RESOLUTION NO. 35
A RESOLUTION OF THE CITY PLANNING COMMISSION
OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING
THE DENIAL OF A PETITION FOR A ZONE VARIANCE
AFFECTING CERTAIN REAL PROPERTY LOCATED IN SAID
CITY.
THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA DOES
RESOLVE AS FOLLOWS:
WHEREAS, on the 21st day of September, 1950, there was
filed with this Commission the petition of Carl E. and K. Patrioia
Foley as owners requesting a zone variance affecting the following
desoribed real property in the City of Aroadia. to wit:
Lot 25 of Tract 12500 as per Map recorded in Book
236. pages ~5 and ~6 of Maps, in the Office of the
County Recorder of Los Angeles County,
to permit the above described property to be used for the construo-
tion of a duplex dwelling; and
WHEREAS, after due notice as required by the provisions
of Ordinanoe No. 760 of the City of Arcadia, a public hearing was
duly held on the matter before this Commission on October 5, 1950,
and all interested parties were given a full opportunity to be heard;
and said matter was further considered by this Commission on October
26, 1950,
NOW, THEREFORE, be it resolved that this Commission make
the following findings of fact and reoommendations to the City
Council of the City of Aroadia:
1. That the request of the petitioners is oontrary to
the spirit and intent of the Master Zoning Plan of the City of
Aroadia which was adopted and beoame effective on June 3, 19~9 after
a series of pUblio hearings, whioh plan was unanimously approved by
the Planning Commission and by the City Council of the City of
Arcadia.
2. That the granting of suoh request is not neoessary
for the preservation or enjoyment of any substantial property

(f) That walls be oonstructed and maintained along the
easterly and westerly lines of the property thus described in confor-
mi ty with the requireJIlen ts of E:ection l5 of Ordinance Ho. 760 of the
City of Arcadia.
(g) That violation of any of the aforesaid oonditions
shall be ground for the cancellation of the variance hereby recouuended.
~he Secretary shall certify to the adoption of this
Resolution, and shall forward a copy of the same to the Cit~r Council of
the City of Arcadia.

3. That the granting of the variance request will not
be inconsistent with good planning practice or the provisions of the
Master Zoning Plan, or with the present development of the neighbor-
hood in which said property is located nor will the granting of the
variance on the conditions hereinafter recommended aversely affect the
Comprehensive General Plan.
4. That such variance is necessary for the preservation
and enjoyment of substantial property rights of the applicant.
5. That the granting of the variance request, upon
the oonditions hereinafter recommended, will not be materially detri-
mental to the public welfare or injurious to the property or improvements
in such vic ini ty and zone in which the property is located, but on the
contrary will be beneficial to the public welfare.
6. That for the above reasons, this Commission recomnend
to the City Council of the City of Arcadia that a variance f'or the in-
stallation, maintenance and operation of an automobile parking lot on
the property described in said application be granted upon the follo\ung
express conditions:
(a) That all regulations of the City of Aroadia appli-
cable to parking lots.be at all times corrplied with.
(b) That a fence 3-1/2' in heifAt be constructed and
maintained at all tiJ:n.es throughout the existence of this variance, said
fence to be 3' back from the front property line and extending without
interruption of any kind by gates or othe~vise from the easterly line
to the westerly line along Christina Street.
(c) That no entrance to said parking lot shall be
allowed from Christina Street.
(d) That no charge shall be made for the privilege of
parking thereon.
(e) That the 3' stretoh along Christina Street between
the property line and the fence hereinabove required shall be landscaped
and planted v:i th sllrubbery of the variety and type sufficient to conceal
at least the fence frOll view frOll Christina Street.
