RESOLUTION NO. 31
A RESOLUTION OF THE CITY PLANNING COMMISSION
OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING
TEE DENIAL OF THE PETITION FOR THE REZONING OF
CERTAIN PROPERTY LOCATED ON THE EASTERLY SIDE OF
LORENA STREET AND RECOMMENDING THE GRANTING OF AN
R-3 ZONE VARIANCE IN LIEU THEREOF.
THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA. DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, on the 6th day of July, 1950, there was filed
with the Commission the Petition of R. C. Ellis requesting ohange
of zone from Zone R-l to Zone R-3 on the following described property

in the City of Arcadia, to wit:
Lot 4, Blook 89, Santa Anita Traot, exoept the Southerly
135' thereof, as per map reoorded in Book 31, Pages 41 and
42 of Miscellaneous Records, in the office of the Recorder
of Los Angeles County, and
WHEREAS, after due notioe as reqUired by the provisions of
Ordinance No. 760 of the City of Arcadia, a public hearing was duly
held on the matter before this Commission on the 3rd day of August,
1950 and again on the l7th day of August, 1950. and all interested

parties were given a full opportuni ty to be heard, .a::a4
NOW, THEREFORE, be it resolved that this Commission make the
following findings and recommendations to the City Counoil of the City
of Aroadia:
1. That there were no protests of any kind to petitioner's
. request except the request of one property owner that an alley now
proposed along the Southerly portion of the property in question be
relocated further south so as to be in line with the existing alley
in the ad ,pining block; th1 s Commi ssion is of the opinion that such
matters are properly acted upon by this Commission when considering
the subdivision of the property.
2. That the property in question is bounded on the lBastl
by the Santa Anita Wash, beyond which lies a pUblic playground.
That the property to the south and southwest thereof is already zoned

. the granting of the varianoe as hereinafter reoommended adversely
affeot the oomprehensive general plan.
4. That suoh varianoe is neoessary for the preservation and
enjoyment of substantial property rights of the applioant.
5. That the granting of the varianoe hereinafter recommended
will not be materially detrimental to the public welfare or injurious
to the property or improvements in suoh vioinity and zone in which
the property is looated.
G. That for the above reasons, this Commission reoommend to
the City Council that a varianoe for the operation of a day nursery
on the property desoribed be granted upon the following oonditions:
A. That the number of ohildren served by S&id day nursery do
not exceed ten in number at any one time.
B. That the ages of the ohildren attending suoh nursery shall

not be less than 2 years nor more than 4 years.
C. That the period of such varianoe shall not exceed three
years, at Which time the operation of such day nursery shall oease,
unless the property be rezoned or a new varianoe obtained so as to
permit the lawful oontinuance thereof thereafter.
The Seoretary shall oertify to the adoption of this Resolution
and shall forward a oopy to the Oi ty Counoil of the City of Aroadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted by
the City Planning Commission at a regular meeting held on the 17th
day of August, 1950, by the following votes:

Weiokert.
