RESOLUTION NO. 72
A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF AllCADIA.
CALIFORNIA. RECOMMENDING THE GRANTING OF A ZONE VARIANCE AFFECTING
CERTAIN REAL PROPERTY IN SAID CITY TO PWIIT DEVIATION FROM FRONT
YARD REQUIREMENTS.
WHEREAS. on May 1:3, 1952, this C01IIIlIission adopted Resolution No. 69 wherebJ'
proceed1ngs were instituted to change the front yard requirements affecting the real
property therein described; and,
WHEREAS, atter notioe required by Ordinance No. 760 of said City, a public
hearing was held by and before this Connniss1on on the 27th dq of May, 1952, at which
time all persons interested were given a full opportunity to be heard;

does hereby find, resolve and reooDlllllll1d as follows:
l. That there were no protests, oral or written, to the granting of the

variance ohanging the setback on the property here1naf'ter described.
2. That the granting of the variance hereinafter recoDlllllll1ded nil not be
inconsistent with good plAnning practice nor the provisions of the Master Zone Plan
nor the present development of the neighborhood in which subject property is located,
nor will the granting of such variance adversel:y affect the comprehensive general plan.
3. That such variance is necessary for the preservation and enjo~ent of
substantial property righte of the owner.
4. That the granting of the variance here1na.t'ter recOllllll8nded will not be
mate~ detriJDantaJ. to the public welf'are or injurious to the property or improve-
ments in such vicinity or zone in which the SUbject property is located.
5. That the varimoe here1nafter recODllllended is in conformity with, and
necessary for compliance with the conditions imposed by this Commission and the City
Council of this City imposed upon the approval of the tentative map of -rract No. 17329.
6. That for the above reasons this Commission recOllllllends to the City Council
the granting of a variance changing the front yard requirement of twenty-five (25) feet.
to twenty (20) feet affecting lots 1 to 20 inclusive, and the Windsor Road frontage of
lot 26. all of Tract No. 17.329 in the City of Arcadia.

The Secretary shall certi!y to the adoption of this resolution,
forward a coPT of the B8IIIe to the City Council of the City of Arcadia.

SECTION 4.

For the foregoing reasons,
.
it is hereby recOl1l1lended that foster
homes be defined as follows:
.
"Foster home" shall mean any home in which foster care of children under
sixt.een (16) years of age, and not exceeding six (6) in number. including
members of the family of the operator who are under sixt.een (16) years of
age, is, for monetary consideration, provided for less than twenty-four (24)
hours a day under license issued by the State of California Department of
Sooial Welfare.
SECTION 5. It is .further recommended that foster homes as thus defined be
inoluded as a use permissible in Zones Rl, R2 and R3 upon the following conditions:
A. That a permit be required in each instance under applicable regulatory
ordinances of the City of Arcadia.
B. That the Olfllers of property within three hundred (300) feet of a:ny
proposed foster home be given written notice of a public hearing to be held on the

application for such permit.
C. That no such permit be granted except upon condition that a license
be obtained from the State of California for such home.
D. That such permit shall be for one (1) year only and renewable con-
currently with the State license.
E. For foster homes located. in Zone Rl only, no per.rnit shall be granted
unless applicant shall have obtained the consent of the owners of at least two
thirds (2/3) of the area ldtbin a radius of three hundred (300) feet of the property
upon which the foster home is proposed to be conducted, inoluding t e consent of the

owners of the inmediately adjacent parcels on each side.
SECTION 6. The Seoretary shall certify to the adoption of this Resolution
and shall forward a copy to theCity Council of the City of Arcadia..
I HEREBY CERTIFY that the foregoing Resolution was adopted by the City
Planning Commission at a regt,lar meeting held on the lOth day of June, 1952, by the
following vote:
AYES: Mr. BaJ.ser, Berl<;y. Danver, Knopp, Pratt and Sorenson
