RESOLUTION NO. 37 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERTY LOCATED IN SAID CITY TO PERMIT THE CONSTRUCTION AND OPERATION OF A PUBLIC SCHOOL THEREON. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS. on the 7th day of Deoember, 1950, this Commission did on its own motion initiate proceedings for the granting of a varianoe on the following described property in the City of Arcadia, to wit: A part of Lot 6, Tract No. 9~9, as shown on map reoorded . in Book 17, page l3 of Maps, reoords of Los Angeles County, des- oribed as follows: Beginning at the Northwest oorner of Lot 12, Tract No. 15960, as shown on map reoorded in Book 35~, pages 9 and 10 of Maps, records of said County; thenoe S 890 06' 50" W along the Southerly line of Tract No. 14428 and Traot No. 15928 429.~0 feet to the West line of said Lot 6; thenoe S 00 53' 10" E thereon 19~.69 feet; thenoe N 890 06' 50" E to the West line of De Anza Plaoe, (formerly Hazel Court); thence Northerly thereon and along the West line of said Lot 12 to the point of beginning, being a paroel of land extending from De Anza Place to Michillinda Avenue, to permit the construction and operation thereon of a public . sohool; and WHEREAS, after notice required by Ordinance No. 160 of said City, a public hearing on the matter was held before this Commission on the 21st day of Deoember, 1950, and all interested parties were given a full opportunity to be heard thereat; NOW, THEREFORE, be it resolved, that this Commission make the following findings and the following recommendations to the City Counoil of the City of Aroadia: ,I, . ,,-.1 I . -1- ~V' <11 '/- . ~ .1". .. . . . .. ... . That adequate off-street parking and loading space be provided for all. employees, customers. visitors and deliveries, sucb parking space to be not less than 50% of the total floor area of all. buildings. vn. That no building over one story in beighth be constructed on the property. VllI. That the plot plan submitted by applicant. marked Exhibit "An and made a part of the record. is hereby approved; that all. modifications thereof, and all future building plans, plot plans and landscape plans be approved by the City Planning Commission before a building parmi t is issued and that all. work be carried out according to such approved plans. IX. That construction of" the first proposed building unit be oommenced within nine months after the granting of the variance and diligent4" prosecuted to CQll1- pletion. . x. That the only vehicular entrance and exit shall. be opposite Nernnan Avenue. unless subsequent approval of the Chief of Police and of the Street Superintendent.i s obtained. XI. That each of the foregoing conditions are continuing and inter de- pendent upon the others and the violation of any one or more of the said conditions shall. constitute grounds for the cancellation of all. or any part of the variance hereby recnmmP.nded. The secretary shall. certify to the adoption of this Resolution. and shall. forward a copy of the same to the City Council of the City of Arcadia. (c) For the uses permitted in Section llA. subdivisions lB, 22. 25 and ~ of ordinance No. 160 of the City of Arcadia; (d) Other kinds of light manufaoture, processing or treatment of products other than those which may- be obnoxious or offensive by reason of emission of odor. dust. smoke, gas, noise or other similar characteristics. inclUding . hazards. provided that the determination of the character of any use as definsd in this paragraph shall be arrived at as set forth in Section 15. paragraph A. Use, subparagraphl. General. item "a" of Ordinanoe No. 160 of the City of Arcadia. upon the following conditions: I. Thai; any of the uses enumerated in Subdivision a, b. c and d of the preceding paragraph, if conduoted on the above described property shall be conducted entirely with:in a building that is adequately sound-proofed and othenrise adequateJ;r equipped so that no noise. dust. vibrations, odors. fumes, gases. or other detrimental effects thereof will be obnoxious or offensive to the adjacent neighborhood. n. That no equipment of any kind shall at any time be permitted if it interferes with radio or television reception even :in the immediate adjaoent neighbor- hood. III. That no buildings or parking space be located. with:ln thirty-five (35') . feet of Santa Anita Avenue and that this area be adequately landscaped and maintained at all times. IV. That no buildings be located within ten (10') feet of Colorado Boulevard or with:in twenty (20') feet of the north property line for a distance of one hundred (100') feet trom Santa Anita Avenue. V. That buildings or portions of buildings located within seventy (10') feet of Santa Anita Avenue be used for office apace only. -4- . . . .' . . . recommended wlll be entirely consistent with good plann:ing practioe and with the pro- visions of the Master zoning Plan. and will be consistent with the present development of the neighborhood. and will encourage and foster the further beneficial development of the neighborhood in which said property is located and will be in accord with the Comprehensive General Plan for the following reasons among others: (a) Because of its size. location. irregular shape, topographical features and certain developments hereinafter and hereinbefore described. the property involved is not suitable nor reasonably usable for residential purposes. (b) The property iJDmediately to the north of the property involved is already devoted to uses substantially of an Mool nature. (c) The property to the north. the railroad right of wa;y to the southwest. the depressed roadway of Colorado Boulevard to the south. and the divided roadwa;y of Santa Anita Avenue to the east. will amply buffer the property involved !rom the adjacent property beyond the buf't'er strips. (d) There are already numerous c-2 and M-l uses in the same vicinity and zone. particularly to the south and east of the property involved. (e) The development of the property involved in an orderly manner with adequate safe-guards and restrictions will be far superior to sny type of l'esidential use than oan reasonably be oontemplated for the property involved. 4. That such variance :is neoessary for the preservation and enjoyment of substantial :pl"operty rights of the applicant. 5. That the granting of the variance requested upon the conditions herein- after recommended. will not be materially detrimental to the public welfare or in- jurious to the property or improvements in such vicinity and zone in which the property :is located. but on the contrary will be beneficial to the public welfare. 6. That for the above reasons this Commission recO""'1"ntl$ to the City Council of the City of Arcadia that a variance be granted permitting the property hereinbefore described to be used for the following purposes. to wit: (a) Des1gn:ing. developing. and manufacturing of electrical. electronic. and mechanical apparatus, equipment. devices. and .instruments useful in. relating to. or an aid in communication and navigation fields, as Ylell as for -)- . . . . NON. THEREFORE. be it resolved that this ComllI1ssion make the following . findings of' fact and the following reoommendations to the City Council of the City ~ Arcadia: 1. That although there were numerous protests against the granting of the variance requested, the m~ority of the protestants were residents or owners of property not in the immediate vicinity of the property involved; that numerous owners of property in the immediate vicinity either were not opposed to the granting of the requested variance or withdrew their objections to the requested variance; that numerous residents and associations. including the Arcadia Chamber of Commeroe, the Down Town Arcadia Business Association and the Arcadia United Citizens Association are whole-heartily in favor of the granting of the requested variance; that D1Bl'ly of the protests. though duly considered. are entitled to relatively little weight because of the distant loca- tion ~ such protestants from the property involved and the little efi'ect that the . granting of the requested variance can have upon them; that much of the merit of the other protests can be removed by the imposition 01' adequate conditions and restrictions :In the granting of the variance as hereafter recommended. 2. That there are numerous circumstanoes concerning the property involved which are exceptional and do not apply generally to the property :In the same vicinity and zone. AlJIOng such circumstances are the fact that the property involved is bound- ed on the south by Colorado Boulevard. whicl'l street immediately west of its intersection with Santa Anita Avenue is depressed so as to go under the railroad underpass. l'Ihich fact makes the property involved allnost entirely inaccessible from the southerly side.. FUrthermore the property is bounded for a great distance on the southwesterly side by the Santa Fe RailwlV right of wlV which is located upon a high embankment adequately and completely screening the property :Involved from the property on the southwesterly side of said railway tracks. That the property involved is bounded on the northerly . side by property developed for and devoted to uses substantially M-l in character. 3. That the granting of the requested variance. as modified and as here- . after recolllIllSIlded. will not be inconsistent with good planning practice or the pro- visions of' the Master Zoning Plan. or with the present development of the neighborhood .r in which said property is looated, nor will the granting of the variance on the con- ditions here:lne.t'ter recommended adversely affect the Comprehensive General Plan. on the contrary, the grant:lng of the variance as and upon the oonditions hereinafter -:!.
