HomeMy WebLinkAbout0144 . . . . .rI.. -r . . . , RESOLUT ION NO. 144 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A PETITION FOR A VARIANCE TO PERMIT THE CONSTRUCTION AND MAINTENANCE OF A SERVICE STATION ON PROPERTY IN ZONE R-l. WHEREAS, there was filed with this Commission, the petition of Helen S. Howser. requesting a zone variance affecting the following described property to-wit: A part of Lot 10, Tract No. 134.87, as shown on map recorded in Book 272, pages l~ and 15 of Maps, records of Los Angeles County, beginning at the most westerly corner of said lot, thence North 590.261 44" East along the northerly line of said lot a distance of 113.06 feet~ thence South 410 50' 30n East 131.02 feet; thence South 580 28' West 138.54 feet to the east line of COlorado Street; thence northwesterly thereon 130.86 feet to the point of beginning. being a parcel of land located at the southeast corner of Colorado Street end Oakhurst Lane, having a frontage of 115.86 feet on Colorado Street and 113.06 feet on Oakhurst Lene, to be used for the construction, maintenance and operation of a Texaco Service Station thereon, as in said petition more fully set forth; and WHEREAS, after due notice as required by law, a public hea:ring on the matter was held by end before this Commission on February 9, 1954, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Planning Commission of the City of Arcadia does hereby find, determine and resolve as follows: SECTION 1. That the requested variance is not necessary for the preservation or enjoyment of a substantial property right of the applicant possessed by other property in the same vicinity or zone, for the reason in part that such property has eJ.ready been accorded relief from the strict enforcement of the regulat ions applicable to properties in Zone R-l and that the variance afford- ing such relief is still in full force and effect as to subject - 1 - ,),(. -'" ,. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Plll1ning COllllllission held on March 23. 1954, by the following vote: AYES: Commissioners Anderson, Balser, Berky, Knol)P, Pratt. That though some additional relief for subjeot property may be proper, the construction, maintenance and operation of a gasoline service station on subject property is not a proper form of such relief for reasons more fully stated hereinafter. . . SECTION 2. That the granting of the variance requested will not only be materially detrimental to the public welfare but .,ill be particul arly injUrIous to the property and improvements in such vioinity and zone in which the subject property is located; that the properties adjacent to subject property are extensively and expensively improved and were thus improved largely during and in reliance upon a previous varianoe for the development of subject property to uses considerably less objectionable and obnoxious than the use presently requested; that the subject property is located in an extremely hazardous location !"rom the traffic standpoint, at a point and in an area where numerous fatal and near fatal auto- mobile accidents have occurred; that the construction and opel'ation of a service station at such location will unreasonably and greatly further incl'ease the existing traffic hazards. SECTION 3. That there are no exceptional or extraordinary conditions aPPlicable to the property involved as to warrant III variance from the provisions applicable to R-l properties so as to permit the construction and maintenance of an automobile service station. That subject property was only recently acquired by appli- cant with full knowledge of all applicable regulations and relief heretofore afforded and the applicable restrictions should not be oonstrued to impose any undue hardship upon the owner thereof. SECTION 4. For the foregoing reasons this Commission recommends to the City Council of the City of Arcadia that the petition of Helen S. Howsel' fol' a variance affeoting the property hereinabove described be denied. SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be - 2 -
