RESOLUTION NO.126
A RESOLUTION OF THE CITY PLAt.lNING COMMISSION
OF THE CITY OF ARCADIA. CALIFORNIA, RECOMMEND-
ING THE GRANTING OF A ZONE VARIANCE AFFECTING
CERTAIN REAL PROPERTIES IN SAID CITY TO PERMIT
THE CONSTRUCTION, MAINTENANCE AND OPERATION OF
AN AtrTOMOBILE SERVICE STATION ON A PART THERE-
OF AND MULTIPLE FAMILY DWELLING UNITS ON THE
REr<lA INDER THEREOF.
YffiEREAS, there was filed with this Commission on September
10, 1953, the petition of Joe E. Earll. Sr.. Lou G. Earll. Joe E.
Earll. Jr., and Jeanne Barry as owners, requesting a zone variance

affecting the following described real property:
I,ots 1. 2, 3, 15. 16, 17 in Block 61-1/2 of part of
Arcadia Santa Anita Tract in the City of Arcadia as
per map recorded in Book 16. Page 58 Miscellaneous Records
of said County, also that portion of the 20 foot alley
running Easterly through said Block 61-1/2 vacated by
Ordinance No.152 of the City of Arcadi~of Lot 15 in
this said Block 61-1/2. C south
to permit tots 1, 2 and 3 thereof to be used for the construction.
.. maintenance and operation thereon of an automobile service station
and the remainder thereof for the construction, maintenanc~ and
operation of multiple family dwelling units; and
\~REAS, after due notice as required by Ordinance No.76o of
the City of Arcadia, a public hearing on the matter was held by
and before this Commission on the 22nd day of September, 1953.
at which time all interested persons were given a full opportunity
to be heard and to present evidence.

NOW, THEREFORE. the City Planning Commission of the City of
Arcadia doeS hereby find~ determine and resolve as follows:
SEC~ION 1. That there were no protests to the granting of
the requested variance. That all of the owners of all properties
abutting the subject property approved the granting of the variance
requested.
SECTION 2. That Lot 1 of SUbject property has only 43.9 feet
frontage on Second Avenue ~nd132.5 feet along Duarte Road and the
Eaat line thereof is only 23 feet. That Lots 2 and 3 of subject
property have only 50 feet frontage on Second Avenue and only 132.5
feet depthj that no one of these lots meets the minimum requirements
of street fronta~e or area under the present Subdivision

. application of a property owner or owners', to ascertain all per-
tinent facts and to determine what, in the face of such facts,
would constitute the greatest adherence to the standards and pur-
poses of this ordinance and to then recommend such interpretations

to the City Council. Upon the review by the City Council and the
approval thereof by ReSOlution, such adjustment shall thereafter
become effective as it pertains to specific property. Proceedings
under this paragraph need not be submitted to public hearings.
SECTION ~ The secretary shall certify ~o the adoption of
this Resolution and shall cause a copy of same to be forwarded to
the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregomg Resolution was adopted
at a regular meeting of the City Planning Commission by the follow-
ing vote.

... was of record prior to June 28, 1940, said lot may be occupied by not
more than one family; and provided that if such parcel of land is a
recorded lot having the required lot area but a minimum width of
fifty (50) feet at the front building line and was of record prior to
January 27, 1949, said lot may be occupied by not more than one family.
There may be one additional dwelling erected for each full seven
thousand five hundred (7500) square feet in excess of the required
minimum of seven thousand five hundred (7500) square feet, but not
more than three single family dwellings will be permitted on anyone
lot or parcel of land in Zone "R-l".
Provided, however, that no main building may hereafter be
erected, constructed or established other than substantially at the
front building line, nor may any additional dwelling be erected,
. except upon the approval of the Modification Committee in accordance
with Section 16 M hereinafter. Such permission shall not be given
if any such main building or additional dwelling will prevent or
interfere with the opening or development of any street the location
of which has been approved by the City Planning Commission and the
City Council, nor if such construction will prevent uniformity of

No lot or parcel of land held under separate ownership at the
time this ordinance becomes effective shall be separated in ownership
or reduced in size below the minimum lot width or lot area required
by this ordinance nor shall any lot or parcel of land held under
separate ownership at the time this ordinance becomes effective and
which has a width or an area less than that required by this ordinance
be further reduced in any manner. No portion of a lot, necessary to
provide the required area per dwelling unit, shall be separated in
ownership from the portion of the lot upon which the building contain-
ing the dwelling unit or units is located.
Where building site areas, other than recorded subdivided lots,
vary from the minimum requirements herein provided, it shall be the
responsibility of the Planning Commission, upon its own motion or by
