RESOLUTION NO. 138 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT DEVIATION FROM FRONT YARD REQUIREMENTS AFFECTING PROPERTY IN TRACT NO. ~9503 IN SAID CITY . WHEREAS. there was filed with this Commission the appli- oation of Aroadia-Monrovia Realty for a variance from the front yard requirements on property facing on proposed Southview Road in Traot No. 19503 to allow a twenty-foot depth of front yard instead ot: a front yard of twenty-t:ive t:eet as required by Ordinanoe No. '760 of the City of Arcadia; and WHEREAS. after due notice as required by law, a public hearing was held thereon by and before this Commission on Feb- ruary 9, 195~, at whioh time all persons interested were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Planning Commission of the City of Aroadia, California, does hereby find, resolve and recommend as follows: 1. That there were no protests, oral or written, to the granting of the variance ohanging the front yard requirements affeoting the property hereinafter desoribed. 2. That the granting of the variance hereinafter reoom- mended will not be inconsistent with good planning practioe nor the provisions of the Master Zoning Plan, nor the present develop- ment of the neighborhood in which the subject property is located, . nor will the granting of suoh variance adversely affeot the com- prehensive general plan. 3. That such variance is necessary for the preservation f and enjoyment of substantial property rights of the owner. ~. '" . ~ . . ... herein and as they may partain to unforeseen circumstances. it shall be the duty of the City Planning Commission to ascertain all pertinent facts concerning said use and by resolution of record set forth its findings and the reasons therefor." and WHEREAS, at a regular meeting this Commission has ascer- tained the pertinent facts and has fully considered the matter; NOW, THEREFORE, the City Planning Oommission of the Oity of Arcadia does hereby determine, resolve and recommend as follows: SECTION 1. That the maintenance and operation of funeral parlors and mortuaries are, by reason of their proprietary nature. their purpose and their method of operation, logically and properly included within the category of theatres, auditoriums and other similar places of assembly as provided in Subsection (d) of Section ... 15 A-2-a-2 of said Ordinance No. 760 rather than within any of the categories specified in Subsections (a), (b) or (c) of said Section 15 A-2-a-2. That proper planning requires that mortuaries and funeral parlors furnish and be required to furnish at least one parking space of two hundred and fifty (250) square feet in the same lot with the main building or contiguous thereto for every four (~) seats provided in such building. computed in accordance with the applicable provisions of said Ordinance No. 760.
