RESOLUTION NO. 10
A RESOLUTION OF THE CITY PLANNING CO~llAISSION OF
'l'HE CITY OF iIRCADIA, RECObIT/lENDING THE GRANTING
OF A Y~TITION FOR A VARIANC~ AFFECTING CERTAIN
REAL PROPERTY LOCATED AT 1016 SOUTH BALD\IIN
AVENUE, IN SAID CITY.
THE CITY PLANNING C01~rISSION OF TIrE CITY OF ARCADIA DOES
HEREBY RESOLVE AS FOLLOWS:
iVHEREAS, on the 31st day of August, 1949, there was filed
with this Commission the petition of A. Jean Lyman regarding a
zoning variance on the following described property in the City
of Arcadia, to wit:
The Southerly 72.89 feet of lot 36 and the Northerly
67.11 feet of lot 37, Tract No. 3430, as shown on the

map recorded in Book 42, Page 32 of ~aps, records of
Los Angeles County, said distances being measured alonG
the Westerly line of said lots,
to permit the above described property to be used for the conduct
of a nursery school, and

VffiEREAS, after notice as required by Ordin~nce No. 760,
a public hearing on the matter was held before this Commission
on the 22nd day of September, 1949, and all interested parties
were given the full opportunity to be heard,
NOV, THEREFORE, BE IT RESOLVED that this Con~ission
recommends to the City Council of the City of Arcadia that the
aforesaid petition be granted and the requested variance be
approved for the following reasons:
1. The granting of this petition will not be inconsistent
with 800d planning practice or the provisions of the Uaster Zoning
Plan, or with the present development of the neighborhood in
which said property is located;

The Secretary shall certify to the adoption of this
Resolution, and shall forward a copy to the City Council of
the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was
special
adopted by the City Planning Commission at a ..~_ meeting
held on the 11th
day of october, 1949, by the following

NOB, THEREFORE, BE IT RESOLVED that this Commission
recommends to the City Council of the City of Arcadia that the
aforesaid petition be approved and a conditional variance granted
for the specified uses only, subject to the following terms and
conditions:
1. That the aforesaid property may be used for the con-
duct of a golf driving range, miniature golf range, pitch and putt
golf course, badminton courts, ping-pong courts, archel'Y ran[le,
tennis courts and the purveying of refreshments usually associated
with and sold at a public golf course, and for no other purpose

or purposes not permitted in Zone R-3 of the City of Arcadia;
2. That the variance hereby granted shall terminate,
cease and have no further effect on and after October 11, 1955; f~~.
3. That the business operations hereinbefore enumerated
and for which this variance is recommended will Dot be conducted
between the hours of 2 olclock a.m. and 6 O'clock a.m. on any day;
4. That no alcoholic begerages, including wine and beer,
will be ke~ or sold upon the aforesaid premises;
5. That in case anyone or more of the provisions or
conditions of this Resolution are violated, the property above
described shall revert to Zone R-3, as defined in said Ordinance
No. 760, and all of the rights and privileges herein granted shall
cease and terminate, in the event that any such violation is not

terminated within thirty days, or such further time as the City
Council may decide that the ovmers of said property, in the
exercise of due diligence, require to correct such violation,
after the owners of said property have been given written notice
by the City Council of said violation;
6. That the rights and privileges granted by this Reso-
lution are accepted by the persons affected thereby upon the
foregoing express conditions.
