RESOLUTION NO. 89
A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL
OF A mITION FOR THE EX'lENSION AND ENLARGEMENT OF AN
EXISTING VARIANCE AFFECTING CERTAIN REAL PROPERTY IN
SAID CITY.
WHEREAS, there was :filed with this COlIlIlIission the petition of Harry B. Fox,
as lessee, clba Equip Rent Campany, requesting a zone variance affecting the follOlf-

ing described property in the City of Arcadia, to-wit:
The West 100 feet of lot 69. Santa Anita ColoD;1, as shown on map recorded
in Book 42, page 81, Miscellaneous Records of Los Angeles County, except
that portion in streets, being located at 82 West Las Tunas Drive,
to permit the extension of the existing variance to operate an equipment rental
yard to include an additional 25 feet to the east of the present yard, and to exl;end
the time of the original variance an additional five (5) years. and
WHEREAS, after due notice as required by the provisions of Orrlin"n"e No. 160
of the City of Arcadia, a public hearing was held on the matter by and before this
Commission on the 26th day of August, 1952, at which time all interested persons
were given an opportunity to be heard and to present evidence.
NCM, THEREFORE, the City Planning COlIlIlIission of the City of Arcadia does hereby
find, detennine and resolve as follOlfst
SECTION 1. That there were four protests by owners of' property in the near
vicini ty of the subject property objecting to the granting of the petition.

That the variance affecting subject property heretofore o~ granted, and as
subsequen~ extended, Will not expire until 1955. that there is no present need
for the further extension of said variance; that the variance heretofore granted
should not be further extended at this time as it Will have a retarding affect upon
development of unimpro-ved adjacent properties. That the requested extension will
project 50 far into the future as to make the integration of the bU5~ss conducted

on the subjec propert3' cl:I..!1'icult, if' not impossible; that the requested variance is
not necessary for the protect10n of ~ vested rights. that the permitting of equip-
ment heavier or larger than that now permitted under the existing variance Will be
extreme~ detrimental to other properties in the same vicinity and zone, and is not
ecessa.1'y for the preservation or enjo;yment of substantial property rights of the

SECTION 2. That for the foregoing reasons this COIIIIIlission recommend to
the City Council that said applicant's request be denied in full.
SECTION 3. The Secretary shall certifY to the adoption of this Resolution
and shall forward a copy of the same to the City Council of the City of Arcadia.
