A RESOLUTION OF THE CITY PLA.NNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, INSTITUTING PllOCEEDINGS TO GRANT A VARIANCE FROM THE FRONT YARD REQUIREMENTS AFFECTING CERTAIN PROPERTY IN SAID CITY. WHEREAS. practical difficulties and unnecessary hardships exist with reference to the property hereinafter described, and good cause appearing therefor. Nai. THEREFORE. the City p1Anning Commiss:Lon of the City of Arcadia does resolve as follows: SECTION 1. That pursuant to Section 16 of Orcl1nance No. 760 of the City of Arcadia. the City PlAnni1'1g Commission of the City of Arcadia does hereby institute proceedings to change the front yard requirements affecting the following described property: Lots 1 to 20 inclUSive, and lot 26 of Tract 17329 approved by the City CODDCU on Deoamber 18, 19S1, . from 25 feet to 20 feet. SECTION 2. That a public hearlng on the matter be set for the 27th day of Mq, 1952. at 8:00 o'clock P. M.. and that the Secretary give notice as required by law. The Secretary shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted by the City PlA"ning Comm1ss10n on May 13. 1952, by the following vote: .AlES: Mr. Anderson. Balser, Berlly. That the granting of' the variance requested. upon the oonditions here- inafter proposed will not. becsuS6 01.' the development and use of other properties in the same vicinity, be inconsistent with good planning practice or the provisions of the master zoning plan, or with the present development of the general neighborhood in which said property is located. nor w:i.ll the granting at the variance as herein- iller recOllllllended adversely affect the comprehensive general plan. 6. That such variance is necessary for the preservation and enjo~nt ot substantial property rights of the applicant, tor the reason that the presebt develop- ment and use of adjacent properties are not oonducive to the use of the subject property 1.'or the uses tor which it is presently zoned; and the extension and opening of Baldwin Avenue as a major north and south traffic ertery will make the subject property still less conducive to the use for which it is presently zoned. 7. That for the foregoing reasons, this Commission recommends to the City Counoil that a variance be granted to permit the property hereinbefore described to be used for the construction and maintenance thereon of two apartment houses ot eighteen units each. subject to the follow1ng oonditions: A. That all improvements construoted thereon conform to the plans and elevations prepared by Robert W. Jolmson and filed w:i.th this Commission. B. That the building size shall not exceed the size shcnm on the plans filed. C. That no more than thirty-six (36) dwelling units be constructed on the entire parcel of land, nor more than eighteen (18) units on either hall' thereof. D. That a six foot (61) high masonry wall be constructed along the rear line of the entire parcel of property thus desoribed, and extending along the side- . lines of the lot from the rear line thereof to the rear line of the buildings to be oonstructed thereon. E. That the parking area be paved. F. That construction of the bni1tli"gs in acoordance with the variance hereby recommended be completed within one year after the eti'ective date of the G. That each condition be interdependent upon the other, and violation of or IIlOre conditions shall be grounds for revocation of the variance hereby -2-
