RESOLUTION NO. 1~6
A RESOLUTION OF THE CITY PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, MAKING CERTAIN
FINDINGS AND RECOMMENDATIONS RELATIVE TO THE PRO-
POSED AMENDMENT OF ORDINANCE NO. 760 OF SAID CITY
WHEREAS, purusant to Section 17 or Ordinance No. 760 or
the City of Arcadia. the City Planning Commission or saId city
did, on Martih 9, 1954, pass, approve and adopt its certain Reso-
lution No. 14.1 entitled "A RESOLUTION OF THE CITY PLANNING COM-
MISSION OF '!'HE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION
TO INSTITUTE PROCEEDINGS FOR THE CONSIDERATION OF AND MAKING
RECOMMENDATIONS CONCERNING THE AMENDMENT OF SECTION l5-c-3-d OF
ORDINANCE NO. 760 OF THE CITY OF ARCADIA WITH REFERENCE TO THE
LOCATION OF SWIMMING POOLS", pursuant to whitih notice was duly pub-
lished and given and a public hearing held on the 2}rd day of March,
1954, at which time all persons present and interested were given
full opportunity to be heard and to present evidence relative to
the matter Qf the proposed amendment of Ordinance No. 760 or said
city as provided in said Resolution No. 141; and
WHEREAS, said Planning Commission having received and
fully considered all the evidence and testimony and reviewed the
subject generally;
NOW, THEREFORE, the C1 ty Planning Commission or the City
or Arcadia does hereby find, determine and resolve as ro1lows:
SECTION 1. That the public necessity. convenience and
general welfare require and this Commission hereby recommends to
the City Council of the City of Arcadia that Ordinance No. 760 of
said city be amended in the following partiCUlars:
That Section 15, Subsection C-}-d be amended to read as
follows:

"d. An accessory building may occupy not more than
twenty-five per cent (25%) of a required rear yard, provided such
building is not more than one (1) story in height and located at
least fifteen (15) feet from the nearest part of a main building.
No accessory building over one (1) story in height shall occupy
any part of a required rear yard.
"On corner lots an accessory building shall be located
not less than ten (10) feet from the rear lot line unless such
building is constructed as required by the Building Code of the
City of Arcadia regarding fire resistance. on corner lots an acces-
sory portion of a main building shall be not more than one (1)
story in height, and shall be located not less than ten (10) feet
from the side street line and not less than ten (10) feet from the
rear lot line.
"~n reverse corner lots an accessory building shall be
located not less than fifteen (15) feet from the side street line.
and not less than five (5) feet from the rear lot line. On re-
verse corner lots an accessory portion of a main building shall be
not more than one (1) story in height and shall be located not
less than fifteen (J5) feet from the side street line and not less
than ten (10) feet from the rear lot line."
Private swimming pools may occupy any portion of a lot
except as hereinafter provided, and the open portions of such pool
shall be deemed as open and unobstructed area for the purpose of
computing yard and area requirements.
Private swimming pools may not be constructed and main-
tained in any required front yard, nor within three feet of any
side or rear lot line. nor within ten (10) feet of the property
line on the street side of a corner lot.
SECTION 2. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy of t he same to be for-
warded to the City Council of the City of Arcadia.

I HEREBY CERTIFY that the ~oregoing Resolution was
adopted at a regular meeting o~ the City Planning Commission held
on April 13, 1954. by the ~ollow1ng vote:
AYES: Commissioners Bals er, Berky, Knopp, Robertson
and Sorenson
NOES: None
ABSENT: Commissioners Anderson and Pratt

warded to the city Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Planning Commission held on
April 13, 1954. by the following vote:
AYES: Commissioners Bal ser, Berky. Knopp, Robertson and
Sorenson
NOES: None
ABSENT: Commissioners Anderson and Pratt

. f'oregoing curcUlnstance is exceptional and is not applicable to
other properties in the same zone.
That the granting of' the variance requested. upon the
conditions hereinafter proposed will not, because of the develop-
ment and use of' other properties in the same vicinity. be incon-
sistent with good planning practice or the provisions of' the master
zoning plan. or with the present development of' the general neigh-
borhood in which said property is located, nor will the granting of'
the variance as hereinafter recommended adversely &tf'ect the com-
prehensive plan.
That such variance is necessary f'or the preservation and
enjoyment of' substantilil. property rights of' the applicant, f'or the
reason that the present development and use of adjacent properties
4t are not conducive to the use of the subject property f'or the uses

f'or which it is presently zoned.
That such conditions then f'ound to exist remain substan-
tially unchanged and are generally applicable to subject property
here in.

SECTION 3. That f'or the f'oregoing reasons this Commis-
sion recommends that the variance heretof'ore granted to applicant
be extended to permit the use of' the Easterly 40 feet of Lots 34.
35 and 36, Block 79. Santa Anita Tract. to be used for the busi-
ness of fabricating and manufacturing purposes and the storing of
materials therefor. so long as it be limited to the period of' time
during which Lot 3. Block 79, Santa Anita Tract, be developed,
maintained and used by applicant f'or vehicular off'-street parking
in connection with the business conducted on the af'oresaid Easterly
40 feet of Lots 34. 35 and 36. This condition shall not preolude
the owner of said property from restricting the use of said lot
to the employees or customers of applicant's business.
SECTION 4. The Secretary shall certify to the adoption
