RESOLUTION NO. 90 A RESOLUTION OF THE CITY PLANNINl .COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMM&lIDING THE DENIAL OF A PETITION FOR A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERU IN SAID CITY. WJlF.1mA!,;, on .Ju:q 22, 1952, there was filed with this COIIIDIission the petition of Ina L. Hance, as owner, requesting a zone variance affecting the follow- :ing described property in the City of Arcadia, to-wit: A part of lot 6, Tract No. 949, as shown on map recorded in Book 17, page lJ of Maps, records of Los Angeles County, described as follows: Beginning at a point on the East line of lot 6 distant North 20$8'25" east 216.12 feet from the North line of Huntington Drive; thence North 87001'35" vest 260 feet; thence North 2058'250 east 216.13 feet; thence South 87001'350 east 260 feet; thence Seuth 20$8'250 West 216.13 feet to the point of beginning, and being located on the vest side of BaJ.didn Avenue north of Huntington Drive, to pemit the property to be used for retail and wholesale nursery business, With a . one-story structure to house D111'sery stock and to provide off1ce and sales1'OOlll space) and WHEREAS, after due notice as required by the provisions of OrdinAnne No. 760 of the City of Arcadia, a public hearing was held on the matter by and before this CODIIII:I.ssion on the 12th day of August, 19$2, at which time all interested persons were given an opportunity to be heard and to present evidence): NOW, THEllEFORE, the City PlA"";l'le Commission of the City of Arcadia does hereby find, detel'lJl:l.ne and resolve as follows: SECTION 1. That there were numerous protests to the granting of the variance requested. The su.bject property abuts and faces Baldidn Avenue. Baldwin Avslll1e is now a through traffic artery. '!hat thcmgh there are exceptional c~ cumst.ances not simi'''..~ applicable in the same vicinity and zone, as determined in Resolution No. 70 of this Commission, nevertheless they are not such as to DllIke the . property undesirable for the uses for which it may be l..awfullJ' used. :!hat the use of the property for the purposes for which the variance is herein requested would be detrimental and injurious to the other properties in the same vicinity and zone. '!hat the granting of the variance requested is not necessary for the protection of substantial property rights of the applicant. That the granting of the var1ance hereinafter recommended Will not adversely affect the general plan. SECTION 2. That for the foregoing reasons th1s Com- mission recommends to the C1ty Counc11 that a variance be grant- . ed to pe1'lll1 t the propert~ hereinbefore desoribed to be used for the permanent locatlon of a storage bu11ding for use in con- Deet10n w1th tbe businesses conducted on adjacent properties. SECTION 3. The Secretary shall cert1t;r to the ad- opt1on of th1s Resolut1on and shall cause a copy of the same to be forwarded to the C1 ty Counc1l of the C1 t1' ot Arcadia.
