RESOLUTION NO.134
A RESOLUTION OF THE CITY PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE
GRANTING OF A VARIANCE AFFECTING CERTAIN REAL
PROPERTY IN SAID CITY TO PERMIT THE CONSTRUCTION,
MAINTENANCE AND OPERATION OF A PUBLIC SCHOOL THERE-
ON.

WHEREAS, there was tiled with this Commission the petition of
the Arcadia Unified School District for a variance to permit the
following described property, to-wit:
Parts of Lots 14 and 17, Arcadia Acreage Tract,
as shown on map recorded in Book 10, Page 13,
of Maps, records of Los Angeles County, described
as follows:
Beginning at a point in the West line of said Lot
14, distant south 100 feet from the northwest cor-
ner thereof' thence south along the west line of
said lots 14 and 17 500.75 feet; thence east 430.92
feet; thence south 93 feet, thence east 430.92 feet
to the west line of First Avenue; thence north
thereon 385.42 feet; thence west 287 feet; thence
north 208.33 feetj/thence west 574.84 feet to be-
ginning, being a parcel of land having 500.75 feet
frontage on Santa Anita Avenue opposite LeRoy Avenue
and Naomi Avenue and ~5.42 feet frontage on First
Avenue in the 1300 and 1400 blocks.

public school thereon; and
WHEREAS, after notice required by Ordinance No. 760 of' said City.
a public hearing was duly held on the matter by and before this Com-
mission on the 8th day of December, 1953, at which time all inter-
ested persons were given a f'ull opportunity to be heard and to pre-
sent evidencej and
NOW, THEREFORE. the City Planning Commission ijereby determines
and resolves as follows:

SECTION 1. That there were protests to the granting of the
proposed variance by owners of adjacent properties upon the ground
that the development ot all of subject property for school purposes
without provision for street eccess would hinder or prevent the
proper development ot such adjacent properties. That said property
is properly located and well suited tor a publiC school and its
acquisition as a school site has heretofore been approved by this
Commission. That the granting of the variance as hereinafter re-
commended will not be inconsistent with good planning practice or

the provisions of the master zoning plan nor with the present or
prospective development of the neighborhood in which said property
is located. nor will the variance as hereinafter recommended
adversely affect the comprehensive general plan. That such
variance is necessary for the preservation and enjoyment of sub-
stantial property rights in that the owner Is the Arcadia Unified
School District charged with the provision of adequate facilities
for the instruction of the youth of this community; that large par-
cels of land properly located are required tor school purposes,
and subject property was acquired after approval of the site by
this Commission and cannot'be lawfully used by Applicant for any
other purposes; that it is essential for the welfare of the in-
habitants of this City that said property be used tor school purposes;
that the granting of the variance as hereinafter recommended will
not be materially detrimental to property or improvements in the
vicinity in which the property is located. That the nature of
Applicant's obligation and the size of the property and the location
required by it are circumstances not applicable generally; that the
public health, safety and welfare require that reasonable provision
be made to enable the acquisition and improvement of public street
access to large adjacent parcels.
SECTION 2. For the foregoing reasons. this Co~ission re-
commends to the City Council of the City of Arcadia that a variance
be granted to permit the above described property. excepting the
northerly 48 feet of the Westerly 434.84 feet thereof, to be used
for the construction, maintenance and operation of a publiC school
thereon. That this Commission further determines that. it by July
1. 1954, reasonable steps shall not have been taken for the ac-
quisition of the portion of the subject property hereinabove approved
for street purposes, this Commission will on its own motion in-
stitute the necessary proceedings to extend any zone variance grant-
ed in the within proceeding to the property hereinabove ~ceptGd.
SECTION 3. The Secretary shall certify to this Resolution
and shall cause a copy to be forwarded to the City Counc1l of the
City or Arcadia.

I HEREBY CERTIFY that the foregoing Resolution was adopted
~ at a regular meeting of the City Planning Commission held on the
t2nd day of December, 1953, by the following vote:
AYES: Commissioners Balser, Berky. KnoPP. Robertson and Sorenson
NOES: NODe
ABSENT: Commissioners Anderson and Pratt.
