NEW MEMBER ROLL CALL CONTINUED PUBLIC HEARING MODIFICATION APPEAL M-63-11 ',~-_/ MINUTES PLANNING COMMISSION, ARCADIA, CALIFORNIA REGULAR MEETING April 9, 1963 The Planning Commission of the City of Arcadia, California, met in regulor session on April 9, 1963, at 8:00 P. M. in the Council Chamber of the City Hall, with Vice Chairman Ferguson presiding. Commissioner Golisch led in the pledge of allegiance. Vice Chairman Ferguson introduced Mr. Carl F. Hanson, the newly appointed Commissioner. PRESENT: Commissioners Ferguson, Golisch, Hanson and Kuyper ABSENT: Commissioners Norton, Parker and Forman OTHERS PRESENT: City Councilman Jess Balser City Attorney Jomes A. Nicklin Plonning Director Will iam Phelps Planning Technician Ernest Mayer, Jr. This motter was continued from the March 26, 1963 meeting for an opinion from the City Monager as to policy with reference to the widening of Sunset Boulevard. The Planning Director stated that the matter before the Commission was whether or not the Commission would sustain the Modification Committee decision fora 25 foot sideyard, or approve the request of the applicant for a ten foot sideyard. The proposed new building is to face on Fairview Avenue with the sideyard on Sunset Boulevard. This is the same setback which the two buildings on the southeast and southwest corner of Huntington Drive and Sunset Boulevard have at the present time. There are other buildings along the street with ten foot setbacks. At the last meeting there were two reports on this matter, one from the Planning Department and the other from the Public Works Department. A copy of the Manager's report had been forwarded to each Commissioner and the conclusion of the report is as follows: "It is our opinion that we should not develop a high level of traffic on Sunset Boulevard between Huntington Drive and Duarte Road which we believe will be injurious to adjacent residential properties. Should the extent of the traffic flow increase to such extent that additional traffic lanes ore needed this can be accomplished by providing four troffic lanes within the existing right of way and eliminating parking. It is, therefore, recommended that the appeal from the Modification Committee decision in Case No. M-63-11 be ,g ranted. " April 9, 1963 Page One , MOTION (Hearing Closed) MOTION , ~ ~ It wos questioned as to whether or not IS feet might be a better pattern if the street were widened, but inasmuch as the other buildings now have ten feet it would not seem appropriate to change this particular setback just for this one building. If at some future time the change of setback is desired, it would have to be based on more facts than are available at this particular time. Whether or not one additional opartment constructed with this setback would moterially affect on improvement program is questionable. It would not be desirable to determine the setback on the entire street at this time, as this will need to be token up in the future ond perhaps publ ic hearings held. This property is all in Zone R-3. The precedence has already been establ ished with the other three on the street. The roadwoy width is 40 ft. with ten foot parkwoy on each side and this then would be on additional ten foot setback. This area at the present times does not look like an apartment district, and consideration must be given to the time when it will develop with the proper zoning on the property rather than with single-family residences. Vice Chairman Ferguson announced that this wos a continued public hearing. If any in the oudience desired to be heord they may be at this time. Freemon Campbell, Designer, 640 Arcodio Avenue, stated he was concerned with this property as he had already designed the building. There was one fact not bro41ht out - there is a duplex to the east with a ten foot sideyard, The existing City Ordinance does read now that the side street :s"e'tback is ten feet, with the narrowest portion of the lot being the front of the property. In this cose the front would be on Fairview Avenue. OPPONENTS: No one desired to be heard. Moved by Commissioner Golisch, seconded by Commissioner Kuyper and unanimously carried that the public heoring be closed. The City Attorney stated it would take four votes to carry the motion and asked if the new member had had an opportunity to review the proceedings. Mr. Hanson stated he had reviewed the files and was inclined to feel that IS feet might be more desirable. The City Attorney advised that were it not for the special setback on this street the matter would not be before the Commission; it would take the ten foot sideyord; it is only because of this special setback that the pro ceedings have been necessary. Moved by Commissioner Golisch, seconded by Commissioner Kuyper, that the decision of the Modification Committee to allow a 25 foot side setback instead of the requested ten feet be reversed and that the request of the appl icants for a ten foot setback be granted. ROLL CALL: I AYES: Comm issioners Gol isch, Hanson, Kuyper and Ferguson NOES: None ABSENT: Commissioners Norton, Parker and Forman, LOT SPLIT L -63-11 The Planning Commission considered Lot Split opplication No. L-63-11, 1501 South Sixth Avenue of Otis H. Hudson. This application seeks to create three lots an a privately developed street terminating in a cul-de-sac. The Planning Department recommends denial on the basis that the Code requires 75 foot frontage on a public street. If the Planning Commission approves thIs lot split the following conditions should be required: I. File a final map 2. Provide a sewer laterol to each porcel 3. Pay a recreation fee of $50.00 4. Water services provided to conform to the Uniform Plumbing Code 5. Remove storage sheds, building materials ond trucks fram the rear of the yard. MOTION Moved by Commissioner Kuyper, seconded by Commissioner Gol isch, that lat spl it No. L-63-11 be denied. The matter' not receiving a majority vote will be carried over to the next regular meeting of the Commission. It was felt that if this property were to be developed it would have to be someth ing other than the standard procedure, but the only other way would be to split the lot ending up with two 56 foot lots. This would be unfeasible on account of the existing improvements. The Planning Director stated that even though some of these large lots appeared to be landlocked, the value of land wos increosing and it moy be that in a short time the value would be great enough to remove the present structures on the surrounding lots and perhaps cul-de-soc from Camino Real, or from Pamela Road. The Planning Department is confranted with many people who desire to know what can be done with their "problem lots". If this type of development is permitted just one time then this same kind of relief would have to be offered to others with similar lots in size and shape in other areas of the City. April 9, 1963 Page Three LOT SPLIT NO. L-63-12 MOTION PLAN APPROVAL Restaurant Live Oak Ave. Mr. AI Coke, 1050 Singingwood Drive, stated he was interested in the property. He felt some voriance in the policies would have to be made as there was no other way to develop a lat such as this. The Planning Director has worked with him and feils there is no solution. , The Planning Cammission considered Lot Split No. L:-:63-12, 1808 South Sixth Avenue - J. W. Davis. This property is proposed to be divided into two parcels - one YJ foot and the other with the existing improvements would be 92 feet in width. Ilie Planning Department recommendation is "for approvol, subject to the following conditions: I. File a final map 2. Provide a sewer lateral to the newly created lot 3. Pay a recreation fee of $25.00 4. Water services to comply with the Uniform Plumbing Cade be provided 5. Shed to the rear of the existing dwelling be demolished prior to final approval. Moved by Commissioner Golisch, seconded by Commissioner Honson, and unanimously carried thot Cot Split No. L-63-12 be approved, subject to the canditions outlined in the Staff report. Plans were presented ta the Comm ission for approval on Lats 32, and 33 Tract No. 13217, on the north side af Live Oak Avenue. The approval is required under the "D" overlay. STAFF REPORT: Rabert Williams, owner of Lots 32 and 33, located on the northwest corner of Live Oak and Fourth Avenues proposes to canstruct 0 YJOO sq. ft. restaurant with seating capacity of 191 persons. The submitted plans and elevotions appear t,o conform to these restrictions as imposed on the development of this property by City Council Resolution No. 3076. The Plonning Department recommends that the preliminary plans be approved, subject to the fallowing conditions: Thot prior ta the issuance of a building permit' for any construction an this site, complete working drawings and specifications be'submitted and be approved by the Planning Department and the Department of 8ui Iding ond Sofety . The proposed plot plan andcEvelopment were presented. The building fronts on Live Oak Avenue with the only c4,rb:.cut to the parking lot off Fourth Avenue. The site is landscaped on the north and east sides with porking on the north and west of the proposed building. Since the adoption of the original resolution, certain changes have been made in the thinking of curb cuts on Live Oak Avenue. The alley to the rear;has been dedicated and must be developed prior to or concurrently with the development of the praject. It was suggested thalo restricted porking could be requested of the City on , Fourth Avenue to protect the residential properties, It is estimated by the owner that there wo'uld be one parking space for each threel.seats provided, which would be adeqL)ate. Moved by Commissioner Golisch, seconded by Commissioner Kuyper~ ond unanimously carried, that the plans and elevations of the restauront to be constructed on the northwest corner of Fourth Avenue and Live Oak Avenue be approved, subject to the conditions as outlined in the Staff Report, Ib,e!,Planning Director stated that copies of these reports had been forwarded to the Commission. The first report advised the Commission of the recent action of the City Council and the adoption of 0 moratorium on construction in Zone R-3. There are now only two ways in which aportment buildings con be constructed in the City until determination has been made by the Council as to oppropriate measures to be adopted, one of these is that the buildings must comply with the conditions of the resolution adopted by the Planning Commission; and the other is that those pions which were in process at the time of the "l',?ratorium may be completed. The City Council also approved the subdivision on Tenth Avenue. The City Council also had the first reading of the Ordinance chonging the fee schedule for the fil ing of var.ious appl ications in the Planning Department. The appoi~tment of the new member to the Commission was also mode at this meeting. The Planning Director presented a work program, :pending within the Deportment. This included work which hod been ossigned to the Department through the various requests; i.e., the City Council, City Manoger, Planning Commission ond the Porks ond Recreation Commission. Off Street parking was an item thot had been discussed. rhe,Director suggested that copies again would be forwarded to the Commission and further discussion and action token. A copy of the work program has olso been forwarded to the City Manager ond "is to be considered in the new budget. Commissioner Ferguson on, behalf of the Commission requested the City Attorney to prepare a Resolution to be directed to Commissioner Michler expressing the thanks and oppreciation to him for his long and valued services o~' 0 Commissioner. Councilman Bolser stated in the approval of the subdivision on Tenth Avenue that on easement be placed on each end of the subdivision to ollow those residents with horses to el)ter the right of way they ore now using. The Council through this action did show cooperation with the Planning Commission in its action. On behalf of the,Council he welcomes Mr. Hanson on the Commission The meeting adjourned at 9:50 P.
