HomeMy WebLinkAboutItem 13a - Regular Meeting Minutes of June 7, 2022, and Special Meeting Minutes of June 14, 2022 1 06-07-2022 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, JUNE 7, 2022 CALL TO ORDER – Mayor Beck called the Closed Session to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Cheng, Verlato, Tay, and Chandler ABSENT: None PUBLIC COMMENTS – There were no public comments. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding potential litigation – one (1) case. No reportable action was taken on the Closed Session Item. The Closed Session ended at 6:20 p.m. Regular Meeting City Council Chambers, 7:00 p.m. 1. CALL TO ORDER – Mayor Beck called the Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Mohammad Abdul Ahad, Mosque of San Gabriel 3. PLEDGE OF ALLEGIANCE – Boy Scout Troop 111 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Danielson, Tay, Verlato, Cheng, and Beck ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that prior to the Regular Meeting the City Council convened in a Closed Session to consider the one item on the posted agenda and no reportable action was taken. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted a correction to page 11 of 16 of the Staff Report for Public Hearing Item 9.a; he advised the City Council that the budget was accurate; however, there was a number quoted incorrectly on the Staff Report and the City Council was provided a revised version with the correct number highlighted. 2 06-07-2022 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Cheng and seconded by Council Member Tay to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Presentation of adoptable dog by the Pasadena Humane Society. b. Presentation of Mayor’s Certificates to the Apache Baseball team and the Apache Softball team for winning the 2022 Pacific League Championship. c. Presentation of Mayor's Certificate to Joshua Khaw of Eagle Scout Troop 111. d. Presentation of Mayor’s Certificate to Praneeth Bandi and Pranav Aratikatla of Eagle Scout Troop 103. e. Presentation to Donna Choi of the Downtown Arcadia Improvement Association for being chosen as "2022 Congressional Woman of the Year for Arcadia" by Congresswoman Judy Chu. f. Presentation of Mayor’s Certificate to the Assistance League of Arcadia for their donation of local restaurant gift cards for homeless program. 9. PUBLIC HEARING a. Resolutions relating to the adoption of the Fiscal Year 2022-23 Operating Budget and the Fiscal Years 2022-23 through 2026-27 Capital Improvement and Equipment Plan. Resolution No. 7443 adopting a budget for Fiscal Year 2022-23 and appropriating the amounts specified therein as expenditures from the funds. Recommended Action: Adopt Resolution No. 7444 adopting a Capital Improvement and Equipment Plan for Fiscal Years 2022-23 through 2026-27. Recommended Action: Adopt City Manager Lazzaretto presented the PowerPoint presentation. Mayor Beck opened the Public Hearing. No one appeared. A motion to close the public hearing was made by Council Member Verlato and seconded by Mayor Pro Tem Cheng; seeing no further objection, Mayor Beck declared the Public Hearing closed. After discussion, the City Council directed staff to bring back a report at a future City Council meeting outlining the three phases that were recommended by Council Member Verlato in order to improve South Baldwin Ave. Phase 1 would be to remove and replace all Ficus trees and fix 3 06-07-2022 up the sidewalks; Phase 2 would add lights, new benches, and nicer trashcans; and Phase 3 would add bulb outs to create more space for trees, plants, flowers, etc like was done on Huntington Drive through the Downtown. There is no interest in changing the direction of parking. A motion was made by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to adopt Resolution No. 7443 adopting a budge tor Fiscal Year 2022-23 and appropriating the amounts specified therein as expenditures for various funds. AYES: Verlato, Cheng, Danielson, Tay, and Beck NOES: None ABSENT: None A motion was made by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to adopt Resolution No. 7444 adopting a Capital Improvement and Equipment Plan for Fiscal Years 2022-23 through 2026-27. AYES: Verlato, Cheng, Danielson, Tay, and Beck NOES: None ABSENT: None c. Resolution No. 7432 approving an Eighth Amendment to Agreement and Lease by and between the City of Arcadia and Methodist Hospital of Southern California. Recommended Action: Adopt Prior to Public Comment, Mayor Beck asked Cliff Daniels from Methodist Hospital to discuss Consent Calendar Item 12.c., the Eighth Amendment to Agreement and Lease by and between the City of Arcadia and Methodist Hospital of Southern California, and a discussion ensued. Steve Song, a member of the public, appeared and asked how to obtain a copy of the agreement/lease with Methodist Hospital; and recommended that the City Council propose a standard of scores for the Hospital when considering the agreement. After discussion it was moved by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to adopt Resolution No. 7432, a Resolution of the City Council of the City of Arcadia California approving an Eighth Amendment to Agreement and Lease by and between the City of Arcadia and Methodist Hospital of Southern California as just revised by the following language suggested by the City Manager: The start of Paragraph 9 (Insurance) would read, “Tenant, at its sole expense, shall obtain and keep in force during the term of the Lease, general liability insurance with limits of not less than Twenty Million Dollars ($20,000,000) for injury to or death of any number of persons in one occurrence, Thirty Million Dollars ($30,000,000) in the aggregate, and not less than One Million Dollars ($1,000,000) for damage to property, insuring against any and all liability of City...” and the sentence would continue unchanged from that point onward. The final sentence in Paragraph 9 would read in its entirety, “The limits and coverage of all such insurance shall be adjusted by agreement of City and Tenant prior to the renewal date of any current policies and then annually thereafter during the term in conformity with the then prevailing custom of insuring property similar to the Premises.” 4 06-07-2022 AYES: Verlato, Cheng, Danielson, Tay, and Beck NOES: None ABSENT: None 10. PUBLIC COMMENTS – There were no Public Comments 11. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). City Clerk Glasco announced that he attended the 24th Annual Memorial Day Tribute to Veterans and Military Families on May 28; he also attended a remembrance ceremony held at 1 p.m. at the Arcadia Vietnam War Monument; and he announced that Mayor Pro Tem Cheng presented a Mayor Commendation Certificate to Life Scout Chris Tran, of Arcadia Troop 104, who made the beautification of the monument his Eagle Scout project. Council Member Tay announced that he attended Dim Sum with Detectives on May 20, held by the Arcadia Police Foundation and they raised about $40,000; and he wished all fathers a Happy Father’s Day on June 19. Council Member Danielson thanked City Staff for all their efforts in putting the budget together; he announced that he surprised Ava Medina at her school and gave her a certificate and thanked her for sharing the story of her brother who was an organ donor and asked to residents to become organ donors; he also thanked Donna Choi and shared that she was recognized as the Congressional Woman of the Year by Congresswoman Judy Chu; he announced that there will be a Patriotic Festival on First Avenue on July 2; and he shared that he had the privilege to be part of the 24th Annual Memorial Day Tribute to Veterans and Military Families by Kathryn Barger’s Office on May 28. Mayor Pro Tem Cheng announced that he attended the Baldwin Stocker PTA recognition on May 25; he attended the 24th Annual Memorial Day Tribute to Veterans and Military Families on May 28; he also attended the Memorial Day Remembrance Ceremony held at Live Oak Memorial Park on May 30 and shared photos for both events; he spoke about Anna and Mathew Bond who adopted two young children with special needs and reminded residents that there is a purpose for all life and shared photos of the family; he attended the Los Angeles County Filipino Employees Association event on June 4 honoring the 134th year of the Filipino Independence; he shared that the Charles Huang Foundation will be giving Methodist Hospital $7.5 million at the end of the month; he reminded residents that they may log on to the City’s website if they are interested in issues that need to go to the people regarding the City Charter; he shared that the Assistance League in Arcadia is looking for summer volunteers as well as the Arcadia Recreation Department; he announced that the 626 Night Market will be back July 1-3, 8-10, August 6-8 and September 3-5; and further announced that the State Fair will be back in Arcadia between July 21 and August 20. Council Member Verlato thanked City Staff for their hard work in preparing the budget; she gave a special thank you to Arcadia Police Foundation and Lily Lu for her generous donation at the Dim Sum with Detectives event; she attended the 24th Annual Memorial Day Tribute to Veterans and Military Families on May 28, and thanked City Clerk Glasco for his tribute to the 14 Arcadias who did not make it back from Vietnam; she further thanked Council Members Danielson and Tay for being part of the Arcadia Rotary and their efforts and time in setting up the Field of Honor flags at the Arcadia County Park; she congratulated Donna Choi who received the Congressional Woman of the Year award from Congresswoman Judy Chu’s Office, and thanked her for all she does for the City of Arcadia as a non-resident; she announced that she attended the Arcadia 5 06-07-2022 Chamber Mixer at the Masonic Lodge; she also attended the annual Highland HOA meeting; she attended the Arcadia High School graduation ceremony and congratulated her son on his graduation; she reminded residents that Concerts in the Park will be back on June 23; and she announced that the Patriotic Festival will be held on July 2, and shared that there will be a beer and wine garden and thanked the Arcadia Performing Arts Foundation as they will be providing entertainment. Mayor Beck shared letters he received from two eight year old residents; he thanked the Arcadia Historical Society for their donation in memory of Carol Libby; he shared photos from the Duarte Kid-Fit Family 5K that he attended with Council Member Danielson; he attended the Baldwin Stocker PTA Recognition and provided Mayor Certificates to those PTA members that were recognized; and he reminded residents that Coffee with the Mayor will be held on June 21, at 9 a.m. at the Community Center. 12. CONSENT CALENDAR a. Regular Meeting Minutes of May 17, 2022. Recommended Action: Approve b. Resolution No. 7431 setting service rates for the collection of residential refuse and recyclables pursuant to Section 5120.7 of the Arcadia Municipal Code for Fiscal Year 2022-23. Recommended Action: Adopt d. Resolutions initiating proceedings for the annual levy and collection of assessments, approving the Preliminary Engineer’s Report, declaring intention to levy and collect assessments for Fiscal Year 2022-23, and appointing a time and place for a public hearing for the Arcadia Citywide Lighting District No. 1. Resolution No. 7437 initiating proceedings for the annual levy and collection of assessments for the Arcadia Citywide Lighting District No. 1 pursuant to the provisions of Part 2 of Division 15 of the California Streets and Highways Code and ordering the preparation of the Engineer’s Report. Recommended Action: Adopt Resolution No. 7438 approving the preliminary Engineer’s Report of Willdan Financial Services for the Arcadia Citywide Lighting District No. 1. Recommended Action: Adopt Resolution No. 7439 declaring its intention to levy and collect assessments within the Arcadia Citywide Lighting District No. 1 for Fiscal Year 2022-23 and appointing a time and place for a public hearing. Recommended Action: Adopt e. Resolution No. 7447 authorizing designated staff to file with the California Office of Emergency Services requests for financial assistance under the Natural Disaster Assistance Act and similar statutes. Recommended Action: Adopt 6 06-07-2022 f. Resolution No. 7448 amending Resolution No. 7380 establishing compensation and related benefits for employees represented by the Arcadia City Employees Association (Public Works Customer Service/Administrative Supervisor). Recommended Action: Adopt g. Resolution No. 7450 establishing an appropriation limit for Fiscal Year 2022-23 pursuant to Article XIII-B of the California Constitution. Recommended Action: Adopt h. Donation in the amount of $2,500 from the Friends of the Arcadia Historical Society to the Arcadia Public Library for the purchase of a Memorial Bench in memory of Carol Libby. Recommended Action: Accept i. Agreement with Beacon Media, Inc. for Legal Advertising Services in an amount not to exceed $24,000. Recommended Action: Approve j. Supplemental Provisions Agreement with Southern California Edison for a Remote Grid Standalone Power System. Recommended Action: Approve k. Extension to the contract with General Pump Company, Inc. for unscheduled maintenance and emergency repair of City wells and pumps in the amount of $137,550. Recommended Action: Approve l. Purchase Order with TruePoint Solutions for annual hosting and support services for the TrueBill utility billing software for Fiscal Year 2022-23 in the amount of $54,000. Recommended Action: Approve m. Purchase Order with Clean Energy for the purchase of Compressed Natural Gas (“CNG”) fuel for the City’s fleet in an amount not to exceed $145,400. Recommended Action: Approve n. Extension to the Purchase Order with S & J Supply Company Inc. for the purchase of water pipeline fittings, brass valves, and other related accessories for the City’s Water Distribution System in the amount of $121,000. Recommended Action: Approve o. Purchase Order with McCain, Inc., for the purchase of five new Traffic Signal Cabinets for the intersections of Baldwin Avenue at Camino Real Avenue, Naomi Avenue, and Fairview Avenue, Huntington Drive at Colorado Place and First Avenue at Wheeler Avenue in the amount of $95,575.87. CITY MANAGER a. Resolution No. 7445 condemning acts of hate and violence against Asian American and Pacific Islander Communities. Recommended Action: Adopt City Manager Lazzaretto presented the Staff Report. A motion was made by Mayor Pro Tem Cheng, seconded by Council Member Tay, and carried on a roll call vote to adopt Resolution No. 7445 condemning acts of hate and violence against Asian and Pacific Islander Communities. ADJOURNMENT The City Council adjourned at 9:59 p.m. to Tuesday, June 21, 2022, at 5:30 p.m. in the City Council Conference Room. Rachelle Arellano Deputy City Clerk ARCADIA CITY COUNCIL SPECIAL MEETING MINUTES TUESDAY, JUNE 14, 2022 CALL TO ORDER – Mayor Beck called the Special Meeting to order at 10:07 a.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Tay, Verlato, Cheng, and Beck ABSENT: Danielson The Council noted that Council Member Danielson had previously recused himself from all discussion on the topic and was not present for this meeting for that reason. PUBLIC COMMENTS – No one appeared. OPEN SESSION a. City Provision of Legal Defense to Council Member Danielson Concerning Quo Warranto Application. Recommended Action: Authorize the City to Defend Council Member Danielson in this Matter City Attorney Deitsch presented the Staff Report and noted for the record that an email was received this morning by the Arcadia Voters Rights Group pertaining to the Application to Sue Council Member Danielson. After City Council discussion, a motion was made by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to authorize the City to defend Council Member Danielson regarding the Quo Warranto Application and retain Special Council Nielsen, Merksamer, Parrinello, Gross, & Leoni LLP. AYES: Verlato, Cheng, and Beck NOES: Tay ABSTAIN: None CLOSED SESSION a. Pursuant to Government Code Section 54956.9 (d)(1) to confer with legal counsel regarding the matter of the People of the State of California v. Michael Danielson, Office of the Attorney General for the State of California. The City Council did not convene in Closed Session.
