RESOLUTION NO. 19.
A RESOLUTION OF THE CITY PLAln1ING CO!illuISSION
OF THE CITY OF ARCADIA, CALIFORlHA, REQ01IMEIID-
ING THE DENIAL OF A PETITION FOR THE RB-ZONING
OF CERTAIN REAL PROPERTY, LOCATED AT 322-
H~l~I~GTON P~_CE, IN SAID CITY.
THE CITY PLAN1UNG COJ.'J'iJISSION OF Tllli CITY OF ARCADIA
DOES HEREBY RESOLVE AS FOLLOWS:
VlliEREAS, on the 4th of November, 1949, there was filed
with this Commission the petition of Martin J. Stately and
Frances E. Stately, requesting the re-zoning of the following
described real property in the City of Arcadia, to wit:
That portion of lot 43, Tract No. 11969, as shown on

map recorded in Book 259, pages 36 and 37 of Maps,
records of Los Angeles County, and that portion of lot
.
4, Tract No. 2409, as shown on map recorded in Book
23, page 23 of Maps, lying between the northerly pro-
longations of the easterly and westerly lines of lot
.
38 of said Tract No. 11969, being located at 322
Huntington Place,
to permit the above described property to be used for the p1~-
pose of multiple dwelling; and
~VHEREAS, after due notice, ~s required by the provisions
of Ordinance Ho. 760, of the City of Arcadia, a public hearing
was duly held on the matter before this Commission on the first
day of December, 1949, and all interested parties were given a
full opportunity to be heard, and
~nEREAS, in the opinion of this Commission, the proposed
re-zoning of the aforesaid property would be detrimental to the
pUblic welfare and injurious to surrounding property, and would
adversely affect the Comprehensive General Plan of this City,

\ITiEREAS, in the opinion of this Commission pUblic neces-
sity and convenience and the general welfare do not require or
indicate the desirability of the variance requested,
NOD, THEREFORE, BE IT RESOLv~ that this Cownission here-
by reco~nends to the City Council of the City of J~cadia ~lat the
aforesaid petition be disapproved and denied, for the follouinG
reasons, to wit:
1. The request of Detitioners is contrary to the spirit
and intent of the Llaster Zoninl; Plan of the City of .\rcadia which
~as adopted and became effective on June 3rd, 1949, after a series
of public hearin::;s and vlhich plan VI as unanimously a.pproved by the
Planning COlllmission and the City Council;
2. A majority of property ouners within a 300 foot ra-
dius of the property in question, and other property ovmers in the
neighborhood, have objected to any variance that Vlould permit the
invasion of business uses into a residential district or zono, SUCll
property OiTIlerS being desirous of, and entitled to, the maintaininc
the present residential zoning of the area involved.
3. The PlanninG Oo=ission considers it inconsiste!1t
with [Iood planning pl'actice to encourage or pormit heavy tl'l\cki'1':;
and other commercial practices upon or over residontial property
and to thus circumvent the intent of the J.iaster ZoninG Ordinance;
