RESOLUTION NO. 14 A RESOLUTION OF THE CITY roLANNING COMMISSION OF 'l'HE CITY OF ARCADIA, DECLARING ITS INTENl'ION '1'0 RECLASSIFY CERTAIN roROPERTIES ON THE NORTH SIDE OF LA YORTE STREWf BETVrnrnN SANTA ANITA AVENUE AND FIRST AVENUE, FROM ZONE C-2 'fO ZONE R-3. THE CITY r>LANNING COMMISSION OF THE CITY OF ARCADIA DOES HER~~Y RESOLVE AS FOLLOWS: SECTION 1. That ~he public in~erest and convenience . require, and i~ is the intention of the Planning Commission of ~he City of Arcadia to amend, rec1assif'y and al~er ~he boundar- ies of a certain zone es~ablished by the provisions of Ordinance No. 760 of the Ci~y of Arcadia, adopted May 3, 1949, so as ~o reclassify ~he several properties on the North side of La Porte street, between Santa Anita Avenue and First Avenue in the City of Arcadia, and to change the zoning of such properties from Zone C-2 to Zone R-3, as provided in said Ordinance. SECT IOU 2. Notice is hereby given that on the 15th day of December, 1949, at 8 o'clock Y.M. of said day, in the Council Chamber, in the City Hall of the Ci~y of Arcadia, any and all persons having any objections ~o said reclassification and re- zoning may appear before said City Y1anning Commission and show cause why said rezoning should not be effected in accordance wi~h ~his Resolution and wi~h the provisions of said Ordinance No. 780. . SECTION 3. The Secretary of the Planning Commission shall post, or cause to be posted, in front of the property under consideration, no~ less than ten days prior to the date of hearing, ~o wit, December 15, 1949, no~ices consisting of ~he words, "NOTICE OF YROPOSED CHANGE OF ZONE BOUNDARIES OR CLASSIFICATION", prin~ed in plain type with letters no~ less 1. 1{ . . . ~ ~ . . by the Xollowing votes: AYES: Mr. Anderson, Davis, Knutson, Robertson, Smith and Stoner. Ofl~i.d j ~e:r::J;. ~ . . . . . the aforesaid petition be disapproved and denied for the fol- lowing reasons: 1. The request of petitioners is contrary to the spirit and intent of the Master Zoning Plan of the City of Arcadia which was adopted and became effective on June 3rd, 1949, after a series of pUblic hearings and Which plan was unanimously approved by the Planning Commission and the City Council. 2. A majority of property owners within a 300 foot radius of the property in question, and other property owners in the neighborhood, object to any variance that. would permit the division of R-O Zone lots and/or the erecting of buildings thereon. 3. The granting of this variance and the improving of the lot so formed would effectually prevent any future street that may be desired from Holly to El Monte between Walnut and Palm. While it may grant relief to two property ovmers in this block, it would at the same time prevent any future relief to twenty other property owners in the same block and would therefore be detrimental to their interest. 4. This Commission considers it inconsistent with good planning practice to encourage or permit changing the boundaries of recorded lots to circumvent the intent of the Master Zoning Ordinance. The Secretary shall certify to the adoption of this Resolution and shall forward a copy to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing Resolution was adopted by the City Planning Commission on December I, 1949, 2.
