A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, PROPOSING THAT THE OPENn~G OF SEVENTH AVENUE, BETWEEN DUARTE ROAD AND CAMINO REAL, BE DELAYED. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Arcadia has requested that this Commission consider the proposed opening of Seventh Avenue between Duarte Road and Camino Real, and WHEREAS, this Commission has under study a Master Street Layout for the City of Arcadia which, when completed, will furnish the opinion of this Commission as to the best method by which future streets may be opened to correlate with existing streets, and WHEREAS, in the opinion of this Commission, the pro- posed Master Street Layout should not be adopted on a piecemeal basis but should be considered on a basis of the existing and proposed streets in the same general vicinity as well as the City as a whole, NOW, THEREFORE, BE IT RESOLVED that this Commission proposes that pending completion of the study of this Commission of the aforesaid Master street Layout, the City Council delay its decision as to the advis~bi1ity of opening Seventh Avenue as aforesaid. . The Secretary shall certify to the adoption of this Resolution, and shall forward a copy to the City Council of the City of Arcadia. RESOIDTION At a regular meeting of the Aroadia City PlanninB Commission held on the 2nd day of June, 1949, motion was made by Jrr. RESOLUTION OF THE CITY PLANNIim COMMISSION OF THE CITY OF ARCADIA, CONCERNING THE PROPOSED MODIFI- CATION OF THE PROVISIONS OF ORDINANCE NO. 742 OF THE CITY OF ARCADIA. THE PLANNING COMMISSION OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That since Ordinance No. 742 represents an earnest effort by the City of Arcadia to maintain a reasonable minimum standard in the subdivision of land, close adherence to the spirit and intent of the Ordinance should be observed in considering all applications to divide properties. The Commission will continue its efforts to assist in im- . proving the ordinance whenever modification of its provisions may be justified by considerations based upon the interests of the community as a whole. The foregoing Resolution was duly offered and adopted at a regular meeting of the Planning Commission of the City of Arcadia, held on the 5th day of M~. 1949. by the following vote& AYES ~ Mr. Anderson, Ingstad, Pike, Pippin, Shaw and Stoner. The granting of the requested variance for an unlimited period would create a dangerous and ill-advised precedent since there may be other persons in a position similar to that of petitioners who could reasonably demand similar relief by variance for the operation of commercial slaughter houses and business operations of any kind in the various residential districts throughout the City. And Y~EAS, subsequent to the adoption of the afore- said Resolution by this Commission, the City Council referred to this Commission a request in writing of petitioners for a modification of the proposed variance as contained in a letter from petitioners and their attorney, and WHEREAS. the entire proposal of petitioners has been fully reconsidered by this Commission and the proposed modification has been duly considered, a majority of the Commission being sympathetic toward the granting of some form of temporary relief to the petitioners, but in view of the manner in which this matter was presented at the meeting of the City Council, held on September 6, 1949, it is the considered opinion of this Commission that any action, other than a denial of this petition, would establish a precedent that would be harmful in the future administration of the Zoning Ordinance; further. that the reported threat of legal action against the City places this Commission in the position where it is unable to recommend BDY action to the City Council other than denial of this request since, in the opinion of this Commission, the City might well be placed in the position of having been coerced into making legal an, illegal business operation. . NOW THEREFORE BE IT RESOLVED that the Commission recommends to the City Council of the City of Arcadia that 3. . . . . . 1. The purpose of the requested variance is to per- mit the maintenance in a residential zone of a commercial slaughter house, which has been specifically included in a manufacturing zone (M-l) under the provisions of the recently adopted Master Plan, and of various commercial enterprises which belong in and have been specifically provided for in the general business zone (C-2). 2. The Planning Commission feels that retail food stores and slaughter houses should not be conducted jointly, or in the same zone. 3. The recently adopted Master Plan did not change these properties from residential to commercial zoning, and due consideration was given at the time of the adoption of such master plan to the desirability of re-zoning for business uses; 4. The fact that an apparent commercial use of these properties over a period of years has been indulged in by peti- tioners and former owners does not justify the condoning of violations of the present and past zoning laws, or legitimating the illegal use of these properties. 5. The variance requested would affect the surround- ing properties as well as the properties involved and would affect the future use of the same by petitioners or any other person or persons to whom the properties might be sold; on the basis of a PERMANENT exception the granting of this request for a variance would amount to a re-zoning of residential property for a commer- cial slaughter house and various commercial uses, all of which have no place in a residential district or zone. 5. Ordinance No.760 provides in part, that any license or permit, if issued in conflict with the prOVisions thereof, shall be null and void. . 2.
