HomeMy WebLinkAboutItem 11e - LA County Tree Replacement Cooperative AgreementLA County Tree Replacement Cooperative Agreement July 19, 2022 Page 1 of 2 DATE: July 19, 2022 TO: Honorable Mayor and City Council FROM: Paul Cranmer, Public Works Services Director By: Carmen Masud, Deputy Public Works Services Director SUBJECT: COOPERATIVE AGREEMENT WITH THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT FOR THE REPLACEMENT OF TREES Recommendation: Approve SUMMARY The Los Angeles County Flood Control District operates and maintains the Santa Anita Debris Basin located in the City of Arcadia (“City”). In response to the conditions created by the Bobcat Fire and subsequent landslides, the Los Angeles County Flood Control District implemented a project to remove accumulated sediment from the Santa Anita Basin. The project required the removal of trees from the basin. The Los Angeles County Flood Control District proposes to provide the City with 463 trees to replace the ones that were removed from the project site on a three-to-one basis. The new trees will be planted throughout the City. It is recommended that the City Council approve the Tree Replacement Cooperative Agreement with the Los Angeles County Flood Control District and authorize the City Manager to execute the Cooperative Agreement for the replacement of trees. BACKGROUND The Los Angeles County Flood Control District provides flood protection, water conservation, recreation, and aesthetic enhancements within Los Angeles County. The Los Angeles County Flood Control District encompasses more than 2,700 square miles and approximately 2.1 million land parcels within six major watersheds. This includes 14 major dams and reservoirs, 483 miles of open channel, 27 spreading grounds, 3,330 miles of underground storm drains, 47 pump plants, 172 debris basins, 27 sediment placement sites, 3 seawater intrusion barriers, and an estimated 82,000 catch basins. The Santa Anita Debris Basin located in the City is one of the debris basins operated and maintained by the Los Angeles County Flood Control District. In response to the conditions created by the Bobcat Fire and the significant mudslides that followed, the Los Angeles County Flood Control District employed a project to remove accumulated sediment from the Santa Anita Debris Basin. During project completion, over 150 trees were removed from the basin. The Los Angeles County Flood Control District LA County Tree Replacement Cooperative Agreement July 19, 2022 Page 2 of 2 agreed to provide the City with a three-to-one tree replacement ratio for the trees removed from the basin. These trees are to be planted throughout the City. DISCUSSION The Los Angeles County Flood Control District proposes to pay the City a one-time lump sum amount of $155,568 for the purchase and planting of 463 trees. The City will use the funds to purchase trees species listed on the City’s Tree Master Plan and will determine the locations suitable for the planting of the trees including along public streets, in City parks, and other public spaces. The City will provide the County Flood Control District a list of all locations where the trees have been planted. The City will have five years after receiving payment from the County Flood Control District to plant all 463 trees. Once the trees have been planted, the City will be fully responsible for the maintenance of the trees at no cost to the Los Angeles Flood Control District. Therefore, City staff proposes to purchase 24-inch box trees based on the price allocation for each tree. ENVIRONMENTAL ANALYSIS This project is categorically exempt pursuant to the California Environmental Quality Act ("CEQA") under Section 15304 (b) Class 4. The planting of new landscaping trees is considered a minor alteration to land and vegetation. FISCAL IMPACT Upon approval of the Tree Replacement Cooperative Agreement, the Los Angeles County Flood Control District will pay the City a one-time lump sum amount of $155,568 ($336 per tree) for the total of 463 trees. The City will be responsible for the maintenance of the trees and will include the trees as part of the tree trimming contract. RECOMMENDATION It is recommended that the City Council approve the Tree Replacement Cooperative Agreement with the Los Angeles County Flood Control District and authorize the City Manager to execute the Cooperative Agreement for the replacement of trees. Attachment: Tree Replacement Agreement Page 1 of 3 HOA.103121384 AGREEMENT THIS AGREEMENT, made and entered into by and between the LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (hereinafter referred to as the DISTRICT), a body corporate and politic, and the CITY OF ARCADIA, a municipal corporation in the County of Los Angeles (hereinafter referred to as CITY). RECITALS WHEREAS, the DISTRICT operates the Santa Anita Debris Basin (hereinafter referred to as BASIN) flood control facility located within the CITY boundary; WHEREAS, the DISTRICT implemented a project to remove accumulated sediment from the BASIN in response to the conditions created by the Bobcat Fire emergency project (hereinafter referred to as PROJECT); WHEREAS, the PROJECT removed trees from the BASIN and the DISTRICT proposes to provide for a similar number of new trees to be planted within DISTRICT property adjacent to the BASIN and planted outside the BASIN, on property of the CITY and in the parkways of CITY streets; WHEREAS, the CITY has various properties suitable to plant new trees; NOW, THEREFORE, in consideration of the mutual benefits to be derived by the DISTRICT and the CITY and of the promises herein contained, it is hereby agreed as follows: (1) THE DISTRICT AGREES: a. To pay the CITY a one-time lump sum amount of $155,568 ($336 per tree X 463 trees). (2) CITY AGREES: a. Upon receipt of the payment from the DISTRICT, described in Section (1) above, to identify locations on CITY properties that are suitable for the planting of new trees and plant 463 new trees on CITY properties or in the parkways of CITY streets. b. To use the payment received from the DISTRICT only for the planting of new trees on CITY properties or in the parkways of CITY streets. c. To plant the new trees within 5 years after receiving payment from the DISTRICT. d. To only plant new trees that are species listed on the CITY planting palette. Page 2 of 3 HOA.103121384 e. Annually, to notify the DISTRICT of the number of new trees and their species, and locations planted by CITY pursuant to this AGREEMENT. f. After planting, to be responsible for the maintenance of the trees at no cost to the DISTRICT. (3) IT IS MUTUALLY UNDERSTOOD AND AGREED AS FOLLOWS: a. Each tree that is planted pursuant to this AGREEMENT shall be the property of the CITY and the DISTRICT shall have no further rights or responsibilities with respect to the trees. b. The DISTRICT shall indemnify, defend, and save harmless the CITY and its officers and employees from and against any claims or liability imposed for any injury (as defined by Government Code, Section 810.8), arising out of or in connection with any work performed by the DISTRICT referenced in this AGREEMENT. d.
