RESOLUTION NO. 109
A RESOLUTION OF TIE CITY PLANNING COMMISSION oF
THE: CITY OF ARCADIA, CAL:mlRNIA, RECOMMENDING
TIE ORlWTING OF A ZONE VARIANCE AFFECTING CERTAIN
REAL PROPERTY IN SA! D CITY, TO PERMIT THE CON-
STRUCnON AND MAINTENANCE THEREON oF ONE STORY
APARTME:NT HOUSES, UPON SPECIFIED CONDITIONS.
WHEREAS, on April 28, 1953, this COIIlIIlission did on its own motion, and
pursuant to Resolut~on No. 106, institute proceedings for the consideration
of a zone varianoe to permit tI'e construction and maintenance of single-story,
multiple family dwell1l1gs, on the follOlling described .real property in said
City, to-wit:
rhose portions of Lots :s a>>d 6, Tract No. 949, as shown on Map
recorded in Book 17. Page 13 of Maps, Records of Los Angeles County,
included within the fol.lowing described exterior boundary line:
Beginning at the Southeast corner of Lot 129, Tract No. 12104, as
shOND on map recorded in Book 226, Pages 37, 38 and 39 of Maps,
records of said County; theme Silllltll 870 01' 3Sn East 220 feet to the
WElst line of Baldwin Avenue; thenl;l6 Nortmrlyalong the West l.1ne of
Baldwin Avenue to the North line o~ said Lot 5, Tract No. 949; tl'ieIlI:e

thence Southerly along the Easterly 1111ils ot said Tract No. :141160, Tract

Records of ss1d..County, and aforesaid Tract No. 12104 to the point of
beginning, (being all that property located on the West side of Baldwin
Avenue beginning approxima:tely 2~ feet. North at Huntington Dn va and

hereby find, dete1'll!l.ne, resolve and recommend as foUows:
SECTION 1. That tl'ere were no prote$ts, written or oral, to the granting
of the variance as proposed, and with the conditions hereinafter rec~nded~
that the Los Angeles State and County Arboretum requested that tile norther:Q" 3.3
acres be excepted frl?Pl the proposed variance for the reason that the Arborehm
proposed to purchase the same for additional off-street parld.ng facilities in
connection With the Arboretum; that, except for such proposed acquisition. this
COllllllission finds that the northerly 3.3 acres~ssilnilarly situated and affected
by prevailing condi t1ons. as
the balance of the property under consideration.

SECTION 2. That when subject property was zoned R-l, Baldwin Avenue had
not been extended as a through street North from Huntington Drive; that Baldwin
Avenue is now a through arterial fr01ll Hunt~ton Drive to Colorado Blvd..; that

the property in question faces and is across the street from t he property of
the Los Angeles Turf Club, comprising approximatel;y rour hundred acres dedicated
to horse racing and other recreational and entertaining events, and to the park-
ing of motor vehicles in cormection with such uses; that in the near Vicinity
are horse stables owned by or used in conjunction with the actiVities of the
Los Angeles Turf Club.
SECTION 3. That the construction of IIlI1ltiple-story apartments through-
out the entire area would materially decrease the value of property abutting
on the rear, part;1.cularly but not ~esse.rily J.inlited .to the le$seD1ng of the
privacy of the owners of said property, and a d1ndnltation, if not total lose,
of tbe View presently afforded said owners from their respective properties.
SECTION 4. That the granting of the 'variance 'hareinafter recommended on the
conditions specified, will not be inconsistent with good planning practice or the
proVisions of the Master Zoning plan, or VIi. th the present development of the
general neighborhood in which said prop&rty is located, nor will the granting of a
variance as hereinafter recommended adversel;y affect the general comprehensive
plan..
SECTION 5. SUch variance as hereinafter recommended is reasonab1Jr
necessary for the preservation am. enjoyment of S\1bstantial property rights of
the applicants, for the reason that the present development and use of adjacent
properties and the development of BalMn Avenue as a through traffic arterial
are not conducive to the use of subject property for the uses for which it is
preSent1Jr zoned.
SECTION 6. That for the foregOing reasons this Commission recOllllll6nds to
the City Council that a variance be granted to permit the property hereinbe1'ore
described to be used for the construction and mainte~e thereon of apartment
houllt.,,,n condition that no apartnllnt house thereon constructed shall exceed
one story in heighth, and a maximum of eight.een feet above final grade, and
provided further that the front, side and rear yards shall not be less than
req\l.ired by Section 6 of Ordinance No. 760 of the City of Arcadia, as amended.
