RESOLUTION NO.I08
A RESOLU'l'ION OF THE CITY PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE
GRANTING OF A ZONE VARIANCE AFFECTING CERTAIN REAL
PROPERTY IN SAID CITY TO PERMIT THE CONSTRUCTION,
MAINTENANCE AND OPERATION OF MULTIPLE FAMILY DWELLING
UNITS THEREON.
WHEREAS, there was tiled with this Commission on April 13, 1953,
petition of Fred N. Howser as owner, requesting a zone variance affect-
ing the following described real property:
Parts ot Lots 7, 8, 9 and 10.. Tract NO.13487, as
shown on map recorded in Book 272, pages 14 and
15 of Maps, and part of Lot 1, Tract No. 949, as
snown on map recorded in Book 17, Page 13 of Maps,
records of Los Angeles County, described as follows:
Beginning at the most southerly corner of said lot
10; said point being in the curved n05therlr. line
of Colorado Boulevard; thence North 8 53'24' East
240.18 feet; thence North 60023'32" East 26.29 feet;
thence North 53039'00" East 158.74 feet, thence North
37038'35" East 129.68 teet, thence South 44045'40"
East 114.39 feet; thence South 16031'07" West 55.29
feet; thence South 9032'45" Wes(; ':'.j:'.lJ ..\,e1.; :'h~nce
South 1055'55" West 165.05 feet to the northerly line
of Colorado Boulevard; thence Westerly thereon 301.82
feet to the point of beginning, being a parcel of land
containing 2.628 acres looated on the north side of
Colorado Boulevard, near its intersection with Colorado
Place..
to permit the same to be used for the construction.. maintenance and
operation thereon of multiple family dwelling units; and
WHEREAS, after due notice required by Ordinance No.760 of said
City ot Arcadia a public hearing on th';! matter was held by and before
this Commission on the 28th day of April, 1953, at which time all
interested persons were given a full opportunity to be heard and to
present evidence.
NOW, THEREFORE, the City Planning Commission of the City ot
Arcadia does hereby find, determine and resolve as tollows:
SECTION 1. Although there was protest voiced by William Peter -
Bilge, accompanied by a petition bearing 68 Signatures of adjacent
residents and owners. upon the grounds that such a change ot use if
granted should be done by zone change and not variance, further that
the requested variance would adversely affect adjoining residential
properties~ the City Planning Consultant reported that in his opinion
the property is not desirable for R-l use on account of the surround-
ing uses and the traffic on Colorado Boulevard, and Commissioner
Pratt reported that in his opinion the property did not lend
to R-l uses on account of its location and topography.

Applicant submitted photographs of the property and Architect's
. sketch of the proposed development. That subject property abuts
Colorado Boulevard, a heavily travelled thoroughfare, that adjacent
prope~ties are usable for or developed to the following uses: on
the North for multiple family residential bungalows and to the West
for a restaurant and cocktail lounge. to the South for a drive-in
restaurant, a motel and multiple family dwellings. That a portion
of subject property has a variance for oft- street parking in con-
nection with the restaurant and cocktail lounge on adjacent prope~ty
to the West. That subject property is of uneven contour and is sur-
rounded on the West and Northwest by a high elevation and the re-
mainder being in part many feet below the level of the abutting
street. The property is not ideally situated for single famil1'
development, but is ldeally situated for the type of use requested.
. That the foregOing circumstances are exceptional and do not apply
generally to all property in the same vicinity and zone.
That the granting of the variance as hereinafter recommend-
ed wl1l not be injurious to or detrimental to other properties in
the same vicinity and zone; that the granting of the variance herein-
after recommended is reasonably necessary for the preservation of
substantial property rights of the owners; that the granting of the
var1ance hereinafter recommended will not be materially detrimental
to nor will it adversely affect the comprehensive general plan.
That tor the foregoing reasons this Commission recommends
to the City Council that a variance be granted to permit the property
hereinbefore described to be used tor the construction. maintenance
and operation of multiple family dwellings not to exceed two stories
. in heighth or Fifty-five (55) dwelling units in number, together
witb access, vehicle parking and accessory buildings incidental thereto.
That the granting of the variance hereiD recommended
shall be upon the condition that the variance for off-street auto-
mobile parking on subject propertY,and for a restaurant and cock-
tail lounge on the adjacent property to the West as granted by
Ordinance No.636, be rescinded and cancelled prior to the effective

date of the variance hereby recolIDDended, and upon the further
condition that construction of the 1mprovemenGauthorized by the
variance herein recommended be commenced within Six (6) months
after final action thereon by the City Council and prosecuted to
conclusion with due diligence, and not in any event to exceed
Two (2) years after commencement, and that when thuB completed
no further additions shall be permitted other than repairs, re-
placements and maintenance to existing structures.
The Secretary shall certify to the adoption of this Re-
solution and shall forward a copy to the City Council ot the City
of A:c-cadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
by the City Planning Commission at a regular meeting held on the
12th day of May, 1953, by the following vote:
