RESOLUTION NO. 129 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A PETITION FOR A VARIANCE TO PERMIT THE CONSTRUCTION OF A THmD DWELLING ON A LOT ZONED R-l. WHEREAS, there was filed with this Commission the petition of Harry H. and Edna M. Vogt, requesting a zone variance affecting the westerly 220.92 feet of the southerly 92.5 feet of the northerly 185 feet of Lot 60, Tract No. 808, as shown on map recorded in Book 16, Pages 82 and 83 of Maps in the office of the County Recorder of Los Angeles County, to permit the use of said property in Zone R-l for the construction and maintenance of a third single-family dwelling; and WHEREAS, after due notice as required by law, a public hear- ing on the matter was held by and before this Commission on October 13, 1953, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Planning Commission of the City of Arcadia does hereby find, determine and resolve as follows: SECTION 1. That subject property lacks 2072 square feet of ..he area required for a third single family dwelling in Zone R-l. That the requested third dwelling would necessarily be Qonstructed unreasonably close to the playground on the adjacent school prop- erty. That such a plan does not conform to sound planning principles. That there are no exceptional or extraordinary cir- cUll1Stances or conditions lip plicable to the property involved or to the intended use of the property that do not apply generally to the property or class of uses in the same vicinity or zone. That the granting of the variance is not necessary for the preservation or enjoyment of substantial property rights of the applicant possessed by other property in the same Vicinity or zone. -1- 129 . . . ,. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting ot the City Planning Commission held on November 24, 1953, by the following vote: AYES: Commissioners Anderson.
