HomeMy WebLinkAbout0054 .. .' . . . - RESOIDTION NO. 54 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, P.ECOMMENDING THE CLASSIFICATION OF SWIMMING POOLS AND RELATED BUSINESSES. THE CITY PLA.NNING COMMISSION OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOVlS: WHEREAS, Stuart King proposes to construot, maintain and operate within the City of Aroadia a school for swimming instruotion, with speoially designed swimming pool, dressing rooms, sanitary aooommodations and inoidental facilities; and WHEREAS, such a business is not specifioally mentioned or generally desoribed in the uses permitted in any zone in the City of Aroadia under Ordinanoe No. 760 of the City of Aroadia; and WHEREAS, Section l5 of Ordinanoe No. 760 provides that if any "Use" is for any reason omitted from the lists of those speoified ae permis~ble in each of the yarious zones, it Bhall be the duty of the City Planning Commission to asoertain all pertinent faots oon- oerning said use, and by resolution of reoord set forth its findings and the reasons thereof, and suoh findings and resolutions shall be referred to the City Council, and if approved by the Oity Counoil, thereafter suoh interpretation shall govern; and ~~A~, the City Planning COmmission has fully oonsidered the matter and finde that it is advisable and neoessary that suoh business be classified; NOW, THEREFORE, BE IT RESOLVED, that the business of main- taining and operating a school for SWimming instruotion, inoluding a ~ swimming pool speoially designed for~BUoh purpose, dressing rooms, . sanitary aooommodations and faoilities inoidental thereto, and the giving of BWimming, diving, life saving and other similar instruotions thereat, shall be olassified as a use permissable in Zone C-2 under Seotion 9 of Ordinanoe No. 760 of the City of Aroadia, provided that automoblie parking spaoe equivalent to one parking spaoe for eaoh eighty (80) square feet of swimming pool area be prOVided on the same lot or oontiguous thereto, and improved as provided in Seotion l5 of Ordinance No. 760 - :. :: :it 1 "...... . . J , ot this Commission, constitute such an exceptional or extraordinary cir- cumstance as to require the granting of the variance requested. SECTION 2. The granting of such a variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, possessed by other property in the same vicinity and zone, in that said property is already as fully developed as Ordi- nance ao. 760 presently permits, and applicant has acquired no additional property riGht entitling him to any variance by reason of any permit issued contrary to the provisions of local law. . S~CTION 3. That the granting of the variance requested would adversely affect the comprehensive general plan in that the public welfare and convenience require that a public street be opened in the area along the rear portion of applicant's said property. RhSOLVED FURTHER, that this Commission recommend to the City Council of the City of Arcadia. that said applicant's petition for a zone variance be denied. RESOLVbD FURTHER, that the Secretary shall certify to the adoption of this resolution, and shall forward a copy of the same to the City Cou.ncll of the City of Arcadia.
