RESOIITTION NO. 32
A RESOIITTION OF THE CITY PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE V.ARl.ANCE
AFFECTING CERTAIN REAL PROPERTY LOCATED AT 530 W. LAS TUNAS DRIVE
IN SAID CITY.
THE CITY PLAmTING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HER.1l:BY RESOLVE AS FOLLOWS:
V~RA~, on the 18th day of July, 1950, there was filed with
this Commission, the petition of Dorothy M. and Joseph Lo Giudioe
requflsting a zone varianoe on the following desoribed property in
the City of Aroadia, towit:
Lot 28 of Traot No. 664l, in the City of Aroadia, County of
Los Angeles, State of California, as per map reoorded in Book
126, page 67 of Maps, in the offioe of the County Reoorder of
said County,
to permit the oonduoting thereon of a day nursery; and
WHEREAS, after notioe required by Ordinance No. 760, a publio
hearing on the matter was held before this Oommission on the 3rd day
of August, 1950, and all interested parties were given a full op:por-
tunity to be heard;
NOW, THRRRIl'ORE, BE IT RESOLVED that this Commission make the
following findings and reoommendations to the City Counoil of the
City of Aroadia:
l. That there was only one protest, to-wit Thomas J. Marshall,
the owner of an untmproved lot.
2. That the property involved is looated on a busy thoroughfare;
the adjoining property on eaoh side is *nimproved and is not likely
to be improved in the near future under the requirements of Zone R-l
in which it is located; that these oiroumstances do not apply gener-
ally to property in the same zone.
3. That the granting of the variance for the period hereinafter
reoommended will not be inoonsistant with good planning praotioe or
the provisions of the master zoning plan, or with the present develop-
ment of the neighborhood in which said property is located, nor will

4. That suoh varianoe is neoessary for the preservation and.
enjoyment of substantial property rights of the applioant.

5. That the granting of the varianoe requested will not^mater-
ially detrimental to the public welfare or injurious to the property
or improvements in suoh vioinity and zone in whioh the property is
looated.

6. That this Commission previously reoommended and the City
Counoil previously granted a varianoe for the use of property looated
at 1811 S. Second Avenue in Aroadia for general ohuroh purposes by
the Mission of the Transfiguration, and that said property has been
exohanged for the property herein desoribed for use by the Mission
of the Transfiguration, and said ohuroh no longer intends to use the
property looated at l81l S. Seoond Avenue in Aroadia for ohuroh
purposes.
7. That for the above reasons, this Commission reoommends to
the City Counoil that the requesteld varianoe be approved and granted.
Resolved further that Resolution No. 1 of this Commission,
adopted June l6, 1949, be and the same is hereby resoinded, and this
Commission reoommends that the City Council resoind its Resolution
No. 1892, adopted by it on June 30, 1949.
The Seoretary shall certify to the adoption of this Resolution
and Shall forward a copy to the City Council of the City of Aroadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted by
the City Planning Commission at a regular meeting.held on the l7th
day of August, 1950, by the following vote:
AYES: Mr. Anderson, Berky, Knutson, Robertson, Sorenson and
\'eiokert.
NOES: None
