6 inclusive. Commissioner Norton requested information as to how this subdivision would affect the overall land remaining on First Avenue. He was interested in what is going to happen with the balance of the street. The Planning Director advised that between First and Second Avenues a new street has already been developed - Greenfield Avenue. With these proper- ties being developed to a minimum depth of 125 ft. it left considerable depth on the properties facing First Avenue, in this case 321 ft. This is not suffi- cient to run another street so if this land is ever to develop the cul-de-sac method as a design technique will have to be used. This area was two properties and contained two old single-family residences with the rear portions completely undeveloped. There will be eight new homes with an approximate value of $35,000 each. He felt that ,the balance of the street would be developed in this manner. The policy has been to remove the old structures and develop new homes. , Commissioner Gol.isch felt this was more desirable than developing with multipleoni,ts. He felt thot if the land is not developed in this manner the ultimate would be a change of zone to multiple use. Commissioner Norton:statedthe acceptance of such a tract is being made without a complete look at the entire block and its future development. Some of the property owners,may be precluded forever from utilizing their property. Chairman Forman stated that with Greenfield Avenue having been developed with new homes it would be impossible to cut the street tlirough which would be the desired plan. However, it would be impossible to remove or relocate one of the expensive residences on Greenfield Avenue in order to accompl ish this. If there was an old house on Greenfield Avenue then the street should go through. The Planning Director stated that the Department, Developer, and the Commission is bound by the Subdivision Ordinance in that property can be developed providing it meets certain standards. If there are any deviations from these standards they are made by the Planning Commission with final action by the City Council. The Chairman, stated that Commissioner Norton had been appointed to the Subdivision.Committee purposely to see if there is some manner in which orderly development can take place without the extreme use of cul-de-sacs. Authorize the Mayor and City Clerk to sign the title sheet of the final map as an owner. ,(This is required to provide street right of way across the drainage channel.) A large delegation was in the audience who were interested in this matter. The Chairman stated that this was not a public hearing, but only a revieYl of plans that had been submitted after a request by the applicant to the City Council had been made. I'f any new information is to be presented the Chairman ,-,!,ould call for itr and have it read into the records. The City Council had set th is matter for publ ic hearing on .Nov~mber 7, 1962. A communication had been received from the delegation representing the Santa Anita Church of Rei igipus Science which was read into the record: "It is our understanding that developers are building a motel on the property on the two acres adjoining the southern boundaries of our present church property and th is matter is coming up far consideration on Tuesday, October 3Qth. In a letter to you dated July 22, 1962, we stated thaI the Church was desirous of negot.iating with regards to the purchase of this property. At this ,timlil we wish to make a firm statement that we are now able to purchase this property from the owners,. We have written a letter so advising them. Thank you for your consider,ation of th is letter." Mr. Mayer presented Plan.'C" and read the staff report. STAFF REPORT On October 16, 1962, the Arcadia City Council entertained a request by the Motel "6" applicants for a reconsideration of the variance appli- cation an. the basis of newly submitted plot plans which indicate a consider- able reduction in th.e total number of room 'units proposed. The City Counci I after careful consideration decided to defer action in , order thatthe Planning Commission be given an opportunity to study the new proposal and arrive at a definite recommendation. The application along with the Planning Commissia~I$,/recommendation is scheduled for a public hearing before.the City Council on November 7,1962. Motel "6" as it.is now proposed and shown on Plan C represents a reduction , in, the total number of room units from the 122 originally proposed by the applicants C!nd considlilred by the Planning Commission to the 88 now prol?osed.~.!his.is roughly a 30% decrease and changes the density from 49 d- units per ai:re to 34t units per acre. The Planning Department continues to consider the use of the subject property for motel purAoses appropriate and bel ieves Pla,n C to be an improvement over the previously 'submitted plans in the sense that they October 30, 1962 PageS ix . . not only show a density decrease but also a compliance with many of the recommended conditions of approval as set forth in the July 5, 1962, Planning Department R.eport. . If the Commission.decides to recommend to .the City Council that this variance be approved the following conditions should be made a part of that recommenda,tjon: 1. The variance not to be operative until cOl1:lplete plot plans, building plans, and elevations h9ve been submitted . to.and approved by the Planning Cammission, which shall be within,one year from the date of tentativ~ approval of the project by the City Council. S,ite work shall not be done until a building permit far the erection of the motel has been issued. Such building permit shall not be issued until the plans have been approved by all interested City, County and State Departments. 2. That grading and drainage plans be submitted and approved by the Department of Public Works prior to the issuance of a building permit. 3. That water services shall meet with the standards set up in t~e U~ifor!'1 Plumbing Code. 4. That all parking lot illumination and building illumination'sf)all be scheduled and directed away from the adjoininll properties and shall meet with the approval of the Dep'artmerit of Publ ic Works. 5. The Planning Commission may grant minor modificati ons" without further public headngs or notice therof, of the condi- tions set out above to the extent neces~ry,:, to accompl ish the purpose of. this variance,. 6. .Install an~ .COI1i truct curb, gutter; street I ights and . sidewalks to the specifications and. standards to meet the approval: of the Department of Publ ic Works and the State Division of Highways. 7. . Relocate the sewer I ine and grant nece~ary easements to the approva.' of the Department of Public Works. 8. .Final plans and working drawings shall be in sub- stantial compliance with Plan C. This plan had eliminated one of .the buildings and hove substituted plant material,landscaping and eliminated some parking spaces whiFh were a little tight. There is a proposed lobby and Manager's living quarters. .It also proposes a recreation' room and a mail's room. Many of the conditions of approval have been complied with, such as the planting along the flood control channel, elimination of parking spaces which were difficul t to negotiate and a decrease in the number of units. October 30, 1962 Page Seven . . : Commissioner Parker asked as to the density factor. This calls for 34 units per acre. , Some approximate figur~s :-vere given as follows: : Westerner - 29 units per acre; Santa Anit,a Motel - 15 units per acre; Round-yp - 5+ units per acre; Huntington - 5+ units per acre; Frontier - 12.6 units per acre; Flamingo - 21.5 units per acrej Eaton's -19,+ units per acre. 13.2+ units per acre.is the approximate q...erall kverage for all motels in Arcadia. The fire zone was discussed. This',is an R-3areo with a C-2 use so ,that the fire zone would remain unchanged. Commercial zoned property is Na, I fire zone. The Planning Director stated in some instances the fire zone had been waived in commercially zoned property. Commissioner Ferguson, stated the cO"1patible use of the property was his concern and this use ,inimilar to athers.in the area. Commissioner Parker stated it was a reasonable use and appropriate in the area and ,is in line with'!he development. The density is a l.ittle heavy but .is much 'improved over t~e ~!her plan. Commissioner Golisch felt from a planning standpoinnhe consensus of opinion was that the use was cOII)Pa,tjble and th is was the measure the Commission had to use, he :felt it was acceptable. Mr.,Jack E. Wells, member of the Board of Trustees for the church, stated they were ,ready financially to purchase the land. They had no commi,tments, but if it were made availoble to them they could purchase .it. He stated the Church was preporing in January to build a Fellowship Hall and additional room is needed. He felt that if they were not allowed to avail themselves of more property in some measure thistduld jeopardize ,their own investment. He felt they had made a contribution to the area, and they had a fully accredited parochial day school from 1st to 8th grades and plans were being ma~e to build additional school facilities. Mr. Roger De Young, Los Angeles, felt it was unfair of the church to "sabotage his deal". He felt the letter should not have been allowed to be submitted., Whether this is planning or not he.is bo~nd to a deal. The property ,is under option. The Chairman: stated whether or not from a legal standpoint the letter should have been read he was not prepared to say, but he desired to present all of ,the information possible and give everyone a chance to present any ev idence necessary. Mr. De Young stated he had no offer from the Church. There were meet- ings over a year ago and no agreement had been reached. I , Commissioner Norton stated ,that they had reviewed the entire matter and he had had an opportunity to observe the workings of this particular company and he felt the plan, before the Commission is a better plan and had rei ieved ,the density factor. It is compatible and .it is unfortunate there is controversy between the property owner and .the church. The Qctober 30, 1962 ,Page Eight . . Commission has demonstrated its desire to work with any religious organizatio,n. He felt their request is too late and should have no bear- ing at this pnrticular date. RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DENYING THE REQUEST'FOR MODIFICATION OF THE SIDE YARD SET- BACK REQUIREMENTS AND ACCESSORY BUILDING REQUIREMENTS APPLICABLE TO REAL PROPERTY LOCATED AT 331 MONTE VISTA ROAD IN SAID CITY." MOTION Moved by Commissioner Ferguson, seconded by Commissioner Norton, and unanimously carried that the reading of the full body be waived. AYES: Commissioners Ferguson, Forman, Golisch, Kuyper, Parker and Norton NOES: None ABSENT: Commissioner Michler RESOLUTION NO. 462 The Planning Director presented Resolution, No. 462, entitled: "A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMEND- ING THE DENIAL OF A ZONE VARIANCE TO ALLOW A SECOND SINGLE FAMILY DWELLING ON THE LOT AT 315 LE ROY AVENUE IN SAID CITY". MOTION Moved by Commissioner Golisch, seconded by Commissioner Parker and unanimously carried that the reading of the full body be waived. REPORTS The Planning Director statec:l that a draft of the proposed standards for nursery schools had been forwarded to each Commissioner with a re- quest for comments on the study from the Comm ission. The draft was reviewed and pertinent information was disC;,lJssed so that the Planning Director cau Id prepare a repart for subm ission at the November 13 meeting. Several matters had been discussed with the State and County officials and a few matters were still being determined. Solid fencing was one consideration. The zoning was also considered. Meetings were announced as fallows: West San Gabriel Valley Planning Congress - Woody and Eddy's Friday, .November 9, 1,962, at noon Downtown Area - November 6, 1962 at 10 A. M. Conference Room City Hall The first meeting of the Planning. Commission in December the con- sultants wi II present detailed report of the Downtown studies as of that time. Time will be reserved on the agenda for this matter. Southern: California Planning Congress on Thursday November 8, Country Club in Camarillo, with the subject being: "Better Builders are Planners". TECHNICAL COMMITTEE (R-3) The Chairman. stated that the City Council had appointed a technical group to study construction of apartment buildings in the City of Arcadia. He advised that Kermit Ferguson had been appointed Chair- man .of the group and asked for a report at th is time. Mr.. Ferguson ,stated that one meeting had been held wherein procedures had been, discussed and an organization. set up. Their study was to be made in connection with the type of construction, so that any future buildings constructed will have more quality. The Commission was of the opinion that inasmuch os this study is under way and the Zoning Committee ,is studying the upgrading af the R-3 areas, that it would be in order to hove the Planning Director check with the City Attorney as to the legality of imposing a "freeze" on ,R-3 development until such time as the two committees hove made a October 30, 1962 Page Ten . , . . . study and prepared recommendations.
