MINUTES PLANNING COMMISSION, ARCADIA, CALIFORNIA REGULAR MEETING September 24, 1963 Chairman Ferguson presiding Pledge of Allegiance 8:00 P.M. PUBLIC HEARING Central Area Zon i ng The public hearing on this matter was continued from the previous meeting. George Forman, Chairman of the Committee studying the proposed zoning presented progress report No. I y as follows: II. There are certain portions of the plan which are appropriotely zoned and could be deleted from the moratorium area. Therefore, the Committee recommends that the Commission advise the City Council to release these areas from the moratorium. The zoning classifications which are appl icable to the orea ought I to be supplemented with the "0" zone to provide architectural control of new development in the area. 13. The term'reseorch and development" used in the plan hos to zome extent been misinterpreted by numerous people and os a result has caused some confusion. The Committee feels that from a zoning standpoint this area could be more oppropriately called "A Plonned Industrial or Light Industrial District". As such industrial uses like those listed in Zone C-M (eKcluding some of the more retail types not reolly compatible with an industrial area like the uses permitted in ZonesCO-C-l, C-2 and C-3 which are primarily retail) and M-l would be permitted subject to regulations more suited to the area. For example in Zone M-l September 24, 1963 : Page One 4. (~~ building heights may be os high as 45 feet or four stories and front, side ond rear yords are not required. The Committee would propose regulations for th is district more I ike those suggested , by Wilsey, Hom and Blair in terms of yard requirements, heigh t limitations, landscaping and site plan approval. These regulations would vary depending on the location of the property. Such variations could be handled in the "0" overlay regulations. 14. The Technical Office Areas designated on the plan were originolly intended to be shown as additional research ond development areas. However, becouse of the locotion of these areas next to R-l property, fronting on Santa Anita Avenue, adjacent to the Freeway, and straddling Colorado Avenue the Consultants wanted it clearly understood thot there is a difference in the two areas. 1h is difference due to locotion would logically require stricter, more precise, regulations than would normally be required. The Committee suggests thot the Technical Office Areas when classified be regulated with rules differing from those of the P.1. 6; Such differences could be handled as previously suggested in the "0" overlay regulations. Is. The areas shown on the pion os offices should be so classified as Zone C-O.eo'r ,by thelcteation!df,,,: nihvt'zche perhaps,!;all ;"Professional Offi,ce, Oistrict".,or CO-I. 16. The areas designated as the convenience center could be placed in Zone: C-l if the regulations of that district were changed to permit building of on area greater than 5000 sq. ft. and elimination of the provision which permits portiol residential use of commercial buildings. ; Mr. Kermit Hartzler, President of the Arcadia Business Men's Association discussed p,oints in the above report. His Association would recommend that the areas as indicated in the report be released from the moratorium. Basil C. Johnson, 20 E. Pamela Rood, protested more apartments being built in Arcadia. He felt this was a residentiol city cnd should remain such with single-family dwellings. MOTION Moved by Commissioner Kuyper, seconded by Commissioner Forman, and unanimously carried that the property shown on the map be recommended for removal from the moratorium areo. MOTION Moved by Comm issioner Formon, seconded by Comm issioner Kuyper, and unanimously carried that the public hearing on the zones appropriate for the Central Area be continued until October 8, 1963. PUBLIC HEARING Height Um it Reduction Public hearing on Resolution No. 496 to consider reduction of existing height regulations in commerciol and manufacturing zones from four stories to two stories was held. Foothill Blvd. Mr. Ralph Stogsdill, 547 Workman Ave (property on Baldwin and Las Tunas) Helen Rosnick, property on First Avenue MOTION Moved by Commissioner Golisch, seconded by Commissioner Hanson, and unanimously corried that the Commission recommend to the City Council that the existing height in all commercial and monufacturing zones be reduced from four stories to two stories. Copies of the Resolution No. 49B will be forworded to the Commission for consideration at the next meeting. FINAL MAP TRACT NO. 28312 The Plonning Commission considered the final map of Tract No. 28312, located south of Longden Avenue, south of EI Sereno Drive. This matter was continued for the purpose of having the developers straighten out the dispute over ownersh ip. The staff report was presented as follows: The final map of the above referenced troct has been reviewed by the Plonning Department and found in compliance with the approved tentative mop. The Planning Department, therefore recommends thot it be approved, subject to the following conditions: I. Install all standard street improvements required by the subdivision ordinance. Improvements, grades and droinoge shall be to the sotisFoction of the Director of Public Works. 2. Provide all easements required For fear line utilities. Tl1ese eosements shall be delineated on a copy of the final map and be submitted to t1md approved by the utility companies and the Department of Public Works prior to recordation. 3. Remove 011 trees and structures from the street right-oF-way. 4. Remove all structures and buildings within or across the tract boundary. These removals or relocations shall comply to 011 City Ordinances, Codes and regulations, and be done to the,satisfoction of the Department of Publ ic Works. 5. On the mop there ore structures some of wh i ch ore to be destroyed. On the property known os 612 W. Longd~n Avenue ore other structures, one of which is 0 house to be relocated prior to the recordation of the mop to 0 location on what will be known os Lot I. One of the conditions of approval coIls for the submission of house plans showing the location of houses on the lots and these to be approved by the Commission. The reason for this one particular condition wos that there was some concern about the location af the houses which hove the Longden Avenue frontage. The Stoff recommends that the final mop be approved, because it is in substantial compliance with the approved tentative map; however, as already mentioned there ore some conditions that were a part of the approved tentative mop ond olso 0 part of the final map - one of these conditions is that all of the structures shall be removed wUhin or across the troct boundaries ond that these removals or relocations sholl comply with all ordinances, codes ond regulotions and be done to the sotisfaction of the Department of Publ ic Works. The Code provides that a building may be re/ocoted on the same lot but cannot move the building from one lot to another. In this particular case the structures to be moved sholl be relocated prior to the recording of the mop in order to be in compliance with the Code. The same would apply to the structures to be destroyed. These houses should be cleored prior to the recordation of the mop. Mr. Henry W. Shatford, representing the present owner of the property, slated that his client hod no objections to which direction the house is fronting whether on Longden or on the new street. He felt it would look better fronting on the new street. The house location plan No.2 was approved with the houses fronting on Longden Avenue. The City Attorney advised that the following should be incorporated in the motion:' "The subdivider be required to execute a covenant in a form approved by the City Attorney agreeing that no structure shall be erected within 25 ft. of the Longden Avenue as to Lots I ond 6 and that there shall be no curb open ings on the Longden frontage of Lots I and 6. MOTION Moved by Commissioner Forman, seconded by Commissioner Kuyper ond unanimously corried thot finol map of Tract No. 28312 be recommended for approval, subject to the conditions as outlined in the staff report and to the further condition as stated by the City Attorney above set forth. TRACT NO. 28438 Finol Map The Planning Commission considered final map of Tract No. 28438, located on Longden Avenue between Holly and Baldwin Avenues. The Staff report wos presented. A copy of said report is on file with the Plann ing Department. MOTION Moved by Commissioner Formon, seconded by Commissioner Honson, and unanimously carried, that the final map of Tract No. 28438 be..recommended for approval, subject to the conditions as outlined in the Staff report. TRACT NO. 27647 Final Map The Planning Commission considered final mop of Tract No. 27647 on August 13, 1963. The applicant now .requests th...t Condition of Approval No.6, which would dedicate Lot No.6 to the City in fee be amended to allow a trust to be placed on Lot 6j that such trust to be opprov~d by the Planning Commission prior to the submission of the final mop to the City Council for approval. September 24, 1963 Page Four f . The Planning Department recommends that Condition No.6 be amended to ollow a trust to be ploced on this property. Mr. Henry W. Shatford, representing the present developer, 'spoke for his cl ient, to the effect thot if ony ogreement had been mode between the property owner and the previous developer, it was not in writing and could not be considered os 0 legal' agreement. Mr. Meeker, of the Meeker Land Co., also spoke requesting such a trust be considered. Commissioner Hanson stated thot in view of the facts that a verbal agreement had been reached between the property owner and the subdivider at the time of the Tentative approval that the agreement should be recognized and honored by the Commission MOTION Moved by Commissioner Kuyper, seconded by Commissioner Golisch, that the Commission omend its recommendotions on Troct No. 27647 of August 13, 1963 as to Item No. 6to ollow a publ ic hearing to be held on a trust to be placed against Lot No.6; and that October 29, 1963 - an adjourned meeting - be fixed as the time for hearing on soid trust. TRACT NO. 28580 Final Map The Plonning Commission considered final map of Tract No. 28580, located on Sixth Avenue, north of Leda Lane. The Stoff report wos presented. A copy of soid report is on file with the Planning Deportment. The approved tentative map as considered by the Planning Commission had been revised by the City Council at the request of the Subdivider which had irel ieved the setback on Sixth Avenue from 25 feet to 15 feet. MOTION Moved by Commissioner Kuyper, seconded by Commissioner Forman, that the final mop of Troct No. 28580 be recommended for approval, subject to the conditions of approvol as set out in the Staff report; and with the further condition that the easements shall be delineated on a copy of the final map and be submitted to and approved by the utility companies and the Department of Publ ic Works. The Commission instructed the Staff to inform them in the future in Staff reports of any oction taken by the Council which differs from the action taken by them. The staff report was presented. A copy is on file with the Planning Department. MOTION Moved by Commissioner Golisch, seconded by Commissioner Hanson, and unanimously carried; that Lot Split No. L-63-26 for property at 902 South Second Avenue be opproved, subject to the conditions as outlined in the Stoff Report. LOT SPLIT No. L-63-27 The Planning Commission considered the application of D. H. Crane,6cr property located at 234 East Sycomore Avenue. The staff report wos presented. A copy is on file with the Planning Deportment. The Commission stated that this was a flag lot which does not conform to the policy of the Commission and the criterio for which other lots have been divided; ond while other lots in the area were so developed in the past, the best interests of planning of the city would be served if this were denied. MOTION Moved by Commissioner Golisch, seconded by Commissioner Forman that Lot Spl it No. L-63-27 be denied. ROLL CALL: AYES: Commissioners Forman, Golisch, Kuyper, Parker and Ferguson NOES: Commissioner Honson ABSENT: Commissioner Norton EXTENSION OF TIME Modification M-63-12 A communication was received from E. B. Christiano o')d Sons requesting on extension of time of a modification for front yard setback on property located on the northwest corner of Santa Anita Terrace and Santa Anita Avenue. This property originally had a 50 foot setback on Santa Anita Avenue. The modificotion was for a 35 foot front setback. The applicant has been unoble to sell the lots or obtain 0 customer for a house on these lots; thereby requiring additional time in order to obtain 0 permit. He requests this extension so thot he may find a suitable buyer for a proposed house on either of these lots. MOTION Moved by Commissioner Golisch, seconded by Commissioner Porker, ond unanimously carried that Modification M-63-12 decision for a 35 foot front setback on Santa Anita Avenue at Santa Anito Terrace (1511 South Santa Anita Avenue) be extended six months from October 9, 1963; with the further provision that the sign now located on the property be mode to conform to the building code. Considerable difficulty had arisen since the approval of the tentative map so that it was impossible to pursue th is tract until such timeos the owner of the property abutting the present street has reoched an agreement to permit; the street to be extended. MOTION Moved by Commissioner Hanson; seconded by Commissioner Parker, and carried that an extension of time'of six months be allowed on Tract No. 22838 frCDm the expiration date of November 7, 1963. Commissioner Kuyper voting "No" to the extension. C-2 PROPERTY Live Oak and Lenore Avenues A communication was received from the lessees of property lacoted on Live Oak Avenue and Lenore requesting that one of the provisions of the Zone Voriance be relieved in order to obtain two odditional porking spoces in front of the commercial buildings. Certain landscaped areas were to be provided. The lessees stote if this were done they would be deprived of two much needed parking spaced. The Commission requested the Planning Departmert to furnish them with o sketch of the area prior to the next regular meeting so thot a study could be made. The matter was taken ;under advisement until October 8, 1963 SUB-DIVISION COMMITTEE The Planning Director stated that with the number of cul-de-sacs being filed it may be well to appoint'a Subdivision Committee to review the cul-de-sac policy to determine if any changes need be mode. AUDIENCE PARTlCIPA TlON Mr. Bosil Johnson complimented the Commission on the type of development being proposed and the manner in which the Commission functions. He very much approved of the cul-de-sac streets with the fine residences locoted on them. He felt the side setback on an orterial street should be considered so that it lookEid pleasing. He suggested that a beautification campaign be instituted in the Commercial areas to overcome some of the problems. ADJOURNMENT The meeting adjourned at 11 :25 P.
