RESOLUTION NO. 33.
A RESOLUTION OF THE CITY PLANNING CO~ISSION OF THE CITY OF
ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE
AFFECTING THE EAST OJm.,.HALF OF THE SOUTH OEE-HALF OF LOT 33
ARCADIA ACREAGE TRACT, IN SAID CITY. '

DOES HEREBY RESOLVE AS FOLLOWS:
V~RA~, on the 2lst day of July, 1950, there was filed with
this Commission the petition of B. IT. Fairohild, lessee, requesting
a zone varianoe on the following described property in the City of
Arcadia, to-wit:
The East one-half of the South one-half of lot 33, Aroadia
Acreage Traot, as shown on map reoorded in Book lO, page 18 of
Maps, reoords of Los Angeles County,
to permit the use thereof for general church purposes, and
ImRRRA~, after notioe required by Ordinanoe No. 760, a publio
hearing on the matter was held before this Commission on the 3rd day
of August, 1950, and all interested parties were given a full oppor-
tunity to be heard;
NOil, TffimEFORE, BE IT RESOLVED that this Commission make the
following findings and reoommendations to the City Counoil of the
City of Aroadia:
l. That there were no protests of any kind to petitioner's
request, but on the contrary all but one of the owners of surrounding
property within 300 feet have given their written approval thereof.
2. That the property involved is adjacent to school grounds,
. and horse stables are situated to the North and to the East thereof,
whioh oiroumstanoes are exceptional and do not apply generally to the

property in the same vicinity and area.
3. That the granting of the variance requested will not be
inconsistant with good planning practioe or the provisions of the
master zoning plan, or with the present development of the neighbor-
hood in whioh said property is located, nor Will the granting of the

of the operation of s~id day nursery.
B. That the aotivities of said nursery school be oonfined
to the hours from 9 A. M. to 12 noon and only five days per week
on week days.
C. That the ohildren enrolled in or served by said
nursery be of pre-sohool age, and that their number does not exceed
35 at any time.
D. The violation of any of aforesaid conditions shall be
ground tor the oanoellation of the variance hereby recommended.
The Seoretary shall certify to the adoption of this Resolu-
tion and shall forward a oopy to the City Counoil of the City of'
Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
by the City Planning Commission at a regular meeting held on the
5th day of Ootober, 1950, by the following vote:
AYES: Mr. Anderson, Berky, Knutson, Robertson, Sorenson,
Weiokert and Smith.

That said property is adjacent to property on the South ~ich is
used for public echool purposes, inoluding publio sohool playgrounds.
That other sides of said property adjoin property now used for
stabling of horses. That these ciroumstances are unusual and do not
apply generally to property in the same zone.
3. That said property will be accessible from proposed
First Avenue when the same shall have been completed and opened;
that the Arcadia Sohoo1 Distriot has granted permission for the oross-
ing, on foot, of the adjoining school property to the South, for the
purposes of' ingress to and egress from the property described in said
applioation.
~. That the granting of the variance requested will not
be inoonsistent with good planning practioe or the provisions of the
master zoning plan. or with the present development of the neighbor w
hood in whioh said property is 100a ted, nor will the granting of the
variance as hereinafter recommended adversely affect the oomprehensive
general plan.
5. That suoh variance is neoessary for the preservation
and enjoyment of substantial pro~rty rights of the applioant.
6. Tbat the granting of the varianoe requested will not
be materially detrimental to the public welfare or injurious to the
property or inprovements in such vioinity and zone in which the
property is looated.
7. That for the above reasons, this Commission recommend
to the City Council of the City of Aroadia that a variance for the
operation of a day nursery on the property described in said appli-
oation be granted upon the following express conditions:
A. That all County health and City fire regulations be at
all times oomplied 1111 th, and that all struotura1 alterations required
by either of said regulations be completed prior to the oommenoement
