TH6 CKTY PLANNi~G co~rr~ISSION OF TEE CITY OF ~lCADIA DOES RESOL-/E AS FOLLOWS: WHbREAS, on the 5th day of July, 1949,there was filed with this Commission the petition of Ross A. Himes and June Nancy Himes requesting the rezoning of the following described real property in the City of Arcadia, towit: The South 117.5 feet of the North 295 feet of Lot 66, Santa Anita Colony, ag shown on map recorded in Book 42, . page 87, Miscellaneous Records of Los Angeles County, to be changed from Zone R-l (Second one-family 2Pne) to Zone R-3 (Multiple-family zone). Lot 66, except the North 295 feet; and that portion of Lot 69 lying Northerly of Las Tunas Drive, both in afore- said Santa Anita Colony, to be changed from Zone R-3 (Multiple-family zone) to Zone C-2 (General Commercial Zone). All of the aforesaid property is located near tbe northwest corner of Santa Anita Avenue and Las Tunas Drive. WHEREAS, after due notice as required by the provisions of Ordinance No. 760 of the City of Arcadia, a public bearins was duly held on the matter before this Commission on the 4th day of August,1949, and all interested parties were given a full opportunity to be heard, . and WHEREAS, in the opinion of this Oommission the proposed rezoning ~f the aforesaid property would be detrimental to the public welfare, and inllurious to surrounding property and wO,ll d adversely af'fect the comprehensive general plan of this City; NOW, T~REFORE, BE IT RESOLVED that this Commission recommend to the City Council of the City of Arcadia that the aforesaid petition be disapproved and denied for the following reasons: 1. The request of petitioners is contrary to the spirit and -1- 4~ . . . " . 1. The request of petitioner is contrary to the spirit and intent of the Master Zoning plan of the City of Arcadia which was adopted and became effective on June 3, 1949, ai'ter a series of public hearings and which plan was unanimously approved by the Planning Commission of the City Council; that at the time of said public hearings, due con- sideration was given by this Commission to the extension of business in an Easterly direction upon a nd along Duarte Road from Baldwin Avenue; 2. It is the opinion of the Commission that there have been no changes in circumstances relating to the peti- tioners' property, since this same matter was reviewed during the public hearings prior to the adoption of the Master Zoning Plan, which warrant or justify the re-zoning of subject property at this time. 3. Under the terms of Ordinance No. 760, covering the planning procedure of the City of Arcadia, land use should be re-zoned by the Planning Commission and the City Council only in the event that such re-zoning is required by Ilpublic necessity and convenience and general welfarell. In the opinion of the Commission public necessity and convenience and general welfare do not require or indicate the desirability of the re- zoning requested by the petitioners. The Secretary shall certify to the adoption of this Resolution, and shall forward a copy to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted by the City Planning Commission at a regular meeting held on the 15th day of September, 1949, by the following vote: AYES: NOES: ABSENT: .
