RESOLUTION NO.107
A RESOLU'l'ION OF THE CITY PLANNING COMMISSION
OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMEND-
ING THE EXTENSION OF AN EXISTING VARJrANCE UNDER
SPECIFIED CONDITIONS.
WHEREAS, on Ma1' 4, 1948, after hearings before the City Plan-
ning Commission and the City Council as reqUired by law, the City
Council of the City of Arcadia adopted Ordinance No.704 wherein
and whereby a variance was granted to permit the property herein-
after described to be used for a Real Estate Insurance Broker's
business; and
WHEREAS, &iter hearings by and before this Commission and said
City Council, the City Council of the City of Arcadia did on March
31, 1950, adopt Ordinance No.Boo wherein and whereby eaid variance
was expanded to include business and professional oftices upon con-
ditions therein specified; and
WHEREAS, there was filed with this Commission on March 24, 1953,
the petition ot Ben and Sophia Roitstein as owners, fOl' the further
extension ot the variance hereinbefore granted as aforesaid for an
additional period of Five (5) years,and for the addition to the exist-
ing structures of an additional structure approximately 10' x 19' in
size; and
WHEREAS. after notice required by Ordinance No.760 of the City
of Arcadia public bearing on said application was held by and before
this Commission on the 14th day of April 1953, at which time all
interested persons were given a full opportunity to be heard and to
present eVidencej
NOW, THEREFORE, the City Planning Commission ot the City of
Arcadia does hereby find, determine and resolve as follows:
SECTION 1. That there were no protests to the granting of said
petition.
SECTION 2. That there has been no substantial change in the
conditions existing at the time of the granting of the previous
variances.
SECTION 3. That the granting of the requested extension for
the period of time hereinafter recommended will not be inconsistent
with good planning practice or the provisions of the Master

plan. nor with the present development ot the neighborhood in whioh
subjeot property is located, nor will the granting ot the requested
extension as recommended, adversely affect the general comprehensive
plan.
That the requested extension is necessary for the pre-
servation and enjoyment of substantial property rights ot applioants.
That this Commission recommends to tbe City Council that
the varianoe heretofore granted by Ordinanoe NO.704, as amended by
Ordinance No.Boo, be extended for a period of Five (5) years trom
and atter final action by the City Council, and that said varianoe
be further expanded to permit the addition to existing structures of
an additional structure not to exceed 10 feet by 10 teet in size.
That said extension and expansion should be granted only
it prior to final action by the City Council applicants shall execute
~ and deliver to the City of Aroadia a grant of easement for alley pur-
poses covering the southerly 20 feet, and for street and highway pur-
poses covering the northerly 10 feet ot Petitioners' portion of Lot
6. Tract No.4090.
The property affected by the variance hereby recommended
ls described as follows:
The North one hundred fifty (150) feet of the East
Ninety and fifty-tour one hundredths (90.54) teet
ot Lot six (6), Tract No.4090, aD &hown OD Map re-
corded in Book 43. Page 47 of' Maps. in the offioe
of' the County Recorder of said County;
The Secretary shall cert1fy to the adoption ot this Re-
solution and shall forward a copy to the Ctty Council of the City of
Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was
... adopted by the City Planning Commission at a regular meeting held
on the 12th day of _May, 1953, by the following vote:
AYES: Commissioners BaJ.ser, Berky, Knopp, Pratt and Soreneon ,
