RESOLUTION NO.93 A RESOLUTION OF THE CITY PLAIfNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDlliG THE DEl'iIAL OF THE PB'l'ITIOB FOR THE HE-CIASSIFICATION OF CERTAIN REAL PROPERTY IR SAID CITY. WBEBEAS, there vaa filed v1th th1s CollllD1ss1on the pet1tlon of Jake S. Foto as owner. requesting tbe re-c1ass1f1cat1on from Zone B-3 to Zone C-2 or C -3 ot the following descr1bed propert1', to-w1 t: Lots 6 and 7, Tract No.11438, as shown on map recorded in Book 234, page 22 of Mapa, records ot Los Angele8 County, and being located at the Northeast corner of Santa Anita Avenue and Live Oak Avenue. WHEREAS, after due not1ce as required by law publ1c bearings were duly be1d on the matter by and before this Collllll1n1on on August 26. and September 10, 1952, at wblcb time all interested persons were glven a full opportun1ty to be heard and to present ev1dence; NOW, 'l'HEREF0RE, the City Planning Colllll11ss1on of tbe C1ty of Arcad1a does bereb1' find, determine and resol ve as follows: SECTION 1. That De1 ther the public necess1 t1', the pUblic con- ven1enee nor tbe general welfare require tbe re-c1as81f1cat1on ot the subject property; That the property can well be used for the purposes tor which 1t 18 presented zoned. That tbe subject propert1' 18 situated in the exact Southerly bound&r1 of tbe C1ty of Arcad1a; that adjacent property in the count1' to the South is zoned commerc1al and adjacent propert1' in the C1t1' to the North 1s zoned R-1; that tbe princ1p1es of good planning requires that an adequate buffer strlp be located between two sucb zones. That tbe classlflcat10n of subject property as C-2 or C-3 vould be injur10us and detr1Jaenta1 to adjacent and surround- ing propert1es and the properties in the general v1cinit1' and zone. in that subject propert;J' 18 a relatively small parcel and commerc1al zoning would permi t 1 t to be used for purposes 1nl1al'lllOnlous vi th and detr1lllental to the uses permitted in adjacent parcels. That subjeot property 18 presently zoned for mult1p1e dwellings, apartment houses, med1cal off1ces and other quas1-commerc1al -1- C:'l uti ~ ~ . . the uses permitted in adjacent parcels. That subject property 1s presently zoned tor mu1t1p1e dwellings, apartment houses, medical offices and other Q.uas1-com- merc1al uses and 1s properl1' suited for sucb development. Tba t further expans10n of the zoning to unlimited com- mercial uses would Oe premature and harmful in part for the reason th*t there 1s more cOlll\llerc1al propert1 in the general area tban the demand requires, and further expans10n of commercial uses 0011' prevents the orderl1' development of tbe commun1ty and retards the proper development tbereof. SECTION 2. That for the foregoing reasons this Commission recommends to the City Counc11 of tbe City of Arcadia that the pet1t1on tor reclassification ot the subject propert1' be den1ed. SECTION 3. Tbe Secretar1 shall certify to the adoption . of this Resolut10n, and shall cause a copy ot the same to be for- . warded to the Cit1 Counc11 of tbe C1ty of Arcadia.
