RESOLUTION NO.7.
A RESOLUTION OF THE CITY PLANNING COmHSSION
OF THE CITY OF ARCADIA, RECOMMENDING TEE DENIAL
OF A ZONING VARIANCE TO ALLOW CERTAIN COMJ.'illRC IAL
USES IN A RESIDENTIAL DISTRICT OI~ TEE EAST SIDE
OF SECOND AVENUE BETWEEN DUARTE ROAD AND ALICE
STREET, IN THE CITY OF ARCADIA.
. THE CITY PLANNING COMMISSION DOES HEREBY RESOLVE AS
FOLLOWS:
WHEREAS, by the provisions of Resolution No. 2 of this
Commission, adopted August 4, 1949, this Commission recommended
to the City Council of the City of Arcadia that the petition
of Joe E. Earll and Lou G. Earll, for a zone variance on the

following described property in the City of Arcadia, to wit:
Lots 1 to 6, inclusive, and lots 12 to 17, inclusive,
and the vacated alley adjacent, all in Block 61-1/2,
Santa Anita Tract, as shown on map recorded in Book
16, page 58, Miscellaneous Records of Los Angeles
County, located on the East side of Second Avenue,
between Duarte Road and Alice Street, and extending
Easterly 282.5 feet, and known as 221 East Duarte Road,
to permit the following uses:
1. Poultry and rabbit slaughter;
2. Retail florist shop;
3. Retail garden supplies;
4. Retail meat and poultry market and/or delicatessen
store;

5. Nursery for the growing and selling at retail and/or
wholesale of flowers and/or plants and the construc-
tion, alteration and maintenance and use of a build-
ing or buildings in connection therewith.
be disapproved and denied for the following reasons:

The Secretary shall certify to the adoption of this
Resolution, and shall forward a copy to the city Council of
the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was
adopted by the City Planning Commission at a regular meeting
held on the 15th day of September, 1949, by the following votes:
AYES: Mr. Anderson, Pippin, Shaw, stoner and SUllivan,
NOES: :None,
ABSENT: Mr.

parties were given the full opportunity to be heard, and
WHEREAS, in the opinion of this Commission the
maintenance of the several commercial uses hereinbefore
described in a residential zone would be detrimental to the
public welfare and injurious to surrounding property and
would adversely affect the comprehensive general plan of
this City,
NOW, THEREFORE, BE IT RESOLVED that this Commis-
sion recommends to the city Council of the City of Arcadia
that the aforesaid petition be disapproved and denied for
the following reasons:
1. The request of petitioners is contrary to the
spirit and intent of the Master Zoning Plan of the City of
Arcadia, which was adopted and became effective on June 3rd,
1949, after a series of public hearings, and which Plan was
unanimously approved by the Planning Commission and the City
Council;

2. The action requested by the petitioners is,
in the opinion of the Commission, contrary to good planning
practice as it involves "spot" re-zoning of this property,
without regard for the effect of such action on the properties
in the immediate vicinity;
3. This Commission recently recommended for denial
a similar petition for an extension of an existing variance
which terminated on June 16, 1949; there have been no changes
since this recent action of the Commission which would justify
a reversal of its prior decision so as to make legal the
present unlawful operation of the enterprise now being con-
ducted at the aforesaid location.
